64-412RESOLI~T [OM NO~ 64R-4i2 A RESOi./~'I'ION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAI lille lg OF THE ANAHEIM ~INICIPAL CODE REI.AI"ING IO ZONINC SHOULD ~E A~NDED AND T~'I' THE BOUNDARIES OF CERTAIN ZONES SHOI'qD BE C~NGED_ WttER'~iRS, the C~tv Planning Commission of the City of Anaheim did hold a p~bli, c ~earing in Reclassification Proceed- ings No. 63-64-109 ~o consider an amendmen~ to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a. change in the boundaries ~f the zone or zones hereinafter mer~tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff~ amd WHERF~S, withim a period of forty days following said hearing thereon the Planning Commission did duly adopt a reso- lution containing a report of its findings, a summary of the evidence presented a~ said hearing, and a recommendation that the proposed amendmen~ be adopted by the City Council and that a certain zone or zo~'~es be changed as hereinafter set forth; and ~tEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission ~he City Council did fix the 3rd day of June , 19 64 , as the time and the City Council Chambers in the City Hail of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim b~nicipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is ~ow situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the mapner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, a~ the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 63-64-109 The North 239~50 feet of the West 252.00 feet of the East 517.00 feet of the northeast quarter of the northwest ~uarter of the southeast quarter of Section 13 Township 4 South Range 1i West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California as per map recorded in boo~ 51 page il of Miscellaneous Maps, in the office of the county recorder of said county. EXCEPT the North 173.00 feet of the West 97.00 feet of the East 167.00 feet thereof~ be excluded from R-A, i~SIDENTIAL-AGRICULTURAL ZONE, and incorpo- rated in R-l, ONE-FAMILY P~SIDENTIAL ZONE, upon the following conditions: That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Orange Avenue, for street ~idening purposes. (a) That all engineering requirements of the City of Anaheim along Orange Avenue, including preparation of improvement olans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. That the o~ers of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Orange Avenue, for street lighting purposes. m That the owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Orange Avenue, for tree planting purposes. That a Record of Survey to record the approved division of subject property shall be recorded in the Office of the Orange County Recorder. That the ov~ers of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. That subject property shall be developed substantially in accordance with plans and. specifications on file with the City of Anaheim, marked "Exhibits Nos. 1, 2, 3, 4 and 5." That Conditions Nos. 1, 2(b), 3, 4 and 5 above-mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. -2- BE IT FURIHER RESOLVED that the City Attorney be, ar.d he is hereby authorized and directed to prepare and submit tp the City Council an ordinance amending Title 18 of t'he Ar~.aheim Municipal Code to accomplish the objects herein found amd deter~ mined to be necessary and proper. this 3rd ATTEST~, I'HE FOREGOING RESOLUTION is approved and signed by day of June _ , 1964 .
