A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM GRANTING CONDITIONAL USE
PERMIT NO. 525 .
WHEREAS, the City Planning Commission of the City of
Anaheim did receive an application for a Conditional Use Permit
from EARL H. DAHLMAN, 2541 E. Lincoln Avenue, Anaheim, California,
to establish a service station on the following described pro-
perty, situated in the City of Anaheim, County of Orange, State
of California, to wit:
That portion of the North half of the Northeast quarter
of the Southeast quarter of Section 12, Township 4 South,
Range 10 West, in the City of Anaheim, in the Rancho
San Juan Cai on de Santa Ana, as shown on a map thereof
recorded in book 51, page 7, Miscellaneous Maps, records
of said Orange County, described as follows:
Beginning at the intersection of Lincoln Avenue, formerly
Anaheim-Olive Road, 60 feet wide and Sunkist Street, the
center line of which is 20 feet westerly of the East line
of said street, and 30 feet Easterly of the West line
thereof, and running thence, North 01° 01' 19" East along
the center line of said Sunkist Street, 218.23 feet; thence,
leaving said center line South 88° 58' 41~' East, at right
angles to said center line 222.35 feet; thence South 01°
01' 19" West, parallel with the center line of said Sunkist
Street, 261.27 feet to a point in the center line of said
Lincoln Avenue; thence North 78° 01' 24" West, along the
center line of Lincoln Avenue 226.48 feet to the point of
beginning.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon said
application on January 6 , 19 64 , notices of which
said public hearing were 'duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
WHEREAS, said Commission, after due inspection,
investigation and studies ma~de by itself and in its behalf and
after due consideration of all evidence and reports offered at
said hearing did adopt its Resolution No. 101~Series

subjecg.go certain conditions therein set forth ; and

WHEREAS, thereafter, within twenty-two (22) days
from the date of the adoption of said resolution, the City
Council did elect, upon its own motion, to review the action
of the City Planning Commission in ~rantin~ said Condi~
tional Use Permit and did thereupon-fix th~ 18th day of
.February. 1964 , as the time and the COuncil Chamber
in the City Hall of th----~ City of Anaheim as the place for a
public hearing upon said Conditional Use Permit, and notices
of such public hearing were duly given as required by law
and the provisions of Title 18, Chapter 18.76 of the Anaheim
Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such
hearing and did give all persons interested therein an oppor~
tunity to be heard and did receive evidence and reports; and
WHEREAS, the City Council finds, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said
hearing, that:

The proposed use is properly one for which a
Conditional Use Permit is authorized by the
Anaheim Municipal Code.
The proposed use will not adversely affect the
adjoining land uses and the growth and develop-
ment of the area in which it is proposed to be
located.

The size and shape of the site proposed for the
use is adequate to allow the full development of
the proposed use in a manner not detrimental to
the particular area nor to the peace, health,
safety and general welfare.
The traffic generated by the proposed use will
not impose an undue burden upon the streets and
highways designed and improved to carry the
traffic in the area.

The granting of the Conditional Use Permit under
the conditions imposed will not be detrimental to
the peace, health, safety and general welfare of
the citizens of the City of Anaheim·
NOW~ THEREFORE~ BE IT RESOLVED by the City Council
of the City of Anaheim that the action of the City Plannin~
Commission ~rantin~ said Conditional Use Permit be, and
the same is 5er·by - sustained , and that Conditional Use
Permit No. 525 be, and the same is hereby, granted
permitting the establishment of a service station on the
property hereinbefore described, subject to the following
conditions:

That the owner of subject property shall deed
to the City of Anaheim a strip of land 57 feet
in width, from the center line~ of the street, along
Sunkist Street, for street widening purposes.

That the owner of subject property shall deed
to the City of Anaheim a strip of land 53 feet
in width, from the center line of the street,
along Lincoln Avenue, for street widening pur-
poses.

(a) That all engineering requirements of the
City of Anaheim, along Sunkist Street ~and Lin-
coln Avenue, including preparation of ~improve-
ment plans and installation of all improvements,
such as curbs and gutters, sidewalks, street
grading and paving, drainage facilities, or
other appurtenant work shall be complied with
as required by the City Engineer and in accord-
ance with standard plans and specifications on
file in the Office of the City Engineer; and
(b) that a bond in an amount and form satisfac-
tory to the City of Anaheim shall be posted
with the City to guarantee the installation
of said engineering requirements.

That the owner of subject property shall pay
to the City of Anaheim the sum of $2.00 per
front foot, along Sunkist Street and Lincoln
Avenue for street lighting purposes.

That trash storage areas shall be provided in
accordance with approved ~plans on file in the
Office of the Director of Public Works and
Superintendent of Streets, prior to final
building inspection.

That subject property shall be developed sub-
stantially in accordance with plans and speci-
fications on file with the City of Anaheim,
marked "Exhibits Nos. 1, 2, 3 and 4"; and,
further, that subject property shall be developed
substantially in accordance with adopted Service
Station Minimum Site Development Standards,
PROVIDED, HOWEVER, that stone or masonry materials
shall be used for the exterior walls, that a
shake roof shall be installed as stipulated by
the petitioner, and that revised elevations
incorporating said materials shall be submit-
ted to and approved by the Development Review
Board prior to the issuance of a building per-
mit.

That any plan for the development of the rear
portion of subject property, after the orange
trees are removed, other than black topping,
shall be submitted to and approved by the Plan-
ning Commission prior to the issuance of a
building permit.

That Conditions Nos. 1, 2, 3(b) and 4 above-
mentioned shall be complied with within a period
of 180 days from date hereof, or such further
time as the City Council may grant.
The City Council hereby reserves the right to revoke
such Conditional Use Permit for good cause or failure of said
owner, his heirs, successors or assigns to comply with the
Anaheim Municipal Code and regulations and the conditions herein.
