AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OFANAHEIM ADDING NEW SECTION 1.04.955 TO
CHAPTER1.04 OF TITLE 1 OF THE ANAHEIM MUNICIPAL
CODEESTABLISHING THE ANAHEIM SISTER CITY
COMMISSION
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION l:
That Section 1.04.955 be and the same is hereby added to Chapter 1.04 of Title 1 of the
Anaheim Municipal Code establishing the Anaheim Sister City Commission to read as
follows:
".010 Establishment. The Anaheim Sister City Commission is hereby
established pursuant to Section 900 of the Charter of the City of Anaheim
.020 Duties. The Anaheim Sister City Commission shall have the power and
duties to:
(a) Advise the City Council on matters concerning sister city relationships
including the promotion of cultural/educational exchange and knowledge
sharing.
(b) Recommend to the City Council by-laws, for City Council approval, which
govern the Commissions own internal procedures consistent with the Charter,
ordinances and resolutions of the City of Anaheim and all other applicable
laws, rules and regulations.
(c) Make recommendations to the City Council of goals, objectives and programs
to ensure the successful management of the existing sister city relationships.
(d) Make recommendations to the City Council on how to effectively manage the
existing sister city relationships and ensure their success and effectiveness, as
measured by City Council approved goals, strategies and programs.
(e) Make recommendations to the City Council regarding criteria for the
establishment of new sister city relationships, including the creation of
selection criteria that aim to match the City with a suitable partners.
(f) Make recommendations to the City Council regarding the expenditure of
funds that further the approved goals, strategies and programs.
(g) Establish the appropriate subcommittees tasked with implementing specific
programs, strategies and goals, consistent with the approved by-laws and other
applicable laws, rules and regulations.
(h) Provide the Mayor and Council with an annual report outlining the programs
and accomplishments of the Commission and its affiliations.
(i) Perform such additional advisory functions as may be delegated or required
by the City Council from time to time.
030 Composition and Appointment of Members.
(a) The Anaheim Sister City Commission shall consist of fifteen (15) members
appointed by the City Council. Each member of the Commission shall be a
resident of the City of Anaheim or other parties, including business owners,
that have a vested interest in Anaheim and the success of the sister city
program. Appointed members shall not hold any paid office or employment in
the City government.
(b) For the initial appointment of the Commission only, each member of City
Council will be responsible for appointing two (2) members with the
remaining five (5) members of the commission (representing Anaheim's
business, tourism and educational sectors) to be appointed collectively by the
Mayor and Council. In accordance with Subsection .040, for the initial
appointments by the each member of the City Council, each member will
appoint one commissioner who shall have a term expiring on the thirtieth day
of June of the first year and one commissioner who shall have a term expiring
on the thirtieth day of June of the second year. Thereafter, as members terms
expire, the members of the commission will be appointed collectively by the
Mayor and Council by the affirmative votes of the majority thereof.
(c) The City Manager shall appoint a City representative to serve as the staff
liaison to the Commission. This member of City staff shall be an ex official
member and will not have voting rights at meetings of the Commission and
hall not be counted for purposes of determining a quorum at the Commission
meetings.
.040 Term of Office. The appointed members shall serve terms of three (3) years,
or until their respective successors are appointed. However, the initial Commission
appointees shall be appointed by the City Council, in accordance with Subsection .030,
for terms specifically expiring as follows:
Five on the thirtieth day of June of the first year following appointment.
Five on the thirtieth day of June of the second year following appointment.
Five on the thirtieth day of June of the third year following appointment.
.050 Unscheduled Vacancies. A vacancy occurring before the expiration of the
term shall be filled by City Council appointment for the remainder of the term, in the
same manner as provided above, for the remainder of the term. In such cases, the City
Council will consider the existing makeup of the board and may appoint a member that
represents the appropriate industry or sector.
.060 Meetings and Procedures. The Anaheim Sister City Commission shall meet
regularly at least once a month in the City of Anaheim or in a location authorized by the
City Council or as otherwise provided by law. Regular meeting dates and times shall be
established by the Commission. A majority of the total number of members of the
Commission then in office shall constitute a quorum. The Commission shall comply with
the provisions of the Ralph M. Brown Act commencing with Government Code Section
54950 et seq. The meetings and procedures of the Commission shall be subject to and
governed by the resolutions and ordinances of the City Council establishing rules and
regulations for City boards and commissions.
.070 Advisory Subcommittees. The Anaheim Sister City Commission shall have
the power to appoint advisory subcommittees of less than a quorum of the Commission to
perform tasks within the scope of the Commission's responsibilities and to make reports
and recommendations to the Commission.
.080 Organization. The Anaheim Sister City Commission shall annually, at its
first regular meeting following the first day of July, select one (1) of its members as
chairperson and one (1) of its members as vice -chairperson, who shall serve in this
capacity for one year or until his or her successor is selected. The Commission shall
recommend to the City Council by-laws for approval by the City Council to govern the
Commission's own internal procedures consistent with the charter, ordinances and
resolutions of the City of Anaheim and all other applicable laws, rules and regulations.
090 No Compensation. Members of the Anaheim Sister City Commission shall
serve without compensation."
SECTION 2: SEVERABILITY
The City Council of the City of Anaheim hereby declares that should any section
paragraph sentence or word of this ordinance of the Code hereby adopted be declared for
any reason to be invalid it is the intent of the Council that it would have passed all other
portions of this ordinance independent of the elimination here from of any such portion as
may be declared invalid
SECTION 3: SAVINGS CLAUSE
The provisions of this ordinance insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to the same subject matter
shall be construed as restatements and continuations and not as new enactments.
SECTION4: CERTIFICATION
The City Clerk shall certify to the passage of this ordinance and shall cause the
same to be printed once within (15) days after its adoption in the Anaheim Bulletin, a
newspaper of general circulation, published and circulated in said City, and thirty (30)
days from and after its final passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE was introduced at a regular meeting of the
City Council of the City of Anaheim held on the 22nd day of September , 2009,
and thereafter passed and adopted at a regular meeting of said City Council held on the
13th day of October , 2009, by the following roll call vote:
