RESOLUTION NO. 64R-195
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE EXECUTION OF AN AGREE-
MENT WITH EUREKA WATER SYSTEM WITH REFERENCE
TO THE FURNISHING OF WATER FOR TRACT NO. 796.
WHEREAS, the City of Anaheim desires to lower the
grade of Webster Avenue between Orange Avenue and Ball Road
so that adequate drainage can be provided for this area; and
WHEREAS, said grade lowering will necessitate re-
location of water lines belonging to the Eureka Water System;
and
WHEREAS, the Eureka Water System is an unincor-
porated association composed of the owners of lots one through
twenty-two o× Tract No. 796; and
WHEREAS, said Water System serves' Tract No. 796 and
the lots range in size from three-quarters of an acre to an
acre; and
WHEREAS, said Water System may have trouble in meet-
ing future demands for water, and the existing pipelines and
pumps are incapable of providing water for future development
of the property served by said Water System and for providing
adequate fire protection; and
WHEREAS, it is the desire of the City to eliminate
the water service to the lots in Tract No. 796 through lines
of said Water System in order that the lines of said Water
System may be removed from Webster Avenue; and
WHEREAS, in order to provide for adequate develop-
ment of the area at the least inconvenience to the property
owners, the City is willing to inst~ 1 a water line, water
meters, and fire hydrants at no cost to the property owners
until the property owner changes the use of his property,
thereby requiring the use of additional water; and
WHEREAS, the City and said Eureka Water System
desire to enter into a contract for the transfer of all
facilities owned by said Water System to the City, and for the
furnishing of water to the property owners in Tract No. 796
by the City,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that an agreement be made and entered
into by the City of Anaheim and Eureka Water System, the terms
and conditions of which shall be as follows-
1. The City shall install an eight-inch water line
in Webster Avenue.
2. The City shall install 3/4 inch b.y 5/8 inch
meters for each lot in Tract No. 796 at a locatzon adaptable
to present service lines.
3. The City shall install fire hydrants to furnish
fire protection.

4. The Eureka Water System shall give_ and transfer to
the City all facilities owned by said Water System. These faci-
lities include but are not limited to:

Pipelines located in,Webster. Avenue;
Pumps, motors and electrical equipment
in wells owned by the Water System;
Any claim of right to use Webster Avenue
for pipeline purposes ~by way of easement
or otherwise.
5. Any real property owned by the Eureka Water Sys-
tem shall be retained by the Water System.
0. The City shall cap ti~e wells which are owned by
-~he Water System and shall remove a concrete base which supports
'the pump on a well located on Lot 9 of Tract No. 796.
7. In the event that the property owner increases
~is use of water by installing larger or additional meters or
running water to additional units through the meter installed
pursuant to said agreement to be entered into, t'he property
owner will be required to pay to the City $2.75 per front foot
to reimburse the City for the cost of installing the eight-inch
water line.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING-RESOLUTION is approved and signed by
