This is an opportunity for members of the public to speak on any item under the jurisdiction of the
Anaheim City Planning Commission or public comments on agenda items with the exception of public

Item 1-A through 1-1 on the Consent Calendar will be acted on by one roll call vote. There will be no

Commissioner Koos offered a motion, seconded by Commissioner Bristol and MOTION CARRIED (with

recommended by staff (with modifications to Item 1-I on page 16 of the June 17, 2002, Planning

Chairperson Bosfinrick introduced Item 1-A as Conditional Use Permit No. 2001-04338, 1074 North Tustin
Avenue - Starbuck's Coffee, a request to review sign plans for two additional wall signs for a coffee shop.
Lewis Geiger, 70361 Hemana Circle, Lake Forest, CA, representing Promotional Signs, states they intend
to install two drive-through signs in addition to the Starbuck's existing signs due to the fact Starbuck's feel
they are losing a lot of drive-through business. It is new to Starbuck's and they need the exposure. They
ask that the two additional signs be placed underneath the existing signs. The signs are illuminated and
read, "Drive-through".
Chairperson Sostwick states there was a question in the morning session regarding widening of the road.
Commissioner Vanderbilt states he asked the question regarding widening of Tustin Avenue bridge over
the 91 Freeway because earlier when Commission approved the project, he had concerns regarding the
circulation. There was a problem with congestion that backs up across the bridge and that affects the
eastbound on ramp as well as the freeway itself. At the time, staff informed that a widening project was
expected to begin in the summer of 2000, until the fall of 2002. He asked if the dates were still correct.
• Taher Jalai, Principal Traffic Engineer, states the project will start within a couple of months. The
construction is going to be lengthy, approximately one to two years to complete and at the end there
would be a three-lane eastbound off-ramp. Each off-ramp is currently a two-lane off-ramp. At the
intersection of Tustin Avenue there would be a three-lane off-ramp and that would add a third lane

~ northbound on Tustin Avenue. It would all interchange, as well as the mid-block segment. The
interchange will have higher capacity and will reduce the existing congestion.
Commissioner Vanderbilt wished to clarify if at this point, the congestion level is at the "E" or "F" category.
Mr. Jalai responded it is level service "E" at both interchanges, eastbound and westbound.
Commissioner Vanderbilt wished to clarify with the improvements it is expected to move up to category
«C»
Mr. Jatai responded yes.
Commissioner Vanderbilt states the reason he feels it is all germane is because the text of the signage is
"drive-through" which is intended, as the applicant has stated, to increase vehicular use of that location in
a drive-through manner. Essentially, the applicant wants individuals to drive in and drive out. So, they are
basically going to be in cue; they are never going to leave their cars. The concern he has is with the large
amount of tra~c during the busy morning hours and if it is already backed up that the signage might
actually contribute to an increase in an already congested situation.
Commissioner Boydstun wished to clarify if the width of Tustin Avenue would be affected where
Starbuck's is located.
Mr. Jalai responded no, the widening would take place to the south of Pacific Center driveway signal.
There was a new signal that was installed at Pacific Center main entry and the widening will be farther
south.
• Commissioner Boydstun wished to clarify if the east side of the street would not be widened.
Mr. Jalai responded yes.
Commissioner Bristol states he talked to John Lower, Transportation Manager, sometime ago when they
had the item, and Commissioner Vanderbilt is correct, the concern was the amount of traffic, obviously
the stacking. He remembers talking about the scoot system and asked if he is not correct that the light at
the signal turning west into Pacific Center is not yet operating correctly and will be reconfigured after the
widening of Tustin Avenue.
Mr. Jalai responded yes, once the Tustin Avenue widening is complete they will install the scoot booths.
Commissioner Bristol states the concern was getting people through it quicker and more efficiently and
that could only help Starbuck's with its business.
ACTION: Commissioner Boydstun offered a motion, seconded by Commissioner Bristol and MOTION
CARRIED (with one Commission vacancy and Commissioner Vanderbilt voted no) that the Anaheim City
Planning Commission does hereby concur with staff that the proposed project falls within the definition of
Categorical Exemptions, Class 11 (Accessory Structures), as defined in the California Environmental
Quality Act (CEQA) Guidelines and is, therefore, categorically exempt from the requirement to prepare
additional environmental documentation.
Commissioner Boydstun offered a motion, seconded by Commissioner Bristol and MOTION CARRIED
(with one Commission vacancy and Commissioner Vanderbilt voted no), that the Anaheim City Planning
Commission does hereby approve the additional wall signs (finro (2), 5-squa~e foot "Drive Thru" wall signs)
• as identified on Final Sign Plan Nos. 1 through 4 because the additional signage conforms to Code
standards and identifies the drive-through service which is not visible to Tustin Avenue. In addition, the
proposed signage is not redundant advertising for the restaurant facility and is designed to integrate with
the existing wall signage.

REQUEST FOR AN EXTENSION OF TIME: Bruce Dohrman, 711 extension of time for one year

environmental documentation for this request.
Commissioner Koos offered a motion, seconded by Commissioner Bristol and
MOTION CARRIED (with one Commission vacancy), that the Anaheim City
Planning Commission does hereby approve the request for a one (1) year
retroactive extension of time (to expire on April 9, 2003) based on the
following:
(i) That this is the first request for an extension of time to comply with
conditions of approval.
(ii) That the property has been properly maintained and that there are
no outstanding complaints or violations on file with the Code
Enforcement Division.
(iii) That there have been no changes to the Anaheim General Plan
Land Use Element that would affect this property. Further, the Code
amendment requiring additional parking for single-family residences
with five (5) or more bedrooms does not affect this project because
the conceptual residential plans indicated three (3) bedrooms with
an optional fourth bedroom configuration for each residence. No
additional information or changed circumstances are present which
would contradict the facts used to support the required findings for

Chairperson Bosfinrick introduced Item No. 1-C as Conditional Use Permit No. 2001-04499, 2585 West La
Palma Avenue - Union Oil (76) Service Station, a request for review of revised plans for recommendation
to the City Council to permit the conversion of the existing service station building to an accessory
convenience market.
Greg McCafferty, Principal Planner, informed there was a correction to the agenda. The actual agenda
for the CEQA states exemptions when in fact it is a Negative Declaration.
Applicant's Testimony:
• Ali Dogmetchi, 2585 W. La Palma, Anaheim, CA, states they requested this in February and were denied.
They have changed and reviewed their plans and is no longer asking for a beer and wine license. He is a
franchisee and does not own the property of that location. He understands a brand new station would
look very nice on that corner, unfortunately, it is not his property. He has a certain amount in his budget
to make the location look better and mold it to the standards of today's gas stations.
They have been working with the Planning Department and have basically done whatever they have been
asked to do; landscaping, building, whatever staff wanted they have approved and said they are going to
do. The only thing they have is that staff has requested no propane tank should be there. They are the
only station that has a propane tank within a 3-mile radius in the area and a lot of people in the area use
propane. On the weekends long lines of people wait for the propane tanks to be filled. He respectfully
asks Commission to reconsider letting them keep the propane tank.
Chairperson Bosfinrick states during the morning session Commission and staff agreed there is sufficient
access and parking to leave the propane tank in.
ACTION: Commissioner Bristol offered a motion, seconded by Commissioner Boydstun and MOTION
CARRIED (with one Commission vacancy) that the Anaheim City Planning Commission does hereby
approve the CEQA Negative Declaration.
Commissioner Bristol offered a motion, seconded by Commissioner Eastman and MOTION CARRIED
(with one Commission vacancy), that the Anaheim City Planning Commission does hereby recommend
approval to the City Council of the revised request to establish land use conformity with existing Zoning
Code, land use requirements for an existing automobile service station and to permit the conversion of the
existing service station building into an accessory food mart; subject to the conditions of approval as
• stated in the staff report dated July 15, 2002, with the deletion of Condition No. 17 pertaining to propane
tanks.

Commissioner Koos offered a motion, seconded by Commissioner Bristol and
MOTION CARRIED (with one Commission vacancy), that the Anaheim City
Planning Commission does hereby approve the final landscape plan (Final
Plan No. 1), including the traffic calming measures, precise court location and
location of the replacement specimen trees, based on the following:
~ (i) That the final landscape plan complies with the requirements
stipulated in Condition No. 7 of Resolution No. PC2002-79 for
noting the installation of (a) matching scrim on the chain link fence
located on the east side of the flood control channel, (b) the
planting of vines on 3-foot centers adjacent to the same chain link
fence, (c) the planting of dense bushy trees to provide screening
to the residences from the new driveway on Anaheim Hills Road,
and (d) the installation of irrigation for the new landscape areas on
the premises.
(ii) The final landscape plan shows the precise location of the two
new courts and specifically notes the protection measures (as
reviewed and approved by Urban Forestry staf~ to safeguard the
existing trees near the construction zone.
(iii) That the final landscape plan indicates traffic calming measures on
the premises, including a marked pedestrian walkway, 90 degree
parking spaces and stop signs at the intersections of the
driveways and the public streets (La Paz Way and Anaheim Hills
Road), as required by Condition No. 19 of Resolution No.
PC2002-79.
(iv) That the final landscape plan shows the location of replacement
trees to be planted per the recommendation of Zoning Division
and Urban Forestry staff, with a majority of the trees planted within

Public Testimony:
Samuel A. Powers, 938 N. Gilbert St., Anaheim, CA, states houses will be built in the project on Gilbert
Street and La Palma Avenue and they are going to create congestion. It is going to be an overload.
Everything around there is an overload. There is an accident at the intersection at least once a week. It
is going to put pressure on the Police and Fire Department. They are building a new Walmart three
blocks west of the site and it is not needed. The houses are going to be two-story and will be looking
down at his property for the rest of his life. Everyone in the area has the same opinion and does not want
to see the project go through. Everything in the area is overloaded, contaminated and worn out. The
water is polluted and the schools are overloaded. The traffic on Gilbert Street is like a freeway. Anyone
in the area will agree.
Warren D. Blumberg, 2419 Greenbrier, Ave., Anaheim, CA, states he lives down the street from the
proposed project_ Several of his neighbors wanted to attend today's Planning Commission meeting but
one neighbor who lives across the street from the proposed site had problems with her property being
broken into and things stolen. So, in that state of mind she could not make it. Everything that Mr. Powers
stated is absolutely true. There appears to be only one access road into the area and it comes off of
Gilbert Street. It is an almost impossible situation. Traffic is very high on Gilbert Street and the project
will make it even higher. All of the homes are one-story homes. If there is going to be any building in that
area it should be one-story homes. A two-story place would be looking down onto Mr. Powers, in
particular and the neighbors next to his property. He feels Commission has the information before them
about the school situation.
~ Commissioner Bostwick reminded the speakers to check with staff on July 29, 2002 or before to see what
the actual report would be.
Applicant's Rebuttal:
John Myhre, 16940 Von Karman Avenue, Suite 200, Irvine, CA, representing Western Pacific Housing,
spoke on behalf of the applicant, and states they are working on issues with staff and the concerns of the
neighborhood and would be prepared to make a presentation to Commission at the appointed time.
OPPOSITION: Two people spoke in opposition to the subject request.
ACTION: Commissioner Boydstun offered a motion, seconded by Commissioner Bristol and
MOTION CARRIED (with one Commission vacancy), to continue the subject request to
the July 29, 2002, Planning Commission meeting as requested by the applicant in order
to address site design and Code waiver issues.

Hills area on Stonybrook Drive and Sherrill Street. He asked the speaker, Bueilla Wiggington, if she
could return to the Planning Commission meeting on July 29, 2002.

Bueilla Wiggington, 603 S. Sherrill Street, Anaheim, CA, states she begins radiation in approximately ten
days and would not be able to attend but appreciates any notifications in regard to Sherrill Street. Her
concerns are that they live on the corner of Orange and Sherrill Street and the Edison easement is
directly behind them. She asked questions pertaining to the proximity of the proposed installation to her
fence, release of any radiation or toxic chemicals, any increase of noise or traffic, and if it would be of any
harm to their pets or shubbery. They have had to replace the shrubbery finrice because of spraying from
the people behind them on the Edison easement. She would fike to know the effect on the resale of the
property, whether the installation would be permanent and if so, what the size would be.
Chairperson Bosfinrick asked Mr. McCafferty if she should contact the planner on the item.
Greg McCafferty, Principal Planner states yes, Vanessa Norwood, Planner, would go over the issues with
her.
OPPOSITION: One person spoke with questions and concerns pertaining to the subject request.
ACTION: Commissioner Bristol offered a motion, seconded by Commissioner Boydstun and
MOTION CARRIED (with one Commission vacancy) , to continue the subject request to
the July 29, 2002, Planning Commission meeting as requested by the applicant in order
to readvertise the correct location of the item.
