Sohl EXECUTIVE DIRECTOR OF COMMUNITY DEVELOPMENT: Lisa Stipkovich A complete copy of the agenda for the meeting of the Housing Authority was posted at 2:22 p.m. on December 1, 1995 at the Civic Center kiosk, containing all items as shown herein. Chairman Daly called the regular meeting of the Anaheim Housing Authority to order at 5:50 p.m. FINANCIAL DEMANDS AGAINST THE ANAHEIM HOUSING AUTHORITY in the amount of $1,728,680.83 for the period ending December 1, 1995, in accordance with the 1995-96 Budget, were approved. ADDITIONS TO THE AGENDA: There were no additions to agenda items. ITEMS OF PUBLIC INTEREST: No items of public interest were addressed. PUBLIC COMMENTS - AGENDA ITEMS: There were no public comments on Housing Authority Agenda items. . 161: APPROVAL OF MINUTES: Chairman Daly moved to approve the minutes of the Anaheim Housing Authority meeting held November 7, 1995, Authority Member Feldahaus seconded the motion. MOTION CARRIED. Secretary Sohl noted that the Hearing portion of the Authority Agenda to consider resolutions for condemnation of certain properties was advertised to start at 6:00 P.M. Recess - Housing Authority: By general Authority consent, the Housing Authority Meeting was recessed until the time for the Hearing(s) on Authority Item 2. (5:55 P.M.) CITRON: See Staff Report dated December 5, 1995 from the Community Development Department recommending adoption of the resolutions of necessity for the subject properties. 95-1 C~V~C CENTER~ ~%lq~B~M HOUB~N~ AUTHORITY DECEMBER 5~ L~9~ 5~00 P.M. Chairman Daly. This is the time for the due process hearing(s) on proposed acquisition by eminent domain relating to properties located at 718, 719 and 728 W. Julianna, 717 W. Hall, and 1175 N. Citron. Lisa Stipkovich, Executive Director of Community Development. Staff has been working on the South of Remneya Revitalization Plan for some time which requires that they acquire property in the area. The reason for the hearing(s) tonight is in order to move forward with the Revitalization Plan and implementing the Disposition and Development Agreement. In order to implement the plan, these properties are needed to comply in order to create open space common areas and provide rehabilitation to the property. The majority of the properties in the area are severely deteriorated and overcrowded and many of the owners have been recipients of numerous Code Enforcement citations. The hearing(s) are about the need the Authority has to acquire the property and not the value of the property. This is due process and necessity to acquire the property in order to complete the project. Chairman Daly. This is the time for the due process hearing on proposed acquisition by eminent domain relating to the subject properties. He also briefed the issues on which property owners could offer testimony (see Page 2 of report dated December 5, 1995). He then opened the Hearing(s). Mrs. Christian Dezinski, 728 W. Julianna. They bought the property in 1989 and when the City in 1992 came up with the Revitalization Plan, the offer was good at that time. They did consider selling on the outside market. A year went by and things started to change. Finally, the City gave an offer they could not accept. They are retired people and this was part of their retirement. They put a lot of work into the property. Lisa Stipkovich. She explained for the Chairman that the hearing(s) is specifically to consider the reason for the acquisition and not the value of the property although value is the major issue with property owners. Value is something they will continue to negotiate and, if necessary, go to trial and have a Judge and jury determine the fair market value. The Authority will work with Mrs. Dezinski and any other owner regarding issues which may not have been brought to the attention of the appraiser. They will try to work things out. Chairman Daly asked if anyone also wished to speak on this property or any of the other properties which are the subject of the hearing; there was no response. Chairman Daly closed the hearing(s). CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: On motion by Chairman Daly, seconded by Authority Member Zemel, the Authority finds a negative declaration has previously been approved and that there are no additional impacts in connection with the subject action. MOTION CARRIED. Chairman Daly offered Resolutions, AHA95-14 through AHA95-18 both inclusive for adoption.
