RESOLUTION NO. 64R-352
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH NORTH AMERICAN AVIATION, INC.,
AUTONETICS DIVISION, WITH REFERENCE TO THE
PLACING OF A PORTABLE TRAFFIC SIGNAL AT THE
INTERSECTION OF MILLER AND '~B" STREETS.
WHEREAS, North American Aviation, Inc., Autonetics
Division, has located an industrial plant within the corporate
limits of the City of Anaheim, California, and employs a large
number of persons in the operation and maintenance of said
plant; and
WHEREAS, building 231 of said Autonetics Division of
said corporation is located at the intersection of Miller
Street, a public highway, and "B" Street, a private road be-
longing to North American Aviation, Inc., Autonetics Division;
and
WHEREAS, large numbers of employees of said Autonetics
Division cross Miller Street at its intersection with '~B"
Street in the morning and evening hours; and
WHEREAS, said employees crossing impedes the normal
flow of traffic and creates a hazard; and
WHEREAS, Section 21360 of the Vehicle Code of Califor-
nia permits local authorities to place and maintain official
traffic control devices at the intersection of a highway and a
private road; and
WHEREAS, it is the desire of the City and said North
American Aviation, Inc., Autonetics Division, to place a port-
able traffic signal at Miller Street and "B" Street to lessen
the hazardous traffic condition which presently exists.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an agreement be made and entered into
by and between the City of Anaheim and North American Aviation,
Inc.~ Autonetics Division~ providing for the deputizing of
employees of North American Aviation~ Inc.~ Autonetics Division
by the City to make them deputized police officers of the City
for the purpose of placing a portable traffic signal at the
intersection of Miller and ~B" Streets~ upon the following
terms and conditions'

The City shall deputize such employees of North
American Aviation, Inc., Autonetics Division, as
said North American Aviation~ Inc., Autonetics
Division, wishes to have deputized and make them
deputized police officers of the City for the
purpose of placing a portable traffic signal at
the intersection of Miller Street, a public street,
and '~B" Street, a private road.

North American Aviation, Inc., Autonetics Division,
shall pay on behalf of the City, its officers, agents
or employees, all sums which it may and shall become

obligated to pay by reason of liability imposed
upon the City by law arising out of or as a result
of negligent acts~ either of commission or omission
in the performance of duties by such employees
deputized by the City as police officers either on
or off of the property of North American Aviation,
Inc., Autonetics Division.
North American Aviation, Inc., Autonetics Division,
shall furnish said portable traffic signal, which
signal is to be approved by the Traffic Engineer of
the City of Anaheim.
Said portable traffic signal shall be placed and
in use only between the hours of 7:30 to 8:30 A.M.
and 4:45 to 6:00 P.M.
The signal phase of said portable traffic signal
shall be determined by the Traffic Engineer of the
City of Anaheim and said phase shall favor traffic
on Miller Street.
Ail compensation of the employees of North American
Aviation, Inc., Autonetics Division, deputized by
the City as police officers of the City of Anaheim
shall be paid by North American Aviation, Inc.,
Autonetic s Division.
Before any such employees are deputized, as herein
provided, the fingerprints of such employees shall
be submitted to the Chief of Police of the City of
Anaheim for investigation to ascertain if such
persons have good moral character and a clear
record; and if it is found that any such employees
are not of good moral character or do not have a
clear record or, in the opinion of the Chief of
Police of the City, would not be a desirable person
or a safe risk to be deputized as such police
officers, such employees shall not be deputized
as such police officers; or, in the event they have
been deputized in the interim and prior to the
completion of such investigation, the City shall
have the right to revoke their appointment as
deputy police officers of the City of Anaheim; and
if at any time it shall be found that any employee
deputized as a police officer to act as such
officer for and on behalf of North American Aviation,
Inc., Autonetics Division, shall be found not to have
a good moral character or a clear record, or does
any act or engages in any conduct which the City
deems inimical to the best interest or welfare of
the City of Anaheim, the City shall have the right
to revoke the appointment of such employee.
Said agreement shall remain in force for an indefinite
term, except that it may be terminated at any time by
a notice of termination by either party, mailed or
delivered to the other party at least thirty (30)
days prior to the effective date of termination set
forth in such notice. In the event, however, that

North American Aviation, Inc., Autonetics Division,
shall fail to comply with any of the terms, condi-
tions or provisions of said agreement within ten
(10) days from date of receipt from the City of
notice so to do, then said agreement may, at the
option of the City, be terminated.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
