RESOLUTION NO. 64R,- 38 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE JOINT COMMUNITY RECREATION PROGRAM OF THE CITY OF ANAHEIM, THE ANAHEIM UNION HIGH SCHOOL DISTRICT, THE ANAHEIM CITY SCHOOL DISTRICT, AND THE MAGNOLIA ELEMENTARY SCHOOL DISTRICT, AND AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF ANAHEIM TO ENTER INTO AND EXECUTE AN AGREEMENT FOR SUCH JOINT COMMUNITY RECREATION PROGRAM. WHEREAS, the City of Anaheim, the Anaheim Union High School District, the Anaheim City School District and the Magnolia Elementary School District desire to promote and pre- serve the health and general welfare of the people of the City of Anaheim and said School Districts and to cultivate and develop good citizenship by providing for an adequate program of commu- nity recreation and to conduct such a program of community recreation as will contribute to the attainment of general educational and recreational objectives for the children and adults of the City of Anaheim and said School Districts; and WHEREAS, the City of Anaheim and said School Districts desire to cooperate with one another to carry out the provisions of Chapter 4, Division 12 of the Education Code of the State of California, and to that end to enter into an agreement with one another to organize, promote and conduct a joint program of com- munity recreation to promote and preserve the health and general welfare of the children and people of the City and said School Districts. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the City of Anaheim enter into an agreement with the Anaheim Union High School District, the Anaheim City School District, and the Magnolia Elementary School District for the following purposes: i . To enter into and jointly organize, promote and conduct a program of community recreation during the fiscal year 1963-64, for general education and recreation objectives for the children and adults of the City of Anaheim and said School Districts to promote and preserve the health and general welfare of the people of the City and said School Districts. . To provide that all public parks and recreation facilities of the City of Anaheim shall be made available and be used as a part of a joint community recreation program for the fiscal year 1963-64, and shall be maintained and cared for by the City of Anaheim; and That the City of Anaheim shall make avail- able to the Anaheim Union High School District all public parks and recreation facilities excepting the Municipal Plunge and the -1- La Palma Park Stadium, except as the use of La Palma Park Stadium is provided for in the lease of said facilities between the City of Anaheim and the Anaheim Union High School District, said facilities to be used jointly in the physical education program of the Anaheim Union High School District, and to be maintained and cared for by the City of Anaheim during the fiscal year 1963-64. · To provide that all recreation facilities of the Anaheim Union High School District shall be made available and be used as a part of said joint community recreation program for the fiscal year 1963-64 and be maintained and cared for by the Anaheim Union High School District. , To provide that all recreation facilities of the Anaheim City School District shall be made available and be used as a part of said joint community recreation program for the fiscal year 1963-64, and be maintained and cared for by the Anaheim City School District, except that all open grounds not covered by buildings and pertinent structures and adjacent to City-owned park sites shall be maintained and cared for by the City of Anaheim Park and Recreation Department as a part of the City's park system in order to insure the citizens of Anaheim a more economical maintenance program and insuring uninterrupted use according to the joint agreement by and between the City of Anaheim and the Anaheim City School District. · To provide that all recreation facilities of the Magnolia Elementary School District shall be made available and be used as a part of said joint community recreation program for the fiscal year 1963-64, and be maintained and cared for by the Magnolia Elementary School District. BE IT FURTHER RESOLVED that the Anaheim City School District shall pay to the City, on demand, all actual expenses incurred by the City for the care and maintenance of the open grounds not covered by buildings and pertinent structures and adjacent to City-owned park sites, referred to in Item 4 above, including expense of labor, compensation insurance, retirement, and the actual cost to the City for all commodities, materials, and equipment used and expended for such maintenance; that the City of Anaheim shall submit itemized demands to the Anaheim City School District once each month during the term of the agreement; that the total cost of said maintenance for the year shall not exceed $3,600.00 and the City of Anaheim shall not expend work or material in excess of said amount. -2- AND BE IT FURTHER RESOLVED that the general expense for salaries of supervisors, instructors, attendants, employees, and supplies andgeneral maintenance expense of said community recreation program shall be borne by the City of Anaheim and the said School Districts as follows: CITY OF ANAHEIM ANAHEIM UNION HIGH SCHOOL DISTRICT ANAHEIM CITY SCHOOL DISTRICT MAGNOLIA ELEMENTARY SCHOOL DISTRICT $150,572.82 35,957.69 26,968.26 11,236.78 BE IT FURTHER RESOLVED that should the total expendi- tures of said community recreation program be of an amount that is less than the total of the contributions of the City and said School Districts as set forth in the paragraph above immedi- ately preceding this paragraph, then the amount to be contributed by the City of Anaheim shall be reduced by an amount equal to the difference between the total expenditures and the total contri- butions described above. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby authorized and directed to execute an agreement for and on behalf of the City of Anaheim with said School Districts, as of July 1, 1963, for the purposes herein- above mentioned and in accordance with the terms and conditions set forth in this resolution.
