INVOCATION: Rabbi Aaron J. Tofield, of Temple Beth Emet, gave the Invoca- tion~ FLAG SALUTE: Councilman Krein led the Assembly in the Pledge of Allegiance to the Flag~ PRESENTATION: Mr. Stanley Pawlowski, President cf the Anaheim Area Visitor and Convention Bureau, presented members of the City Council and the City Manager with plaques in recognition and appreciation for the development of a convention facility. MINUTES: Minutes of the City Council meetings held November 21 and 28, 1967, were approved on motion bv Councilman Krein, seconded by Councilman Chandl.~r. MOTION CARRIED~ WAIVER OF READING - ORDINANCES AND RESOLUTIONS~ Councilman Krein moved to waiw~ the reading in full cf all ordinances and resolutions, and that consent to the waiver of reading is hereby given by ali Councilmen~ unless after read~ ing of the title, specific request is made by a Councilman for the reading of such ordinance or resclutiono Councilman Chandler seconded the motion° MOTION UNANIMOUSLY CARRIED~ REPORT - FINANCIAL DEMANDS AGAINST THE CITY: Demands against the City in the amount of $1,127,382.42, in accordance with the 1967-68 Budget, were ap- proved~ PUBLIC HEARING - CONDITIONAL USE PERMIT NO. 977: Submitted by Raymond N. Rough, requesting permission to construct a 3-story, 50-unit~ adult only, apart~ ment-hotel, with waiver of the site development standards of the R-3 zone. Property briefly described as located on the north side of Glenoaks Avenue, west of Euclid Street. The City Planning Commission, pursuant to Resolution No. PC67-24J, denied said application~ Appeal from action taken by the City Planning Commission was filed by the applicant~ and public hearing scheduled this date. Mr. Thompson, with the aid of a sectional map, noted the location of subject property, the zoning and use in the immediate area. In summar- izing the hearing held before the City Planning Commission, he reported that the units were proposed to be 504 square feet, which size would place them in the category of a motel, rather than apartment, as the density would be two times that of the R~3 zone. He also reported other findings of the City Planning Commission, resulting in their denial of the application. 7'he Mayor asked if the applicant wished to address the Council° Mr. Harry Knisety, attorney, representing the applicant, advised that the project is not a motel, that it is a complex of 248 bachelor aparu- ments~ which will be privately financed with rentals ranging from $120~00 to $125.00 per month. Mr. Knisely explained the features planned for the recreational area, and further reported that a similar complex has been developed in Torrance, Califcrnia~ and that it is designed to cater to single adults, between the age of 21 years tc~ 35 years~ 10532 City Hall, Anaheim, California - COUNCIL MINUTES - December 19, 1967, 1:30 P.Mo A letter representing 142 units, favoring the proposed project, signed by William Todd, President of Gramercy Park Owner's Association, Inc., to Mro Rough, was submitted and reads The Mayor asked if anyone in opposition wished to be heard. Mrs° Warren C. Thomas, representing Anaheim Village I, Board of Directors, reported that when they purchased their units they were advised that this would be an all-adult complex, and if considered necessary, she could obtain a petition of opposition, representing one hundred percent of Anaheim Village I. Mrs° Thomas submitted a picture of her home, and stated that it was her opinion the proposed project would depreciate the value cf their homes, and their would be transient tenants~ Councilman Chandler noted that the only variation from the exist- ing development was that the buildimg was proposed for three-story construc- tion, and the fact that they were proposed as bache]or-type apartments; the fact that they intend to restrict rentals to an age group was no part of the issue~ The file and plans were reviewed by the City Council. Mr. Geisler noted that the application was for an apartment-hotel, and as there were no provisions in the Anaheim Municipal Code for a bachelor apartment complex either the Code should be amended,to provide for such development, or it must be considered as a hotel, wLich requires the five percent room license, or a variance would be required to grant necessary waivers as an apartment house° Mr. Knisely requested that action be taken on the application as a hotel, and if necessary, they would apply for the variance necessary to oper- ate as an apartment complex° Mr. Tom Black, 1804 West Greenleaf, resident and owner of some of the ~r~inzir~i~rm~ in the area, and also member of the Board of Directors of ~ con~om~nzums oramercy ~ark, advised that they had viewed the elevation and preliminary plan and that the board of directors felt the development would be an asset to the area, as it would beautify their entrance and complete the Gramercy Park complex° In his opi,ion~ the project would not depreciate the value cf their properties~ Mr. Knisely, for the purpose of clarification, advised that the development will be an apartment operation and will meet the demand that must be recognized. There being no one else wishing to address the Council, the Mayor declared the hearing clcsed~ RESOLUTION NOo 67R-692: Discussion was held by the City Council° At the conclusion thereof, Councilman Chandler offered Resolution No. 67R-692, grant- ing Conditional Use Permit No. 977, as a hotel (interim use), subject to the following conditions~ 1~ That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 2o That any air conditioning facilities proposed shall be properly shielded from view and the sound shall be buffered from adjacent residential homes~ 3o That any external lighting that may be provided shall be directed onto the property~ away from any abutting parcels. 4~ That conditions Nos~ 1, 2, and 3, above mentioned, shall be com- plied with prior to final Building and Zoning inspections. 5~ That subject property shall be developed substantially in accord- ance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos~ 1, 2~ 3, 4, 5, 6, and 7. 6o Prior to issuance of Certificate of Completion on the premises, the applicant shall process to completion the necessary variance to cover the variation from the Code, for use as an apartment house only. 10533 City Hall, Anaheim, California ~ COUNCIL MINUTES ~ December 19, 1967~ 1~30 P.M. PUBLIC HEARING - VARIANCE NO. 1785: Submitted by Harlen Wold, requesting per- mission to establish a restaurant with waivers of required building set- back and six foot block wall~ Property presently zoned R-A, and briefly described as located on the north side of Lincoln Avenue, west of Aladdin Drive, (north portion of Reclassification No. 65-66-102.) At the City Council meeting held May 31, 1966, the City Council continued decision on subject variance to allow readvertising of legal notice providing for single-story development on the northern portion of property described in Reclassification No~ 65-66-102. The City Planning Commission, pursuant to Resolution No.2017, series 1965-66, granted said variance, May 5, 1966, subject to the follow- ing conditions: 1~ That the sidewalks shall be instal~d along Lincoln Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 2~ That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 3~ That fire hydrants shall be installed as required and deter- mined to be necessary by the Chief of the Fire Department. 4~ That this Variance is granted subject to the completion of Reclassification Nc~ 65~66-102~ 5~ That Condition Nos° 1, 2, and 3, above mentioned, shall be complied with prior to final building inspection~ 6. That any air-conditioning facilities proposed shall be pro- perly shielded from view from abutting street(s)~ 7~ That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim.. Excerpts of the City Planning Commission meeting held yesterday, (December 18, 1967), at which time current plans of development were re- viewed, were noted, and the following conditions recommended: Condition No. 7 be amended to read: "That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Noo 1, Revision No. 2." Condition No~ 8 be added, reading: "That the R-A portion of sub- ject property shall be developed in accordance with the C-1 Zone site de- velopment standards with appropriate landscaping and screen plantings" Condition No~ 9 be added, to read: "That all parking area light- ing and/or any other external lighting sball be directed downward and away from the ab~tting residential parcels to the east°" Mro Thompson, in summarizing the history of subject reclassifica- tion and variance, reported that the City Council had approved C-1 zoning on the front 215 feet of subject property, and ruled that the rear portion of the property should remain in the R-A zone, and that at the time a pre- cise plan was submitted the variance be readvertised, setting forth the necessary waivers~ He noted that the proposed building was oriented along the west side o~f the property and that plans indicate development meets all C-1 site development standards~ 10534 City Hall, Anaheim, California ~ COUNCIL MINUTES December 19, 1967, 1~30 P.M. The Mayor asked if anyone wished to address the Council~ Mr~ Ivan Hatfield, ]27 North Aladdin Drive, addressed the Council in opposition, submitting a statement purportedly signed by nine property owners on Aladdin Drive, opposed te the requested uses Mr. Hatfield advised that they would approve of a professional of~ fice that would close at night, however, it was their opinion that a restaur- ant which could possibly be operated on a 24-hour basis, would be unfair to them as residents to the east~ Mro GoRo Winder~ 1531 South P,)mona~ Fullerton, representing the ap- plicant, advised that according to the minutes of the last hearing the objec- tions were to the two-story development and not a commercial use. Mr~ Winder further repc. rted that the restaurant was not a franchise restaurant, and it would be developed by an owner who presently has a success- ful operation in the City cf Commerce~ In. explaining the proposed operation, Mr~ Winder advised that it would not be an all~-night operation, nor one depen- dent upon entertainment~ it would be a family-type restaurant, serving good food, and an asset tc the area~ Mro Hatfield felt that since there were three established restaur- ants in the area, it was possible that the proposed restaurant could become a 24~hour operation, due t~ competitic, n~, The Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed. Councilman Chandler noted that the Lincoln Avenue frontage was com- mercial, and further felt that the issue had been determined, and the rights of the home owners on Aladdin Drive protected by' restricting the actual de- velopment of C-1 to the Lincol~ frontage° Mr. Thompson reported that the waivers requested and advertised pertained to the west property' line, and with the subsequent recommendation of the City Planning Commission that the R-A portion of subject property be developed according to the C~i site developments standards, a block wall and screened landscapimg will also be required adjacent to the R-1 subdivision on the east property llne~ Reference was again made te the recommendation regarding the parking lot lighting and Mr~ Murdech reported that some low.~type lighting is not too satisfactory, as the parking lot is usually too dark for safety° At the conclusion of the discussion, Councilman Krein offered a resolution denying Variance No.. 1785o Refer to Resolution Bock° A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO0 1785, (Harlen Wold). MOTION CARRIED° PUBLIC HEARING ~ RECLASSIFICATION NOo 67.~68,~31~ Submitted by Forest Lawn Cemetery Association, requesting change of zone from R-3 to P-i~ property located at the northwest corner cf Westport Drive and Peregrine Street~ 10535 City Hall, Anaheim, California - COUNCIL MINUTES - December 199 1967, 1:30 P.M. The City Planning Commission, pursuant to Resolution No. PC67-248, recommended said reclassification, subject to the following conditions: la That subject property shall be developed in accordance with the site development standards of the C-1 Zone; provided that the masonry wall may be erected on the property lines adjacent to abutting streets. 2. That all interior landscape areas shall be provided with trees distributed equally throughout the parking area, and that each tree shall be protected by a suitable barrier t~ prevent damage by vehicles° 3o That any ]ighting that is provided within the parking area shall be directed downward and away from the property lines~ Mro Thomps~pn noted the location of subject property and in summar- izing the hearing before the City Planning Commission reported that the pro= perty is projected tp be developed as a parking lot for the existing commer- cial facilities and pest office facility to the north, and the P-.1 zone was an assurance tc the apartment complex to the south that nothing other than multiple-family would 'be developed on the property° The Mayor asked if anyone wished to address the Council° Mr. Austin Eddy~ 1600 South Glendale Avenue, Glendale, represent- ing the applicant~ ~equested they be permitted to erect a three-foot masonry wall, instead of $ five~=fcot wall, setting back three feet, with a planter on the street side between the wall and the sidewalk, and further requested that the lighting facility installed by the City for street lighting on Pere- grine and Westport be placed underground, with Forest Lawn Cemetery Associa- tion paying any differential in cost~ The Mayer asked if anyone else wished to address the Council, there being no response~ declared the hearing closed° RESOLUTION NO. 67R~693: Discussion was held by the City Council, and it was determined that the lower~-wall construction could be accomplished through Development Services Division° At the conclusion of the discussion, Council- man Krein offered Resolution Noo 67R-693, authorizing preparation of neces- sary ordinance changing the zone as requested, subject to the recommendations of the City Planning CommJssicn~ Refer to Resc~lution Book. MOTION CARRIED° REQUEST FOR FRANCHiSE~ Request c~ J~Wo Mullin~ Personal Conveyor Public Mass Transportation System~ for franchise, was ordered deferred to January 9, 1968, on motion by Councilman Krein, seconded by Councilman Chandler~ MOTION CARRIED° PETITION - HELICOPTERS~ Request of Mr~ John Krajacic, together with petition representing fo,ur motels, requesting Council support and assistance in their complaint against low flying helicopters was submitted° Rec,'gnJzing the C:ity O'~uncil had n~:, jurisdiction over this mat- ter, Councilman Chandler was of the opinion that if the complaint was foro warded by the Gity C~uncil ~ the pr~7per authority it would, in essence, lend credence tc their cc~mplaipt~ Mro Krajacic, owner of the Dunes Motel, reported that the re- quest was reported tc the City Council on the advice of the CoA~Ao He explained the situation, and noted those present in the audience verify- ing their compiaint~ Mrs~ Hightower, of the Jack and Jil. 1 Motel, verified the state~ ments made by Mr~ Krajacic, and felt that the Council forwarding their complaint would get quicker resultso Mr. Murdoch reported he would be: hesitant to accommodate their request without a thorough investigation, and further reported that when the original conditional use permit was granted for the Heliport, the City at that time requested that they avoid, if possible, the residential areas, recognizing, however~ that they cc;uld not avoid all residential areas° At the c,~nclusio., of the discussion~ the matter was deferred to January 2~ 1968, for mc~re infcrmsti~n~ at the request of Councilman Krein. WEED ABATEMENT - REIMBURSEMENTS: Mr. Murdoch reported on investigation made relative to Weed Abatement and charges therefor extended to the tax rolls. He advised that a portion of the Weed Abatement charges included cost of rubbish removal, which service was not indicated in the legal notice, and that this amount, representing 47 parcels, was $5,288.00 plus $2,194.52 overhead, or a total of $7,482.52° On the recommendations of the City Manager, and on motion by Council- man Chandler, seconded by Councilman Krein, upon evidence of payment of char- ges on the tax bill, reimbursement to the payee of costs for the removal of rubbish, plus overhead costs attributal thereto, was authorized. MOTION CARRIED° EMPLOYMENT - ELECTRICAL CONSULTANT: Report of needs to study alternative means of providing an electric power supply to the City of Anaheim, together with recom- mendation that RoW. Beck and Associates, Seattle, Washington, be employed as electrical consultant to conduct such study, was submitted by Gordon Hoyt, Utilities Director~ Brief discussion was held as to the areas covered by recommended study~ At the conclusion thereof, recommendation of the Utilities Director was accepted, and employment of R,Wo Beck. and Associates authorized; the City Attorney to prepare necessary contract document, on motion by Councilman Krein, seconded by Councilman Chandler. MOTION CARRIED~ TRANSFER OF FUNDS: Inter.~Bodget transfer of $66,000.00 from funds previously set aside for the acquisition of Edison facilities for the payments of estimated cost of recommended study was authorized, on motion by Councilman Krein, seconded by Councilman Chandler.
