RESOLUTION NO. 64R- 343
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AN AMENDMENT
TO THAT CERTAIN CONTRACT AND AMENDMENTS
THERETO, FOR COLLECTION AND DISPOSAL OF
RUBBISH AND WASTE MATERIAL ENTERED INTO
ON JUNE 27, 1956 BY THE CITY OF ANAHEIM
AND C. V. TAORMINA, DOING BUSINESS AS
ANAHEIM DISPOSAL COMPANY.
WHEREAS, a contract was entered into by and between
the City of Anaheim and C. V. Taormina, doing business as
Anaheim Disposal Company, as of the 27th day of June, 1956,
and said contract was extended and re-executed on the 1st day
of July, 1958; and
WHEREAS, the parties to said contract have entered
into amendments to said contract and have extended the term
thereof to June 30, 1964; and
WHEREAS, the parties to said contract do mutually
agree that said contract should be extended, in accordance
with its terms as modified by the amendments thereto heretofore
entered into, to June 30, 1968, with a proviso that should a
trash transfer station be constructed and open for use of the
contractor, then the terms of the contract regarding payment
to said contractor shall be renegotiated.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that that certain contract entered into
on June 27, 1956, by and between the City of Anaheim and C. V.
Taormina, doing business as Anaheim Disposal Company, extended
and re-executed on July 1, 1958 and thereafter amended and the
term thereof extended to June 30, 1964, be and the same is
hereby extended as modified to and including June 30, 1968,
subject to the following condition:
"Should the County construct and open for
operation a trash transfer station in the
Southeastern area of the CITY or in close
proximity to said area of the CITY, then
the payments to the CONTRACTOR as set forth
in the contract documents shall be renegotiated
by the parties to said agreement, and should said
parties fail to agree upon a reasonable and pro-
per payment to the CONTRACTOR within thirty (30)
days after said trash transfer station is in
operation, then the said contract as extended
shall cease and terminate at the end of said
thirty-day period and shall thereafter be of
no further force and effect."
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized and directed to enter into
a contract for and on behalf of the City of Anaheim with C. V.
Taormina, doing business as Anaheim Disposal Company, amending

that certain contract entered into on June 27, 1956 and
~mendments thereto, as more particularly hereinabove set
forth.
THE FOREGOING RESOLUTION is approved and signed
by me this 12th day of May, 1964.
