RESOLUTION NO~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommend in9 denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holdin9 of a public hearin9 thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code~ and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (l~O) days following the hearing thereon~ the Planning Commission did duly. announce by formal resolution its findings of facts and declare its' opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described~ and WHEREAS, upon receipt of said resolution, summary of evidence~ report of findings and recommendation of the City Plan- nih9 Commission~ the City Council did fix the llth day of February 196~ as the time~ and the City c6~h'cil Chamb'~'r's ' ' in the C{'~y ~all-'fn the City of Anaheim as the place for a public hear iuD upon said proposed amendment to Title 18 of the Anaheim [Municipal Code~ and the exclusion of said property~ hereinafter described~ from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did Give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS~ at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findin9s and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE~ BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended~ and that all of the property and area situated in the City of Anaheim, County of Orange, State of Caltfornia~ described as follows: 63-64-20 Parcel i: Lots 3 and 22 of the 3~ D. Taylor Tract~ in the city of Anaheim~ county of Orange, state of California~ as per map recorded in book 5~ page 16 of Miscellaneous P~ps, in the office of the County Recorder of said county~ together with that portion of Glen Avenue abandoned by order of the Board of Supervisors of said county, as shown on said map lying between the prolongation of the easterly and westerly lines of said lots. EXCEPT that portion thereof lying southwesterly of the following described line: Beginning at a point on the West line of said Lot 22 distant along said West line, South 16° 02' 35"'East 117.77 feet from the center line of said Glen Avenue, said point being also the northwest corner of that certain parcel of land described in deed to said state, recorded in book 2800, page 60 of Official Records; thence along said West line and its northerly prolongation, North 16© 02' 35'~ West 196.72 feet; thence South 58° 02' 18~ Mast 327.59 feet; thence South 48° 04' 42'~ East 258.05 feet; thence South 26° 12' 53': East 341.78 feet to the general northeasterly line of that certain parcel as described in deed to said state, recorded in book 3022, page 464 of Official Records; thence southeasterly along the curved northeasterly boundary of the land described in said last mentioned deed and North 40° 36' 20" East 106.23 feet along said boundary to the easterly line of said Lot 22. ALSO EXCEPT any portion of said land not included within the boundary of the Rancho Santiago de Santa Ana as described in the Patent of said Rancho. Parcel 2: That certain parcel of land in the city of Anaheim, county of Orange, state of California, described as follows: Beginning at the northwest corner of Lot 2 of said J D. Taylor Tract, as per map recorded in book 5, page 16 of Miscellaneous Maps, in the office of the County Re,c, order of said county; thence South 67° 36~ 50'' West 50.47 feet along the North line of Lot 3 of said J. D. Taylor Tract in Station 8 thereon~ as shown on said map; thence South 66© 20' 50': West 400.00 feet along said North line to Station 7 thereon as shown on said map; thence North 86© 45' 10" West 109.20 feet to the northwest corner of said Lot 3; thence North 17© 01' West along the northerly extension of the West line of said Lot 3 to its intersection with the North line of Parcel 2 of land conveyed -2- to the Orange County Water District by Lenna M. Bonner by deed recorded March 27, 1941 in book 10867 page 214 of Official Records; thence North 70° 41' East 339.73 feet along said North line to an angle point; thence North 66° 35' East 211.86 feet along said North line to its intersection with the northerly extension of the East line of said lot 3; thence South 17° 01' East 134.27 feet along said extension of the East line to the point of beginning. EXCEPT any portion of said land not included within the land described in the deed to Rae Oakes, recorded August 10, 1960 in book 5369, page 130 of Official Records. be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That a Final Tract b~p of subject property shall be submitted to the City Council for approval and recorded in the Office of the Orange County Recorder. 2. That provision shall be made for drainage of subject property into the Santa Ana River, subject to the approval of the Orange County Water District, Orange County Flood Control District and the City Engineer. Ail drainage across Batavia Street shall be by means of an underground storm drain system. 3. That alley cut-offs and/or radii shall conform to Standard Plan No. 130 on file in the Office of the City Engineer. 4. That the access road to the most northern street, adjacen~ to the Santa Ana River levee, shall be relocated easterly of the existing location shown on the map, to clear more adequately the Batavia Street overpass. 5. That the grade and alignment of the Batavia Street overpass shall be approved by the State Division of Highways. 6. That the exterior streets shall be 55 feet wide, with the exterior one foot being reserved by the owner of subject property and used for the construction of a 6-foot masonry wall. 7. That all vehicular access rights to Batavia Street, except at street and/or alley openings shall be dedicated to the City of Anaheim. 8. That subject property shall be developed sub- stantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1 through 17, Revision No. and in accordance with kodachrome photographs of the exhibits submitted by the applicant on this date. -3- . That plans for development of subject property and final building plans shall be submitted to and approved by the City Council prior to the issuance of a building permit. 10. That the completion of these reclassification proceedings is contingent upon the completion of Reclassification Proceedings No. 63-64-21 and upon the granting of Conditional Use Permits Nos. 465 and 466. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
