A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 541 .
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from DONNA A. BOWEN, 2648 West Ball Road, MASAMI OGATA, 2656 West
Ball Road, and JOHN G. WEBER, 2664 West Ball Road, Anaheim, Cali-
fornia, to construct a one and two-story multiple-family, planned
residential development, with carports, and permitting a waiver of
the following Anaheim Municipal Code requirements:
1. One-story height limitation within 150 feet of R-A
zoned property;
2. Minimum lot width and area;
3. Required frontage of all lots on a dedicated street
or alley;
4. Required side yards,
on the following described property situated in the City of Anaheim,
County of Orange, State of California, to wit:
The East 396.00 feet of the northwest quarter of the north-
east quarter of the northeast quarter of section 24, Town-
ship 4 South, Range 11 West, in the Rancho Los Coyotes,
City of Anaheim, County of Orange, State of California,
as said section is shown on a map recorded in book 51
page 11 of Miscellaneous Maps, in the office of the County
Recorder of said county.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on March 30th , 19 64 , notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies made by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. _~Series 1963-64
, ~rantin~ Conditional Use Permit No. 541,
~Ubject.... to the ~onditi~ns therein set forth ; and
WHEREAS, thereafter, within twenty-two (22) days
from the date of the adoption of said resolution, the City
Council did elect, upon its own motion, to review the action
of the City Planning Commission in grantinm said Condi~
tional Use Permit and did thereupon fix th~ 21st day of
~Anr~ 1,9_~k__, as the time and the COuncil Chamber
in t~e ity Hall of the City of Anaheim as the place for a
public hearing upon said Conditional Use Permit, and notices
of such public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such
hearing and did give all persons interested therein an oppor-
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said
hearing, that:

The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municipal Code.

The proposed use will not adversely affect the
adjoining land uses and the growth and develop-
ment of the area in which it is proposed to be
located.
The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.

The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and improved to carry the
traffic in the area.

The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim°
NOW~ THEREFORE~ BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Plannin~
Commission ~ranting said Conditional Use Permit be, and
the same is h~reby -~ustained , and that Conditional Use
Permit No. 541 be, and the same is hereby, granted
permitting t~e c6~struction of a one and two-story multiple-
family, planned residential development, with carports, and
a waiver of the following Anaheim Municipal Code requirements-
1. One-story height limitation within 150 feet of
R-A zoned property;
2. Minimum lot width and area;
3. Required frontage of all lots on a dedicated street
or alley;
4. Required side yards,
on the property hereinbefore described, subject to the following
conditions:
i ·
That the owners of subject property shall pay to the
City of Anaheim the sum of $25.00 per dwelling unit,
to be used for park and recreation purposes, said
amount to be paid at the time the building permit is
issued.

That trash storage areas shall be provided in accord-
ance with approved plans on file in the Office of
the Director of Public Works and Superintendent of
Streets, prior to final building inspection.

That fire hydrants shall be installed as required and
determined to be necessary by the Chief of the Fire
Department, said fire hydrants to be installed prior
to final building inspection.

That subject property shall be developed substantially
in accordance with plans and specifications on file
with the City of Anaheim, marked "Exhibit No. 1,
Revision No. 1," and "Exhibits Nos. 2, 3, 4 and 5."
·
That a 6-foot masonry wall shall be constructed along
the southerly property line, prior to final building
inspection.
·
That 6-foot masonry walls shall be constructed along
the east and west property lines, and that a bond
in an amount and form satisfactory to the City of
Anaheim shall be posted with the City, prior to
final building inspection, to guarantee the con-
struction of said walls.
·
That this Conditional Use Permit is granted subject to
the completion of Reclassification Proceedings No.
63-64-91 now pending.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owners, their heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
THE FOREGOING RESOLUTION is approved and signed by
me this 21st day of April, 1964·
