64-489RESOLUTION N0o 64R-489 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT PUBLIC CON- VENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION AND COMPLETION OF A PUBLIC IMPROVEMENT~ TO WIT: '~~KOVEi¥~IqT OF THE INTERSECTION AT OLIVE AND ALBERTA STREETS, IN THE CITY OF ANAHEIM: JOB NO. g68. ~k-P~k~J!NG THE ~~ P OFILES~ D WIN~S A~%~D SPECIFICATIONS FOR THE CONSTRUCTION THEREOF; AUTHORIZING THE CONSTRUCTION OF SAID PUBLIC IM~' PROV~NT iN ACCORDANCE WITH SAID PLANS~ SPECI~, FtCAI'ION$~ ETCo; AND AUTHORIZING AND DIRECTING THE CIT~ CLERK TO PUBLISH A NOTICE INVITING SEALED PROPOSALS FOR THE CONSTRUCTION THEREOF. WHEREAS~ public convenience and necessity require the const~'uction and completion of a public improvement in the City o~ Anaheim,, to wi~ Tke im~rovem<~n~ .of L-he intersection at Olive and Alberta 3treeizs~ in the City of Anaheim, consisting c:f excavation~ including hauiaway and disposal; construction of A.C. pavement, including palnt binder~ fog seal coat and saw cutting, Portland Cement Concrete cross gutter cu.~.o~_ns, removal of existing drainage structure, and appuz-tenant work as more particularly set forth in the plans and speci- fications on :file in the Office of the City Clerk or City Engineez'~ Job No. 868. gX.D WF~REA$~ the City Council instructed the Public Works ~~t. to prepare detailed ~gns~ p~ pro~.~es~ drawings an-~specifications, and estimates of quanti~ies and costs and make necessary surveys for the con- struction of said public improvement; and WHEREAS, said Public Works Deoartment has prepared said detailed de-~gns~ ~~ ~i]-~~gs and specifications for the construction of said public improvement and has submitted the same to the City Council.; and WHEREAS, the City Council finds that the detailed designs~ plans, profi, les~ drawings and specifications for said public improvement above mentioned, are i.n accordance with good engineering pract~ice and are adequate to serve the needs and requirements of the City of Anaheim and the citizens and resi- dents in. said area for the purposes for which they are intended, and that they are adequate for the construction of said public improvement and should be approved. NOW~ THEREFORE~ BE IT RESOLVED by the City Council of the City of Anaheim that the detailed designs, plans, profiles~ drawings and specifications for said public improve- ~e~t hereinabove mentioned and described, be, and the same are hereby, approved and adopted as prepared by said ___~A~ ~ ~orks Department o AND BE IT FURTHER RESOLVED that said public improve- me~t skall be constructed in accordance with said detailed designs, plans, profiles, drawings and specifications as prepared by said Public Works Department and hereby ~pproved~ and such addenda or modifications thereto as may be ~ppr©ved prior to the awarding of bids therefor. BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to publish a notice according to law, inviting sealed proposals for the furnishing of all plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary to construct and complete, in a good and workmanlike manner, in ~tric~ accordance with said detailed designs, plans, profiles, Crawings and specifications as prepared by said Public Works Department , the public improvement hereinabove ~e~tioned and described, and fixing the 6th day of ~ Au~us~ , 19~, at the hour of 2:00 o'clock PoM. as 7~e d~te and hour for the opening of said bids at the City Counc~i Chamber in the City Hall in the City of Anaheim, and ~.h~!t said notice shall be published twice, the first of which tubiications shall be at least ten (10) days prior to the date iixed for the opening of bids, and that said publications ~h~].i. be at least five (5) days apart. AND BE IT FL~THER RESOLVED that the successful ~d. de~ or bidders shall be required to enter into a contract with the City of Anaheim in the manner and form approved by ~he City Attorney of the City of Anaheim for the construction, i~s~aliation and completion of said public improvement herein~ abcve mentioned and described, in accordance with the plans ~nd specifications prepared by said Public Works Department the notice inviting sealed proposals, this resolution and all applicable City Ordinances or Code Sections and the laws of the State of California, and shall be required to post bonds and insurance in the amounts and within the time required by law, a~ specified in the notice inviting sealed proposals, and in a form approved by the City Attorney. this THE FOREGOING RESOLUTION is approved and signed by me 14th day of July , 19 64 .
