A RESOLUTION OF THE ANAHEIM RF..~EV~LOPM~NT
AGENCY AUTHORIZING APPLICATION POP, I~DERAL
FUNDS AND MAKING CERTAIN FINDINGS WITH RESPECT
TO SR-91/KRAEMER BOULEVARD INTERCHANGE
ENHANCE~T
WHEREAS, the Anaheim Redevelopment Agency (the 'Agency") is a community
redevelopment agency organized and existing under the Community Re, development Law, Health
and Safety Code Section 33000 et Le~.; and
WI-IEREAg, the C[ty Council of the City of Anaheim (me "CiDd Council') aClolatCxl the
Redevelopment Plan for the Alpha. Redevelopment Project {'Project Alpha") on July 19, 1973 by
Ordinance No. 3190, and as said plan was first amended by tho City Council on July 20, 1076
by Ordinance No. 3631, and as said plan was third amended by the City Coancii on January 5,
1982 by Ordinance No. 4300; and
WI-tEREAS. thc Anaheim Redev¢lol~mcnt Agency is engaged in activities necessary and
aOpropriate to carry out such r~lcv~lopment plan for Proj~:t Alpha; and
WHEREAS, Section 3344:5 of me California Community Reclevc;lopment Law (Health and
Safety Code SecTion :33000, et Iseq.) authorize~ a retlevelopment isgvncy, with the consent of the
lcgislatlw b~xty, to pay all or part of the value of the land for and the cost of thc installation and
construction of any building, iacility, structure, or other improvement which is publicly owned
either within or withou! the oroject area upon certain findings; and
WHEREAS, the United States Congress has enacted the Intermodal Surface
Transportation Efficiency Act of' 1991, whicla is to make avanabie over $200 million in federal
dollars over a six year period as funds to the California Department of Transportation for
transportation enhancement activities; and
WHEREAS, the Department of Transportation has established the procedures and criteria
for reviewing proposals and, along with ~e Regional Transportation Agencies, will su0mit to the
California Transportation Commission a list of recommended projects from which the recipients
will be selected; and
WHEREAS, said procedures and criteria established by the California Department of
Transportation call for the approval of an application by the applicant's governing body before
s~bmi.~.~ion of said application to the California Transportation Commission; and
WHEREAS, the application contains assurances that the applicant must comply with; and
WHERI~AS, the applicant, if selected, wilt enter into an agreement with the State of
California to c:~rry out the transport.qticm erthaneement activities 0roiect; and
WHEREAS, the Agency desires to apply for funding to physi~lly enhance the 91
Freeway/Kra~mer Boulevard Interchange (the "Inter¢t~ange Enhanccmem Proj~t"); and
WHEREAS, the Agency proposes to commit to use an amount which' is expected to be
approximately One Hundred Tnirty-Three Thousand Four Hundred Four Dollars ($133,404.00)
of i,.s tax increment fimds to pay for twelve percent of the costs of the Interchange ,qnhancement
Project if the grant is received; and
WHEREAS, ~e expenditure of Agency .qtnds for the Interchange l~nhanccmcnt Project is
of ~nefit to ~oj~t Alpha and ~e surrounding development, ~d is n~s~ m eff~ate ~e
purposes of ~c Proj~t Alpha r~cvolopmom plan, b~ause ~e lmerchange E~aneement pr0i~t
will provide an ~s~i~lly e~anc~ entrance into ~e An~im Canyon Business Cen~ in ~e
No.east lndnsffial portion of Project Alpha, one of ~e major gateways imo ~ Proj~t ~;
and
WHEREAS, the California Department or' Transportation, and not thc Agency, would be
responsible for the maintenance and operation of the Interchange Enhancement Project; and
WHEREAS, there are no other reasonable means of financing the cost of the Interchange
Erthancernent Project as the City has no funds in its general fund or capital improvement accounts
which are currently unencumbered or available for tho benefit and use of the Agency, and
likewise, the Agency has no alternative sources of funding to pay for the costs of ',he Interchange
Enhancement Proje~,
NOW THEREFORE, THE ANAI-IEIM R_EDI~VELOPMFo~ AGENCY DOES
RESOLVE AS FOLLOWS:
~, The Agency finds and determines that Agency's payment of a portion of
the costs of the Interchange Enhancement Project is of benefit to Project Alpha and the
surrounding development, and is necessary to effectuate the purposes of the Proj~t Alpha
redevelopment plan.
Section 2,. The Agency f'mds and determines that no other means of financing the
Asency's payment of a portion of the costs of the Interchange Enhancement Project are available
to the community.
Section 3. The Agency is au~orlzed to pay for th; A~ency's share of the costs of the
Interchange Enhancement Project, upon receipt of federal fimds for such project.
S_.ection 4. The Agency hereby approves the filing of an application for the
'rranspomtion Enhancement Activities Program for consideration for funding the Interchange
Enhancement Project, and directs the Executive Director of the Agency, or her designee, m file
such application.
