ACTION: Commissioner Bostwick offered a motion, seconded by Commissioner
Koos and MOTION CARRIED, that the Anaheim City Planning Commission does
hereby determine that the previously-approved negative declaration is adequate
to serve as the required environmental documentation for subject request.

MOTION CARRIED, that the Anaheim City Planning Commission does approve
Final Sign Plans, in part, approving signs A, B and D only, and deleting sign C

Chairperson Boydstun asked whether Item No. 1-A and Item No. 2 should both be heard together.
• Greg Hastings, Zoning Division Manager stated Item No. 1-A and Item No. 2 are relative to the same
property and the same conditional use permit. Commission may wish to hear Item No. 2 first and then
return to 1-A since it is dependent on Item No. 2.

Following the continuance of Item No. 2 Chairperson Boydstun asked if Item No. 1-A should also be
continued since they are both related to the same property.
Judy Dadant, Associate Planner, introduced this item by stating Item No. 1-A is a condition of approval for
Condition Use Permit No. 3812. If Commission would like to act on it today then they would assist the
applicant in complying with their conditions of approval.
Commissioner Vanderbilt wondered whether it was possible to vote on this item when there has not been
a resolution on discussion of items.
Judy Dadant stated the information that is provided for Commission is background information. The
request is specifically for the Commission to review final sign plans. Therefore, Commission can act on
this even though the other conditions of approval have not been complied with on the original CUP.
Commissioner Bristol stated the recommendation approving A, B and D and deleting C is what the
applicant was asking about on the signage.
Judy Dadant advised sign "C" is the van logo, that is on the west elevation of the building that is visible
from the 57 Fwy. Staff s concern was that the logo as well as the wall sign that reads "Custom Vans by
Star", would be visible from the public right-of-way and it would seem to be somewhat redundant
• information on that elevation. That is the reason staff recommended the removal of that.

. Greg Hastings, Zoning Division Manager, added there is another reason. One is that the van is
somewhat of a mural and when it gets gra~ti applied to it it is difficult to get the gra~ti removed without
damaging the mural. If the sign had a plastic face, the graffiti could be easily removed. This sign
however, is actually painted on the wall.
B. a) CEQA EXEMPTION SECTION 15061(b)(3)
b) REQUEST TO ALLOW GRANT DEEDS OR TAX BILLS IN LIEU OF
TITLE REPORTS FOR ENTITLEMENT SUBMITTAL
REQUIREMENTS: City Initiated, Planning Department, 200 South
Anaheim Boulevard, #162, Anaheim, CA 92803, request to allow grant
deeds or tax bills in lieu of title reports for entitlement submittal
requirements.
ACTION: Commissioner Bristol offered a motion, seconded by Commissioner
Koos and MOTION CARRIED, that the Anaheim City Planning Commission
does hereby concur with staff that the proposed project falls within the definition
of Categorical Exemptions, Class 15061(b)(3), as defined in the State EIR
Guidelines and is, therefore, categorically exempt from the requirements to
prepare an EIR.

and MOTION CARRIED, that the Anaheim City Planning Commission does
hereby concur with staff to allow grant deeds and tax bills in lieu of preliminary

Greg Hastings, Zoning Division Manager, introduced this item by stating Item No. 1-B is for the Planning
Commission's review. Currently the Code requires that Commission set forth the requirements of
applications that can be for the Commission. One of the current requirements is that a preliminary title
report be submitted with all applications. Staff has reviewed this with the City Attorneys office. The
recommendation would be that in place of the preliminary title report that instead we require documents
which would show a legal description and vesting which are easier to obtain. One of the
recommendations this morning, from Planning Commission, was a current tax bill and any other
document that would be used for legal description could be submitted. They would have both the vested
and legal description. Staff would recommend that the Planning Commission direct staff to make that part
of the application process instead of the preliminary and title report.

Applicant's Statement:
Allen Weinstock from Cape Property Management, stated they are agents for the owners of the Blue
Gum Industrial Park, 1311 through 1347 North Blue Gum Street in Anaheim.
Staff has recommended one of the signs on the 1331 building be removed. It has been there for many
years and has been kept in good condition. Another sign that had been on the building has been covered
over by the construction of the freeway.
In 1996 Commission requested that they plant vines on the elevation of the 1331 building. At that time
the State of California began construction of the freeway expansion and made the area inaccessible to
them from their property and from the property next door it would take a very small person in an almost
impossible situation to plant and maintain the vines in the location. All other concerns of the prior CUP
have been meet by the owners of the industrial park.
THE PUBLIC HEARING WAS CLOSED.
• Chairperson Boydstun asked if the freeway is far enough along now that they will be able to plant vines.

Allen Weinstock responded it is completed, however, there is not enough room between the sound barrier
• and their building to access and plant vines.
Commissioner Bristol asked if this is the same area where graffiti opportunist are often back there
spraying their wall.
Allen Weinstock responded that was correct.
Commissioner Bostwick wondered how the graffiti opportunist can get there but they could not.
Allen Weinstock explained the graffiti is about 5 or 6 feet off of the ground. They would need to get down
below to ground level and access the property from their next door neighbor in order to slide in and try to
bend down and dig a hole, plant a vine and then maintain it. There is a sound barrier there and their
building is right next to it. There is approximately 18 inches of access between the sound barrier and
their building, about 6 to 7 feet off the ground that they stand on, as opposed to where the freeway is -
there is a height elevation difference. [He referred to the photos which he provided earlier as part of their
package.]
Commissioner Koos asked how else Mr. Weinstock would suggest they address the ongoing graffiti
problem.
Allen Weinstock responded they have addressed it themselves by having it painted out and have spoken
with the State of California. The State indicated they would address the situation through their crews to
make sure that it is maintained by the State of California. Therefore, together they feel that they will be
able to control the situation. He asked in his letter to Commission that they be given more than 24 hours
to address the graffiti issue because it attracts graffiti opportunist. Code Enforcement suggested lighting
which they are proposing to discuss with the State of California as well as the highway patrol and they
• have not yet had a response to their request.
Commissioner Bristol stated they have been before Commission several times in the past and it was
discussed that the use may be too intense for this site. He asked how Mr. Weinstock woufd address the
situation with the tandem, and then sometimes with 3, parKing with vehicles that they have. In October it
was noted as a temporary situation where the vans were parked outside.
Allen Weinstock explained this tenant deals with the conversion of vans. They are a dealership for
Chrysler, which means they can purchase directly from Chrysler. They are actually converting new vans.
With the changeover of seasons in October they were overstocked and addressed this parking problem
very quickly, as they must move these trucks out. It is only periodically, and not a usual and customary
occurrence.
Ralph Caputo, the general manager of Star Custom Industries. He is in charge of the vehicles and the
conversions with Chrysler Corporation and has been so since 1989. The vehicles come directly from
Chrysler and are shipped to their location; they convert them and ship them to a dealer. This was an
exceptional year. Chrysler Corporation had finro instances in which they were overstocked with California
vehicles and one of their consignment manufacturers went out of business so they asked Star Custom
Industries if they could take the additional inventory to help them move the inventory to the dealers.
Those vehicles are now gone and sold.
Commissioner Bostwick asked how many other tenants do they now have on the property besides Star
Vans.
Allen Weinstock responded they have five tenants on the property. Two of them are occupants of
multiple buildings. There are only seven buildings and one building is divided into three.
• Commissioner Bostwick asked if the tenants have a problem with parking.
Allen Weinstock responded to the best of his knowledge they did not.

• Commissioner Bristol stated they previously discussed partitioning the parking lot to keep the vehicles
separated from the rest of the property, tenants were also concerned with that. There was discussion at
the morning session regarding the intensity of the project, which is not complying with the conditional use
permit. Commission is trying to determine how they make this property comply.
Allen Weinstock responded currently they have adequate parking for all of their tenants so that everyone
is very happy, including lighting, security and maintenance, which they handle. They do not see the
problem that was seen by Code Enforcement and the Planning Department. The tenants renew their
leases. There is no longer the issue of trucks. There is no opposition today as there had been in the
past.
Commissioner Koos asked staff if they could comment on the issue regarding the applicant's assessment
of the inability to plant vines due to the tightness of the sound wall.
Don Yourstone, Senior Code Enforcement Officer, stated there is a very small access befinreen the wall
and the building. It would be very difficult for someone to get back there to plant the vines. Even if they
did plant them he did not know how well they would grow due to the lack of sunlight.
Commissioner Bostwick stated he thought there were other areas that were of concern which are the
non-permitted awnings and trash enclosure areas, which are not well kept and asked about having that
cleaned up.
Ralph Capato stated regarding the trash situation, there are certain times when they are requested by the
trash company to put their trash cans out so they can access them easily. They informed them,
subsequently, that they can no longer do that and were requested by the City of Anaheim to keep the
trash containers behind their fences. They have complied with that and have since been operating that
• way.
Regarding working of the vehicles outside of the building. When you are in business for a long time you
rely on management to make sure that certain things are complied with and sometimes people forget and
do some of the work outside. When they were made aware of it then, it subsequently stopped and posted
signs on the property stating that there is to be no work on the outside of the building.
The problem that they have is in washing of vehicles. lt is almost impossible to wash vehicles inside of a
building. They have washed them in a place where the water is drained out quickly. They use all
biodegradable, environmentally friendly products. He requested some relief in that area because it is
very difficult to wash them inside of the building.
Regarding the awning. It has been there many years but he did not know what the exact situation of the
awning was.
Commissioner Bristol asked Mr. Capato if they are currently washing vehicles outside.
Ralph Capato responded they are currently in a dilemma with that, occasionally they do.
Melanie Adams, Associate Civil Engineer, stated they would be allowed to use spot degreasers, etc. but
wipe them off before the vehicle is rinsed. They should not be using soaps or other types of detergents
on a large basis and rinsing them into the storm drain.
Ralph Capato indicated they wash approximately finro vehicles a day.
Commissioner Vanderbilt advised there are car washes that are enclosed in a building. If they are
• washing two cars a day he wondered whether they could have them washed at a car wash in the area.
Ralph Capato responded they are dealing with van conversions, which in most instances have large roofs
on them and can not go through regular car wash.

• Commissioner Vanderbilt stated there are some car washes available to accommodate that. There are
also the coin operated type of car washes that have a high roof so they can drive a truck or van through.
Ralph Capato stated he would first like to see what the issue is because they still need to maintain the
business and be cost effective in what they do. If that is what is required of them then they will comply
but they would prefer not to drive the vehicles to the car wash.
Commissioner Bristol asked if Commission could add new conditions to this item since this request is for
an extension of time.
Greg Hastings, Zoning Division Manager advised attached to the staff report is the previous resolution
plus there was a resolution amending the original resolution, which Commission may wish to review in
terms of the conditions. If Commission is leaning towards approving the request then they may want to
review it and staff could suggest changes to conditions based on the today's discussion.
Discussion during the Action:
Commissioner Bostwick stated the condition regarding the graffiti. He suggested, on Condition No. 3,
taking out "the existing building walls, and masonry blocks adjacent to the freeway shall be planted with
clinging vines on the entire length of the property." Regarding removing the on-site gra~ti within 24
hours, he suggested it be left in.
Greg Hastings, Zoning Division Manager clarified that was Condition No. 13.
Greg Hastings, Zoning Division Manager advised in the staff report it indicated that there not yet
compliance with a couple of the conditions, the trash and parking lot. Condition with outdoor work, the
• applicant indicated that the outdoor washing of vehicles is currently going on.
Commissioner Bostwick suggested to leave the condition as is.
Commissioner Bostwick regarding Condition No. 25, that no awning or patio type covers shall be
permitted, therefore the applicant needs to remove those.
Greg Hastings, Zoning Division Manager, stated Condition No. 2 has been modified a couple of times.
The current wording is on the first resolution of their packets (R98-200) page 2 of that resolution and that
condition requires that the storage of vehicles only occur between Buildings A, B, C, D and E. Other than
that the conditions would stand.
Commissioner Bostwick cautioned to owners that those conditions need to be adhered to since they are
going to be returning next year.
Selma Mann, Assistant City Attorney, asked for clarification to Condition No. 3 of PC96-26, was he
recommending deleting the entire condition orjust a portion.
Commissioner Bostwick responded the entire condition.
Selma Mann, Assistant City Attorney, regarding Condition No. 2 on PC98-200, asked what the suggested
change was.
Commissioner Bostwick recommended that the outdoor storage of vehicles may occupy only those
parking spaces with the exhibit on file but that is the parking between Buildings A,B, and C.
Greg Hastings stated he did not have the actual building numbers but only had the addresses, which
• were 1325, 1331 and 1341 as being those units currently occupied by the applicant. He asked
Commissioner Bostwick if he was recommending a change to that condition to allow additional outdoor

storage so that condition would stand as is or modified to reflect those three buildings, 1325, 1331 and
• 1341, by address rather than building numbers.
Selma Mann stated the only issue is that a reinstatement be that they be in compliance with all conditions
of approval. This is an unusual situation where they are actually recommending changing some of the
conditions. In some instances the conditions are remaining the same such as Condition No. 29 regarding
the trash storage areas but it appears that the applicant is not in compliance with the condition.
At this point, Commissioner Vanderbilt recommended a continuance to allow time for the owner to comply
with the existing conditions.
Commissioner Bostwick stated it is still a problem with the reinstatement when they are not in
conformance with original conditions.
Selma Mann stated they are actually amending the condition to change it to give a new time limit for the
applicant to comply. They might want to revisit the Code Section if it is that problematic. The Code as it
is now states that the applicant has to be in compliance with the conditions of approval. She did not see
that there was a difference between putting a time limitation on this one if that is what they want to do, to
change the condition so that the applicant would thereby be in compliance, provided that the applicant
refurbishes the trash storage area within the time that Commission indicates. No difference from
excluding the applicant on vine pockets. If they change the condition so that the applicant is in
compliance then it appears it is something that the Commission can do.
Change of Previous Motion:
Commissioner Bostwick changed his previous motion to a motion for a continuance to February 14, 2000.
~ Allen Weinstock stated he is in a quandary. Their trash complies with the permit that they were issued in
Their awnings are in compliance with City Code. There is an enclosure behind gates that the Planning
Department could not find a permit for. Any other awnings are in compliance and have been in
compliance so he is in somewhat in a quandary of what they are not in compliance with other than the
washing of two cars a day in an area adjacent to the sound wall at the 57 Fwy.
Commissioner Bosfinrick stated if the awning did not have a permit then it got there somehow.
Allen Weinstock explained it may have been permitted originally with the buildings and therefore did not
need to be noted as a separate permit. He understood the City was to re-inspect today and may have
some more input for Commission.
Don Yourstone, Senior Code Enforcement Officer, stated he did an inspection in October and was told
that the trash bin was rolled out from the property to a common area and picked up by the trash company
at that location. It appeared that the trash truck would not access into the area where the trash bin was
being stored to pick up the trash and load it and turn around safety.
Commissioner Bristol suggested on Condition No. 8 of PC98-26, thought a parking design that showed
exactly where the vehicles are to be parked could be done at the same time.
Commissioner Bostwick stated the problem is that the trash truck can not get in if the trash is not taken to
• the outside edge then the trash does not get picked up. When he visited the site he felt it was like a
maze. The trash truck probably does not want to go in there. Therefore, Commissioner Bristol suggested
a continuance to February 14, 2000, so the applicant can address the trash issue and comply with all
conditions before the next hearing, seconded by Commissioner Vanderbilt and motion carried.
1973 to construct the unit. There are times when a trash bin is rolled into the common area parking for
access by Anaheim Disposal. They have no enclosure within their park other than that one, which is on
the south side of the property, which services 1315 Building. So he did not know how else to comply with
that requirement.

• Selma Mann, Assistant City Attorney asked if the Commission wished to let their decision with regard to
the Negative Declaration stand because under the permit-streamlining act the final decision must then be
made within 60 days of the approval of the Negative Declaration.
Commissioner Bostwick then offered a motion to rescind the previous motion for CEQA Negative
Declaration, seconded by Commissioner Bristol and motion carried.
FOLLOWING IS A SUMMARY OF THE PLANNING COMMISSION ACTION.
OPPOSITION: None
ACTION: Determined that the previously-approved negative declaration is adequate to serve
as the required environmental documentation for subject request.
That the Commission rescind the motion for approval of the previously-approved
negative declaration and continued subject request to the February 14, 2000
Planning Commission meeting in order for the property to be brought into compliance
with Code requirements before considering the reinstatement of Conditional Use
Permit No. 3812.

located at the southerly terminus of Paradise Street, 325
feet south of the centerline of Balsam Avenue (Issac

To permit a church and private recreation facility with accessory living
quarters with waiver of (a) minimum setback of institutional uses adjacent
to a residential zone boundary and (b) minimum number of parking
spaces.

Applicant's Statement:
, Greg Hammill, 414 Fernhill Lane, Anaheim Hills, stated he is representing Vietnam Ministries
Incorporated. The proposal is to demolish an existing community building and build a new building in its
place, with a new community building, kitchen and offices. One of the conditions deals with a parking
area located north of the property that is in the process of being abandoned or given (he was not certain
how that worked) to the ministry for use in the park as parking.
Under the Recommendations on page 7 of the staff report, Item No. 27(c) recommends denial of a waiver
pertaining to the required setbacks. Staff requested the applicant to ask for that waiver because they had
measured 12 feet from the existing parking to the eastern property line wall. However, they later had a
civil engineer go out and do a boundary survey and found that their property line is actually 3 feet on the
other side of that wall and they actually have a 15-foot setback from their property line. Therefore, the
walls were built 3 feet on their side of the property.
There is an existing ministry that has taken over this park because the homeowner's associate is no
longer together. They have added a lot to that park. They upgraded and cleaned it up and maintain the
pools and the community building for use by the community. It has been an asset to the community.
They have used the park not only for the community's use but also for their ministry. They have a youth
camp from time to time (He referred to a list of youth events.]. Their goal is to educate Vietnamese youth
in the area regarding their heritage and culture. It has been a very valuable tool for their ministry. Other
than that they do not have any outside users. The other users are all generated from the two tracts of
homes that surround them.
They had a community gathering to share the information on their proposal and display a rendering of the
new project. (He forwarded a pefition of signatures form residents in favor of the project to Commission].
~ Condition No. 16 refers to a 20-square foot walf sign. He requested they have the option of a monument
sign or a wall sign to be determined after they complete some work with a sign company.

Condition No. 19 refers to the recreation facility that shall not be used by anyone except residents in the
• two tracts and not by any outside organizations. If they are considering Vietnam Ministries as an inside
organization then that is fine but if not then they are concerned with that condition.
This is an existing permitted conditional use permit use and they are not planning on expanding it, they
simply want to build a larger facility so that they can house their existing offices under one roof.
Public Testimony:
lan Cook, 2263 East Sandalwood Place, stated the corner of his property is the wall around the park. He
is in the homeowner's association president that turned the property over to Vietnam Ministries. Being
one of the first homeowner's associations in Orange County, their bylaws had "no teeth" whatsoever and
they were not able to take care of the property. That is why they gave it to the Ministries. Living next to
the park, he has noticed it is much quieter now and as a homeowner's association they used to have
motorhome clubs, etc. in there for weekend activities. So the peace and quiet there now is very
beneficial. The Vietnam Ministries has been very nice to them in allowing residents to use the facilities.
THE PUBLIC HEARING WAS CLOSED.
Chairperson Boydstun asked Mr. Hammill if the Vietnam Ministries has a membership.
Greg Hammill responded there is a donation that is made from members.
Chairperson Boydstun was trying to determine who are members of this Ministry.
Greg Hammill stated they do not come from all over. The ministries primary mission is not the church;
they do not even have a worshiping congregation. When the original CUP was granted it was granted to
~ a church that had a worshiping congregation. But that congregation has now been dissipated into
Vietnamese churches and they do not have plans to ever have a worshiping congregation. The ministry
primarily translates daily devotional guides and bibles into Vietnamese.
Chairperson Boydstun asked how many members or participants are in this ministry.
Greg Hammill stated there are some volunteers but most of them are staff members.
Phu Ho stated they have six staff members and sometimes they have two to three volunteers help out.
Chairperson Boydstun suggested that they stipulate that the residents and ministry staff be allowed to use
the facility.
Phu Ho agreed.
Commissioner Bristol referred to their letter of operation.
Chairperson Boydstun stated the letter indicates "or other groups will use the pools as their needs
demand and the pools are available."
Commissioner Bristol stated this appears to be a business because of how the rooms will be made
available and staff indicated there was no congregation.
Greg Hammil stated he wrote the original letter of operation. Originally the park was used by the Elks
Club who made it available in the past and he wanted to keep it that way. The facilities are meant to be
available for the surrounding neighbors who need a community room. People from outside the
• surrounding community are not going to have access to the facility.

Commissioner Arnold stated he would like to see more detail and clarity as to who could use the facility.
~ Just because there has not been a parking problem in the past, does not mean one will not develop if
there is no degree of clarity specified.
Greg Hammill agreed.
Commissioner Vanderbilt stated it appears that the bulk of the operation is going to be the ministry efforts
which are not necessarily community based, but instead more of an international flavor. Therefore, he
was not certain whether it would actually be viewed as a"church".
Greg Hammill responded it is a non-profit religious organization.
Commissioner Vanderbilt stated he perceives that a church operates in and benefits the immediate
community, which this does not appear to be the case here.
Greg Hammill explained the Vietnam Ministries took it over six years ago when the property had a
problem. In trade for that, they wanted to operate it for their own ministry, as well as for the community.
They have their o~ces in homes there. What they want to do is turn the homes back into a residence
and get the people housed in offices. The people who donate to the ministry are excited about
revitalizing a building on the campus.
Commissioner Arnold asked if the Ministry is engaged in religious activity.
Greg Hammill responded it is a Christian organization that translates bibles and other materials into
Vietnamese for the benefit of the Vietnamese people.
Commissioner Koos asked if staff recommended denial for this seven years ago when it came before
• Commission.
Greg Hastings, Zoning Division Manager explained he believed it was denied for the same reasons that
they are discussing today. At the time it was simply to convert the existing building into that type of use.
The intent then was to have more of a congregational type of ineeting.
Commissioner Koos stated it seemed like this neighborhood was developed with this centerpiece being a
community area. He is not comfortable with the evolution of what this is becoming, the intensification that
is being proposed, and where will it stop. Has a difficult time figuring out what the operation actually
involves. It is a religious operation, but is rented out to corporate entities and asked if the intent changed.
Greg Hammill responded the addendum was written to clarify what the real letter of intention is. The
letter of operation was based on history and he inadvertently left out everything that the property had
previously been used for prior to Vietnam Ministries taking over the property. Vietnam Ministries has
greatly reduced the influence of any outside groups coming into the neighborhood.
Commissioner Koos stated staff has concerns over the architectural issues and asked if it were approved
would it have to return as a Reports and Recommendations item. He did not feel comfortable approving
what has been presented thus far, in terms of the architecture. He is not certain whether he liked the
evolution of what it was originally built for, what it is today, and incrementally adding to it.
Commissioner Bostwick stated in Condition No. 19 it states the facility shall only be used by neighboring
residents residing in the tracts. It appears they are keeping it within the neighborhood, but agrees the
building needs to compliment the rest of the neighborhood. He does not want to see it commercialized to
a full-blown building that is rented out and felt it can work as it is currently conditioned.
• Chairperson Boydstun asked staff if the waiver can be denied if fence is 3 feet inside their own property.
Greg Hastings explained it may be the case along one of the property lines, but the chart m Paragraph
No. 8 indicates each property line there appears to be a different circumstance where the waiver would

~ be necessary. The requirement indicates that there be a 15-foot, fully landscaped area around the entire
property and within that area there can only be landscaping. There cannot be any play area or parking.
The fence is permissible if it is there. The charts show that there is only 5 or 8 feet to the property line
and it needs to be 15 feet.
Commissioner Bristol asked Mr. Hastings about the wall versus monument sign on Condition No. 16.
Greg Hastings suggested leaving out the word "wall", that way it could be either one.
CommissionerArnold thought it is a good use and the neighborhood's support is abundant, however, the
applicant should return with a more detailed letter of operation.
Commissioner Koos stated he would support, as part of the Reports and Recommendations item, that the
applicant return with a more detailed letter of operation.
Greg Hammill stated it is conditioned in Condition No. 17, which they are in agreement with.
Greg Hastings advised there are two issues. One is the actual operation and the building itself. Staff
would agree with the Commission that there is not sufficient information at this time to make a
determination as to what uses could or could not be used on the property. The Reports and
Recommendations item would be fine for the elevation drawings. However, for the actual use of the
property, it may be difficult for staff, in the conditional use permit, to determine what really is the purpose
of the property. If Commission was to act on this today, the Reports and Recommendations would not be
part of a public hearing and would not be recorded as a condition of approval.
Commissioner Koos did not want to delay this item, and thought Condition No. 19 would be acceptable.
• Commissioner Arnold advised to add "Ministry staff° to make it clear that the staff can use the facility.
Commissioner Bristol stated originally he was not going to approve this, but after understanding what the
applicant is talking about and tying it to the area, he felt it was acceptable.
During the Action:
Greg Hastings stated as part of the letter of operation there was an attached list of events and asked
Commission if these uses would be acceptable under this conditional use permit.
Chairperson Boydstun responded they would as long as they are connected to the neighborhood.
Greg Hastings advised they will make a copy for the file so that it is on record. It could be conditioned
that the uses be consistent with the letter submitted by Vietnam Ministries, Inc. December 16, 1999
including the attachment.

• Applicant's Statement:
George Sepulveda stated he proposed to raise the height of the wall to 8 foot all around the property line.
The trash pick-up is once a week and intended to keep it open during the time the trash truck is picked
up. The route used by the trash trucks ruined his plants, which therefore initiated the request for approval
from the Traffic Engineering Division for directional signs so the Sanitation trash truck could make the
necessary turn more easily for the trash pick-ups.
The intention was to purchase this building and operate this business for a long time in compliance with
the conditions of approval. He requested approval of the permit for a longer period of time than a one-
year, as recommended in Condition No. 1. He felt it is unfair because he intends to spend a lot of money
to purchase the property and in one year he would need to return again for approval. He did not feel that
is enough time to obtain a return on the business.
Condition No. 5 regarding the recommendation of removing the pole sign, it has been there for several
years and the pole sign would help him in establishing the business. Therefore, the requests that the sign
not be required to be removed.

Chairperson Boydstun indicated that the applicant would install an 8-foot wall between the business and
the motel.
George Sepulveda responded that his intentions were to build a new wall between the motel and this
facility.

George Sepulveda thought there would be enough room and further explained that it was shown on the
• plans.
Commissioner Bristol referred to a comment made by the applicant, in which he stated that there would
be no noise because all work would be done inside. It would be assumed that the doors would be
opened for ventilation and circulation inside the building.
George Sepulveda explained that the doors would be open during business hours. Also the
neighborhood was about 50 feet away from the working area of the building. Noise will always be a big
problem because of the distance to the neighborhood. Also he planned to have the compressor inside
the building, whereas before it was outside of the building.
Commissioner Bostwick asked if the applicant had planned to remove the metal roof on the back.
George Sepulveda responded yes because it was to be an access for the truck to turn around. At this
moment it is in the way so it needs to be removed.
Commissioner Koos reiterated Commissioner Bristol's concerns. He felt this size parcel did not lend itself
to a lot of different kinds of commercial opportunities. Perhaps this business would work at this location,
to a certain extent, but with these small-type businesses they seemed to be prone to possible Code
Enforcement violations. There are residents to the south and the previous use was more sales oriented
as opposed to auto repair.
Chairperson Boydstun interjected that the previous business had a machine shop in the back.
Commissioner Bristol explained that he visited this area over the weekend as well he visited this property
numerous times in the past. In particular, he noticed the open windows to the motel to the west. He
• wondered the level of noise that would result with the type of use proposed at this site. Staff
recommended a proposal for an 8-foot wall, which would appear to potentially block the motel's light on
the west side as well as the south side of the property. He thought the applicant appeared to be a good
businessman but was uncertain whether this is the appropriate site because it does not appear to be able
to hand this type of use. It was tight even for the previous use.
Commissioner Vanderbilt directed a question to staff regarding Condition No. 18 regarding to the hours of
operation to be from 7 a.m. to 7 p.m. Monday through Friday. The petitioner stated that their hours of
operation would be 8 a.m. to 6 p.m. He noticed that the other similar businesses that operate along
Lincoln Avenue are opened at 7 a.m. He wondered whether the petitioner may have proposed 8 a.m. as
their operating hours as a concession to open an hour later than other businesses in order to
accommodate the neighbors.
George Sepulveda responded that in his other businesses he usually opened at 8:00 a.m. and that those
are the hours that he prefers.
Commissioner Vanderbilt stated in terms of the search for business locations; he could appreciate the
fact that Mr. Sepulveda wants to own a business instead of renting. That suggests that he intends to be
there for the long time with a long-term investment. Generally, this means there would be more
comprehensive improvements to the property.
George Sepulveda explained his efforts to get his business back into Anaheim. He began his business in
1988 at 807 South Anaheim Boulevard and was there for seven years and as a result many of his
customers have followed him and are in Anaheim.
Commissioner Vanderbilt questioned the reason Mr. Sepulveda moved his business to Fullerton.
. George Sepulveda explained the reason he moved to Fullerton was because he started working with a
large company which they later terminated the lease. He now wants to return to Anaheim because many
of his old customers are from Anaheim. They continue to follow him. He has been trying to find a

location in Anaheim for the past two-months until he came across this property. This is the only one he
• could locate. At this moment he is having a difficult time in trying to get all the necessary fees for that
property. If he can not obtain them then he would have to start searching all over again. At this moment
the business is at a temporary facility that he rents on a month-to-month basis.
Commissioner Vanderbilt indicated that the tire business next door was for sale.
George Sepulveda stated it is not large enough for this business and was a very old building. The hoist
he uses does not fit in the building. He would have like to have it because it is cheaper but he would
need to tear it down completely and build a new facility there which would be too expensive. The real
estate agent suggested making improvements at this location, so he tried but had no idea how difficult it
would be to get a conditional use permit for this business.
Commissioner Koos stated he is not unsympathetic to Mr. Sepulveda's situation and his desire to for a
business in Anaheim. 7his is a diverse area; there is a motel to the west and residences to the south and
retail to the north. He could not see supporting this project but respected the applicant's desire to want to
run a successful business.
Chairperson Boydstun stated that when you look at what is across the street and what is around this
location, these are the types of businesses that are there and she could not see any change, unless
someone comes along and buys up a whole section.
Commissioner Koos concurred with Chairperson Boydstun's comments. Unfortunately there is not a
master land use plan for East Lincoln Avenue. At the same time, however, they can do incremental
planning that would minimize future problems. He wondered whether they wanted to set a precedent or
want to turn things around.

OPPOSITION: None
ACTION: Approved Negative Declaration
Granted Reclassification No. 99-00-14, unconditionally, based on the basis that the
reclassification of this property to the CL Zone conforms to the Anaheim General
Plan land use designation of General Commercial, and the reclassification also
complies with Commission and Council Policy to reclassify CG and CH zoned
properties to the CL Zone.
VOTE ON RECLASSIFICATION: 7-0
Denied Conditional Use Permit No. 4173 based on the following:
(i) That the proposed auto repair facility will adversely affect the adjoining land
use to the west and south and the growth and development of the area in
which it is proposed to be located with visible service bays to residential and
motel uses and the public right-of-way.
(ii) That the size and shape of the site for the proposed automobile repair facility
as it is currently developed may not be adequate for a busy auto repair facility
which has limited areas of parking during trash pick-up days.
(iii) That the property may be constrained in providing an adequate trash truck
• turn-around and can only do so by impacting required parking.
(iv) That the granting of this conditional use permit may be detrimental to the
peace, health, safety and general welfare of the citizens of the City of Anaheim

as evidenced by the orientation of the overhead doors towards residential and
• motel land uses instead of adjacent commercial uses and its potential to
adversely impact these residential and motel uses.
