RESOLUTION NO. 64R- 93
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH ANAHEIM UNION HIGH SCHOOL
DISTRICT WITH REFERENCE TO THE INSTALLATION
AND MAINTENANCE OF A LIGHTING SYSTEM ON
TENNIS COURTS AT LOARA HIGH SCHOOL·
WHEREAS, the Anaheim Union High School District owns,
maintains, and operates eight (8) tennis courts at Loara High
School, 1765 West Cerritos, Anaheim, California; and
WHEREAS, pursuant to Sections 16651 through 16664 of
the California Education Code, the City of Anaheim and the
Anaheim Union High School District are engaged in a joint recre-
ation program whereby the facilities of both parties are being
used for recreational purposes; and
WHEREAS, the City of Anaheim and said School District
desire to install and maintain a lighting system on the eight
(8) tennis courts at said Loara High School in order to make
them available for night use.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an agreement be made and entered into
by and between the City of Anaheim and Anaheim Union High School
District providing for the installation and maintenance of a
lighting system on eight (8) tennis courts at Loara High School,
1765 West Cerritos, Anaheim, California, upon the following
terms and conditions:

The City shall, within a reasonable time after
the execution of said agreement, install a
metered lighting system for use in connection
with the eight (8) tennis courts at Loara
High School, 1765 West Cerritos, Anaheim,
California, pursuant to specifications
approved by the School District prior to the
commencement of the installation project
herein referred to.

The City shall pay all costs and expenses
incurred in connection with the above
installation, and in addition, shall pay
all maintenance costs for meters, lights,
lines, or any other equipment included in said
lighting system, so long as said agreement
shall remain in effect.

The School District shall maintain the eight
(8) tennis courts, above referred to, in a
first-class condition in accordance with
School District standards, for use by the
public in the joint recreation program
by the City and said School District.

The School District and City shall~share the
proceeds of the metered use of the tennis-
courts. Said proceeds shall first be used
by the City to maintain the lighting system,
including the meters, lights, and lines, and
the remainder, if any, shall be used by the
School District to maintain the condition of
the courts.

The management, direction and control of the
school premises and improvements shall be
vested in the governing board of the School
District, except to the extent such direction,
management, and control are, or may be by the
City and said School District, jointly exercised
or delegated to a commission for community recre-
ation purposes as authorized by Sections 16651
through 16664 of the Education Code of the
State of California.

Said agreement shall remain in effect for a
term of one (1) year from the date of execution
thereof, and thereafter shall be automatically
renewed from year to year unless one of the
parties to said agreement gives notice to the
other at least ninety (90) days prior to the
expiration of any annual term of its intention
not to so renew said agreement at the expiration
of said term. The lighting system, and all of
its component parts,, shall belong to the City,
and it may be removed from school premises upon
termination of agreement.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim, as of January 23, 1964.
