RESOLUTION NO. 64R-200 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 63-64-62 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zo~.e or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 24th day of March , 19 64 , as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, ~and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Cgde should be adopted and that the property hereinafter descrzbed should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit' -1- 63-64-62 PORTION ':A':: That portion of Tract No. 787, as shown on a Map recorded in Book 24, page 9 of Miscellaneous Maps, records of Orange County, California, described as follows: Parcel 1: Lots 3 to 16, inclusive, Lots 18 and 20, and Lots 1, 3 and 4 of Block A of said. Tract No. 787. Excepting that portion of Lot 1 of Block A adjoining the West line of said Lot 17 of said Tract No. 787. Also excepting that portion of Lot 3 of Block 7-.. lying within the 60.00 foot right of way of Webster Avenue. Parcel 2: Lots 1 to 16, inclusive, and Lots 1 and 5 of Block A of Tract No. 796, as shown on a Map recorded in Book 24, page 28 of Miscel- laneous Maps, records of Orange County, California. Excepting therefrom the South 31.5 feet of Lot 9 and. the North 43.5 feet of Lot 10 of said Tract No. 796. Also excepting that portion lying within the 60.00 foot right of way of Webster Avenue. PORTION '~B'~': That portion of Tract No. 789, as shown on a Map recorded in Book 24, page 28 of 14iscetlaneous Maps, records of Orange County, California, described as follows: Lots !, 2 and 19, and that portion of Lot 4, Block /~., adjoining the East line of Lot 1 of said Tract 789. Excepting therefrom that portion lying within Ball Road.. be excluded from ii-A, RESIDENTIAL-AGRiCULTURAL ZONE, and incorporated. in the following zones upon the conditions hereinafter set forth: Thst Portion '~A'~ of the above described pz-ope~-~- ,~y shall be changed, to and. incor- porated in X-3, MOLTIPLE-FgMILY RESIDENTIAL ZONE; and That Portion ~B;~ of the above described ?rcpe~:ty shall be changed. 'to and. incor- porated in C-l, NEiGHBORI{OOD-COMMERCIAL ZONE. That said, change of zones shall be made upon the following condi;;ions: i . That the o~mers of subject property shall deed. to the City of Anaheim a s'crip of land. 32 feet in w-;dt~, :_rom the center line of 'the street, along Orange Avenue and Webster Avenue, for street widening puz'poses. -2- · · · · · · · 10. That the owners of subject property shall deed to the City of Jmaheim a strip of land. 53 feet in width, from the center line of the street, along Ball Road, for street widening purposes. (a) That all engineering requirements of the City of Anaheim along Orange Avenue, Webster Avenue and Ball Road, including preparation of improvement plans and installation of all improvements, such as curbs and. gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance ~Tith standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to suarantee the installation of said engineering requirements. That the o~zmers of subject property shall pay to the City of .<~aheim the sum of $2.00 per front foot, along Orange Avenue, Webster Avenue and Ball Road, for street lishting purposes. That the owners of subject property shall pay to the City of .gnaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of .Public Works and Superintendent of Streets, prior to final building inspection. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection; and that a water flow shall be provided, which is determined by the Chief of the Fire Department to be sufficient for adequate fire protection. That a modified cul-de-sac shall be constructed at the terminus of Conley Avenue which shall be subject to approval of the City Engineer; and that said cul-de-sac shall be provided by the owners of the property located east of the tez~ninus of Conley Avenue. That ~he owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Orange Avenue, Webster Avenue and Ball Road, for tree planting purposes. That plans for the development of any portion of sub- ject property shall be submitted to the Development Review Board. for report and recommendation to the City p1~ -~ ~ =nnzn~ Commissien and City Council, and that said. plans shall be subject to the approval of 'the Commis- sion and Council; provided, however, that any plans for any parcel of property in Portion '~A" shall be limited to a density not exceeding 18 dwelling units per net residential acre or buildin$ site, and shall be limited, to one-story construction within 150 feet -3- of any property classified R-I, One-Family Resi- dential Zone; and provided further, that plans_ for Portion '~B" shall conform to all provisions of the C-l, Neishborhood-Commercial Zone. 11. That any buildings presently located on subject property shall be removed prior to the develop- ment of the property for C-1 and R-3 uses, . respectively. 12. That the various parcels of property included in these reclassification proceedings may be re- classified separately; howe~er, prior to the adop- tion of an ordinance reclassifying any portion of subject property a legal description of said portion shall be furnished the City by the property owner. 13. That Conditions Nos. 1, 2, 3(b), 4, 9 and 12 above- mentioned shall be complied with prior to the adoption of an ordinance reclassifying the respec- tive parcels of property. BE iT FUi%THEX ~iESOLVED that 'the City Attorney be, and ae is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
