A RESOLUTION OF THE ANAHEIM
REDEVELOPMENT AGENCY DESIGNATING
THE EXECUTIVE DIRECTOR TO REVIEW
RELOCATION ASSISTANCE CLAIMS AND/OR
SETTLEMENT AGREEMENTS AND TO APPROVE
RELOCATION ASSISTANCE PAYMENTS AND/OR
SETTLEMENT AGREEMENTS FOR THE
ANAHEIM PLAZA REDEVELOPMENT PROJECT
WHEREAS, on December 15, 1992, the Anaheim Redevelopment Agency
entered into an Owner Participation Agreement with the California State Retirement
System (CLSTRS) to redevelop the Anaheim Plaza shopping center; and
WHEREAS, Section 7260 et seq. of the Government Code requires
governmental agencies which undertake projects or programs for public use to make
relocation assistance payments to displaced persons and businesses when caused by
the direct result of rehabilitation, demolition, or other displacing activities; and
WHEREAS, the Anaheim Redevelopment Agency has heretofore adopted
"Rules and Regulations" for the Implementation of the California Relocation Assistance
Law (hereinafter "Rules"); and
WHEREAS, said rules permit a claimant to appeal from an Agency initial
determination regarding the claimant's eligibility for an amount of relocation assistance
payment and other issues; and
WHEREAS, said Rules (Commencing at Section 800) require an administrative
review of said claim by a designee of the Agency which designee just: (a) be someone
other than the person who made the initial decision and (b) have authority to revise the
initial determination of the claim; and
WHEREAS, Section 33418 of the Community Redevelopment Law provides
that all applications and records relating to relocation advisory assistance or relocation
expenses are confidential.
NOW, THEREFORE, BE IT RESOLVED by the Anaheim Redevelopment
Agency that the Executive Director be, and she is hereby, declared to be the designee
of the Agency for reviewing Agency staff determinations regarding claims and
settlement agreements or relocation assistance pertaining to the Anaheim Plaza
Redevelopment Project, made under the Rules when a request for review is made.
BE IT FURTHER RESOLVED, that the Executive Director is hereby authorized
to revise the initial determination of such claims.
BE IT FURTHER RESOLVED, that the Executive Director be, and she is
hereby, authorized to approve, on behalf of the Anaheim Redevelopment Agency,
payment of all claims and/or agreements for relocation assistance pertaining to the
Anaheim Plaza Redevelopment Project which do not exceed Fifty Thousand Dollars
($50,000.00), and which have been processed in accordance with the "Relocation rules
and Regulations for Implementation of the California Relocation Assistance Law"
previously adopted.
BE IT FURTHER RESOLVED, that the Finance Director be, and he is hereby,
authorized and directed to pay claims so approved by the Executive Director.
