A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING CERTAIN PORTIONS OF PUBLIC
STREETS KNOWN AS LYNNE AVENUE, HAMPSTEAD
STREET AND AUDRE DRIVE TOGETHER WITH THREE
ADJACENT PUBLIC ALLEYS (Abandonment No. 2003-00076)
WHEREAS, the City Council of the City of Anaheim did, by Resolution No. 2004R-
70, duly adopted, declare its intention to vacate certain public streets, highways or public service
easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and
WHEREAS, notice of a public hearing to consider said vacation was posted and
published in the manner prescribed by law; and
WHEREAS, on the 22nd day of June, 2004, a public hearing was held to allow
interested persons to submit evidence concerning said proposed vacation.
WHEREAS, the abandonment approved herein does not convey right, title and
interest to the abandoned property, which is conveyed by separate quitclaim deed pursuant
hereto.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of that certain portions of those public streets known as
Lynne Avenue, Hampstead Street and Audre Avenue, together with three adjacent public alleys,
ali bounded by Cerritos Avenue to the north, Audre Drive to the south, Walnut Avenue to the
cas! and Ninth Street to the west.
See Exhibit "A", attached hereto, for the legal description of the foregoing.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution
shall not be effective until a certified copy of this Resolution is recorded in the Office of the
Recorder of Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby,
authorized and directed to cause a certified copy of this Resolution to be recorded in the Office of
the Recorder of the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this22nd day of June ,2004, by the following roll-call

said Parcels at any time and from time to time, with such vehicles, machinery, and
equipment as may be necessary or convenient to the City of Anaheim, its agents,
franchisees, or assigns, for any and all purposes herein mentioned.
ALSO RESERVING THEREFROM, unto the Pacific Bell Telephone Company/SBC, a
nonexclusive EASEMENT for public utility purposes to construct, place, operate,
inspect, maintain, repair, replace, and remove such arterial and underground telephone
and telegraph communication structures and facilities as the company may from time to
time require, including poles, anchors, wires, cables, conduits, manholes, markers, and
necessary fixtures, and appurtenances on, under, over, above, along and across the
entirety of said Parcels A, B-l, B-2, C, D, E, F, G, and H, together with rights of ingress
and egress thereto/from. Said reservation unto Pacific Bell Telephone Company/SBC is
subject to the above-reserved rights of the City of Anaheim.
ALSO RESERVING THEREFROM, unto the Southern California Gas Company, a
nonexclusive EASEMENT for public utility purposes for the installation and

QUITCLAIM DEED
WITH
RESERVATION OF EASEMENTS
FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged,
the CITY OF ANAHEIM, a municipal corporation and charter city ("City"), hereby releases,
remises and quitclaims to the ANAHEIM HOUSING AUTHORITY, a public body, corporate
and politic ("Authority"), all of its right title and interest in and to that certain property in the
City of Anaheim, County of Orange, State of California (i) described in Legal Description of the
Property attached hereto as Exhibit "A" and incorporated herein by this reference and (ii)
depicted on the Sketch which is attached hereto as Exhibit "B" and incorporated herein by this
reference ("Property"), subject to the existing easements, restrictions and covenants of record and
thc reservation of easements and covenants set forth in the Legal Description of the Property,
attached hereto as Exhibit "A" and as follows:
The City hereby reserves from the quitclaim, unto the owners (individually an "Owner"
and collectively the "Owners") of the properties described in the Description of the
Dominant Tenements attached hereto as Exhibit "C" and incorporated herein by this
reference ("Dominant Tenements") a nonexclusive easement appurtenant to the Dominant
Tenements described as follows (the "Dominant Tenement Streets and Sidewalks
Easement"):
Subject to the terms, limits and conditions set forth below, a non-exclusive
easement for private right-of-way over the real property described in the Legal
Description of thc Streets and Sidewalks which is attached hereto as Exhibit "D"
and incorporated herein by this reference, and depicted on the Sketch attached
hereto as Exhibit "B" (the "Streets and Sidewalks "). By this easement, the
Owners shall have the same use of the Streets and Sidewalks as they would have
had were the Streets and Sidewalks public right-of-way, subject to the following:

Authority and its successors and assigns in and to the Streets and
Sidewalks shall have the right to control access to the Streets and
Sidewalks by placing them within a gated area (the "Controlled
Access Area"), provided that thc Owners are given reasonable
access to the Streets and Sidewalks, which access shall be, in all
material respects, equal to the access provided to other owners of
property within the Controlled Access Area;
Authority and its successors and assigns in and to the Streets and
Sidewalks shall have such right to make and enforce reasonable
rules and regulations for use of the Streets and Sidewalks,
including without limitation, for parking thereon, as City would
have were the Streets and Sidewalks public right-of-way, provided,
however, any and all such rules and regulations shall, in all
material respects, (i) apply equally to the Owners and to the owners
of other properties within the Controlled Access Area, and (ii) be
enforced equally against the Owners and the owners of other
properties within the Controlled Access Area.
Authority and its successors and assigns in and to the Streets and
Sidewalks shall maintain the Streets and Sidewalks in good
condition and repair and, in all material respects, in an equal
manner.
Breach of any of the covenants or restrictions contained in this
Section shall not defeat or render invalid the lien of any mortgage
or deed of trust made in good faith and for value as to the Streets
and Sidewalks, but all of the provisions, restrictions and covenants
contained herein shall be binding against any owner of the Streets
and Sidewalks, or any interest therein, whose title is acquired by
foreclosure, trustee's sale or otherwise.
The provisions of this Section shall be binding upon and inure to
the benefit of the parties hereto and their respective successors and
assigns; provided, however, that upon the transfer by any party of
its interest in the property affected by this Section, including,
without limitation, a transfer of a ground leasehold interest for a
term of not less than fifty-five (55) years, that party's obligation
hereunder shall terminate as of the date of such transfer with
respect to all obligations subsequently arising.
The provisions of this Section will directly burden the Streets and
Sidewalks and benefit the Dominant Tenements and the provisions
of this Section shall constitute covenants running with the land and
shall bind the property described herein.
The tem~ of this Section as to the Streets and Sidewalks shall be in
perpetuity or until such time, if any, as the Streets and Sidewalks
are restored as public right-of-way.
IN WITNESS WHEREOF, THE CITY HAS EXECUTED THIS QUITCLAIM DEED
WITH RESERVATION OF EASEMENTS AS OF THE DATE SET FORTH BELOW.

together with fights of ingress and egress thereto/from, including the right to enter onto
said Parcels at any time and from time to time, with such vehicles, machinery, and
equipment as may be necessary or convenient to the City of Anaheim, its agents,
franchisees, or assigns, for any and all purposes herein mentioned.
ALSO RESERVING THEREFROM, unto the Pacific Bell Telephone Company/SBC, a
nonexclusive EASEMENT for public utility purposes to construct, place, operate,
inspect, maintain, repair, replace, and remove such arterial and underground telephone
and telegraph communication structures and facilities as the company may from time to
time require, including poles, anchors, wires, cables, conduits, manholes, markers, and
necessary fixtures, and appurtenances on, under, over, above, along and across the
entirety of said Parcels A, B-I, B-2, C, D, E, F, G, and H, together with rights of ingress
and egress thereto/from. Said reservation unto Pacific Bell Telephone Company/SBC is
subject to the above-reserved fights of the City of Anaheim.
ALSO RESERVING THEREFROM, unto the Southern California Gas Company, a
nonexclusive EASEMENT for public utility purposes for the installation and
maintenance of gas line facilities on, under, along and across said Parcels B-l, B-2, C,
and H, together with rights of ingress and egress thereto/from. Said reservation unto
Southern California Gas Company is subject to the above-reserved rights of the City of
Anaheim.
