AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
CHAPTER 1.04 OF TITLE l OF THE ANAHEIM MUNICIPAL
CODE TO INCREASE THE MONETARY LIMITATIONS
ON THE AUTHORITY OF THE CITY PURCHASING AGENT
WHEREAS, the authority of the City Purchasing Agent to bind the City on contracts in
writing without previous approval of the City Council has been established at twenty thousand
dollars ($20,000.00) since July, 1988; and
WHEREAS, the limitation on authority of the Purchasing Agent has resulted in
consuming the time and attention of the City Council on contracts of a routine nature as inflation
and costs of materials has increased the cost and value of city contracts since 1988; and
WHEREAS, Section 518 of Article V of the Charter of the City of Anaheim authorizes
the City Council to impose a monetary limit upon the authority of those designated by City
Council to bind the city by contractual agreements.
NOW, THEREFORE, the City Council of the City of Anaheim does ordain as follows:
Section 1. That Section 1.04.260 of Title 1 of the Anaheim Municipal Code be, and the
same hereby is, amended in its entirety to read as follows:
"1.04.260 PURCHASING AGENT - POWERS
The Purchasing Agent is hereby designated as an officer of the City and, as such, is
empowered to sign contracts in the name of the City. The Purchasing Agent is authorized to bind
the City on contracts in writing without previous approval of the Council when the value of the
contract does not exceed one hundred thousand dollars ($100,000.00) except as may be limited
by section 12111 of the City Charter."
Section 2. Effective Date
This ordinance shall take effect thirty (30) days from and after its enactment.
Section 3. Publication
The City Clerk shall certify to the passage of this ordinance and shall cause the same to
be printed once within fifteen (15) days of its passage in the Anaheim Bulletin, a newspaper of
general circulation published and circulated in said City.
Section 4. Savings Clause
Neither the adoption of this ordinance nor amendment of any other ordinance of the City
shall in any manner affect the prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as a waiver of any tax, license or
penalty or of the penal provisions applicable to any violations thereof. The provisions of this
ordinance, insofar as they are substantially the same as ordinance provisions previously adopted
by the City relating to the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
Section 5. Severability
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such invalidity shall not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Anaheim hereby declares that it would have adopted
this ordinance and each remaining section, subsection, sentence, clause phrase or portion thereof
irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or
portions have been declared invalid or unconstitutional.
THE FOREGOING ORDINANCE is approved an adopted by the City Council of the
City of Anaheim at its regular meeting this 27th day of April ,
2004, by the following roll -call vote:
