ARA1992-01RESOLUTION NO. ARA 92-1 A RESOLUTION OF THE ANAHEIM REDEVELOPMENT AGENCY APPROVING AN OWNER PARTICIPATION AGREEMENT WITH CATELLUS DEVELOPMENT CORPORATION AND MICRO TECHNOLOGY, INC.; AND MAKING CERTAIN ENVIRONMENTAL FINDINGS IN CONNECTION THEREWITH WHEREAS, the Anaheim Redevelopment Agency (the "Agency") is engaged in activities necessary to implement the Redevelopment Plan (the "Redevelopment Plan") for Redevelopment Project Alpha (the "Project" of "Project Area"); and WHEREAS, Catellus Development Corporation ("Owner") owns certain property in the Project Area, which property is generally bounded by Landon Drive on the north, Kellogg Drive on the east, La Palma Avenue on the south, and Manassero Street on the west (the "Property"); and WHEREAS, Micro Technology, Inc. ("Tenant") is a major employer and fast growing company in the Project Area engaged in the design, manufacture and marketing of high-technology computer products; and WHEREAS, Owner and Tenant have submitted to Agency a proposed Owner Participation Agreement (the "OPA") pursuant to which, among other things, (a) Owner will construct for use by Tenant a building of approximately 130,000 square feet (the "Premises"); (b) Tenant will continuously employ on the Premises not less than one hundred and twenty-five (125) people; (c) Tenant will periodically notify the City of Anaheim's Job Training Program Division (the "Division") of job openings on the Premises and work with the Division to fill said openings with people referred by the Division; and (d) Agency will provide certain financial assistance for the project solely out of tax increment generated by the project; and WHEREAS, the Agency has prepared a financial analysis of the project and determined that, at a fair market rent to Tenant, Owner would not receive a fair rate of return on its investment and the project would, therefore, be infeasible; and WHEREAS, pursuant to the California Environmental Quality Act, as lead agency the City of Anaheim prepared a Negative Declaration dated June 19, 1991 (the "Negative Declaration") for the development of the Property (the "Project"); and NOW, THEREFORE, BE IT RESOLVED BY THE ANAHEIM REDEVELOPMENT AGENCY AS FOLLOWS: 1. After review and consideration of the Negative Declaration for the Project, the Agency hereby finds that the Negative Declaration is adequate. 2. The Agency hereby approves the OPA. 3. The Agency hereby authorizes the Chairman, Vice- Chairman, or Executive Director to (a) execute the OPA and all other documents and instruments necessary or desirable for the implementation thereof; (b) take all other actions necessary or desirable for implementation of the OPA; and (c) file a Notice of Determination for the action of the Agency by this Resolution.
