RESOLUTION NO. 64R-481 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. _~. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from VESPER B. WHI~E, 12912 - 9th Street, Garden Grove, Califor- nia, to create three R-A, RESIDENTIAL-AGRICULTURAL ZONE lots of less than one acre each from the parcel of property herein- after described, and to permit the establishment of a church facility on the rear 223-foot lot of said parcel. Said property is situated in the City of Anaheim, County of Orange, State of California and is more particularly described as follows: That portion of the South half of the Northeast quarter of Section 17, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, described as follows: Beginning at a point in the South line of said North- east quarter distant thereon West 758.08 feet from the Southeast corner of said Northeast quarter, said point of beginning also being on the South line of the land described in the deed to Anna L. Meredith and J. F. Meredith, recorded July 31, 1952 in Book 2363, page 411 of Official Records, distant thereon West 98.08 feet from the Southeast corner of said land; and running thence North 0° 18' West parallel with the Easterly line of said land 444.4 feet to the Northerly line of said land; thence Southerly 89© 29' 07" West along said North line 97.96 feet; thence South 0° 18' East parallel with the Easterly line of said land 444.94 feet to the Southerly line of said land; thence South 89° 10' 10'~ East along said Southerly line 97.96 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on March 16 , 19 64 , notices of which said public hearing were duly given as required by law and the provisions of Title 18 Chapter 18.76 of the Anaheim Municipal Code; and ' WHEREAS, said Commission, after due inspection, investigation and studies m~de by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1094 Series 1969-64 , denyin~ Conditional Use Permit No. 543 ; and -1- WHEREAS, thereafter, within twenty~two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denvin~ said Conditional Use Permit and said appeal was sera--hearing on April 21 , 19~ 64 ~ at th~ City Hall, in the City of Anaheim, and notices of such public nearing were duly given as required by law and the provisions cf Title 18, Chapter ]8.76 of the Anaheim Municipai Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports~ and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: The proposed use is properly one for which a Conditional Use Permit is authorized by the A~naheimMunicipal Code° Ne proposed use will not adversely affect the adjoining land uses and the growth and develop~ ment of the area in which it is proposed to be 1, ocated~ The size and shape of the site propos~md for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare~ o The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area~ o The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim° NOW~ THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion denying said Conditional Use Permit be, and the same is hereby disapproved ~ and that Conditional Use Permit Noo 543__5-~7~same is hereby, granted permitting the creation of three R-A, RESIDENTIAL-AGRICULTURAL ZONE lots of less than one acre each from the parcel of property hereinbefore described, and permitting the establishment of a church facility on the rear 223-foot lot of said parcel, subject to the following conditions: That the owner of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Orange Avenue, for street widening purposes. (a) That all engineering requirements of the City of Anaheim along Orange Avenue, including prepara- tioB of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. That trash s~orage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire department, said fire hydrants to be installed prior to final building inspection. o That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot, along Orange Avenue, for tree planting purposes. That a 22-foot private driveway shall be provided from Orange Avenue to serve the property. That Conditions Nos. 1, 2(b) and 5 above-mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, her heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
