Greg McCafferty, Principal Planner, introduced Item No. 3.
Applicant's Statement:
Thomas Hartley, 25971 Arriba Linda, Laguna Niguel, CA, pointed out that the staff report, dated October
4, 2004, reported that their request was to waive the required parkway; however they were not asking to
waive the parkway but to waive the sidewalks. He stated that the project started as a two parcel site with
a total of approximately 53 acres so they decided, if economically they could make it work, they would just
develop the top ridge and use the balance of the property as open space. Their intentions are to
separate the property into two parcels, with one for the subdivision and one to be donated to the
Community Services Department, Recreation and Parks Division.
Ralph Hanson, General Council of the Santiago Geological Hazard Abatement District (GHAD), stated
they were asking for an amendment to staff's recommended condition of approval, which was illustrated
in a letter submitted to Commission regarding Mitigation Measure No. 26.
Natalie Meeks, Development Services Manager, responded that the letter submitted requests that the
Mitigation Measure be modified to allow the Geological Hazard Abatement District the opportunity to
approve the grading plan and the mitigation pertaining to the grading plan. However, City staff does not

• recommend allowing a private body the authority to approve the mitigation measure, but recommends
giving them an opportunity to review and comment on the mitigation proposed.
Mr. Hanson stated they have over 12 years of expertise in monitoring the ground water underneath the
project to control the landslide just yards away from the project, and welcome the opportunity to be a
participant in the process.
Mark McLaty, Geologist of the Santiago Geological Hazard Abatement District, 1290 N. Hancock St.,
Anaheim, CA, reminded Commission of the Santiago landslide which took place before the large rainfall
of 1992, and stated that they monitor ground water levels on a monthly basis and prepare reports
quarterly to the district. And any other infiltration of surface water by irrigation or other means would be
detrimental to the system.
Public Statement:
Robert Zerrenner, 6985 Via EI Estribo, informed the Commission that he was the President of the
Homeowners Association and was involved in the landslide of 1992. A study paid for by the City
suggested that an increase in surface infiltration could have a detrimental effect on the stability of the
landslide. Therefore the effect of future development on ground water levels, the existing de-watering
system and landslide stability must be addressed prior to approval of any new development, particularly
to the south and west of Avenida de Santiago. He is supportive of the project but is concerned that if the
project is developed incorrectly, it may have a negative impact.
Donna Gunther, 6960 E. Avenida de Santiago, Anaheim Hilis, CA, stated along with the Hidden Canyon
Association Board and the Anaheim Ridge Association they sent a letter to the Planning Division on
March 1, 2004, listing concerns of stability, pedestrian safety, street condition, emergency vehicle access
• (Pegasus Street), and increased traffic volume.
Susan Tyler, 1190 S. Tamarisk Drive, Anaheim, Hills, CA, a neighbor of Donna Gunther, echoed her
street and traffic concerns and stated that 21 homes would mean approximately 42 more vehicles on an
already narrow curvy road, with the addition of trash cans on trash day.
Susan Sigman, speaking on behalf of the Board of Directors of the Anaheim Hills Citizens Coalition,
asked the Commission to carefully consider the grading and hydrology reports for the area so that their
decision would not affect future homeowners and surrounding neighbors.
Appficant's Rebuttal:
Mr. Hartley responded that they have been working on the project for 18 months; have spent $400,000 in
geological review; and it is not their intent to endanger any of the surrounding communities. PCR did an
environmental study, and Paul Singer, an independent contractor, performed a short analysis of the traffic
that would be added to the area due to the development. Their conclusion was that the design of the
street system was adequate to handle the proposed traffic impact. Regarding the concerns on the open
space, the parcel that would contain the subdivision has two open space designations that are fairly
vertical and it would be impossible to develop anything there. The other parcel, which they separated in
order to have a definable packaged property that they could donate, also does not lend itself to
development.
THE PUBLIC HEARING WAS CLOSED.
The Commissioners discussed and were confident that staff reviewed the project thoroughly; that it meets
the standards necessary for development; and that the addition of the 21 homes would be an asset to the
• area. They concurred that GHAD should be allowed to participate in the grading hearing process as an
interested party, but should not be given approval authority over a City process.

OPPOSITION: 6 people spoke with concerns and suggestions.
6 letters were received prior to the meeting in opposition/concern.
ACTION: Commissioner O'Connell offered a motion, seconded by Commissioner Buffa and
MOTION CARRIED (Commissioners Romero and Velasquez absent), that the Anaheim
City Planning Commission does hereby determine that the Mitigated Negative
Declaration together with Mitigation Monitoring Plan No. 124 is adequate to serve as the
required environmental documentation for subject request.
Granted Reclassification No. 2003-00109 to reclassify a portion of the property from the
T(SC) (Transition; Scenic Corridor Overlay) formerly the RS-A-43,000 (SC)
(Residential/Agricultural; Scenic Corridor Overlay) zone to the RH-2 (SC) (Single-Family
Hillside Residential; Scenic Corridor Overlay) and OS (SC) (Open Space; Scenic
Corridor Overlay) zones; and adoption of the resolution attached to the staff report dated
October 4, 2004, including the findings and conditions contained therein.
Granted Variance No. 2004-04626 (to waive the required private street standards to
construct a private residential street without sidewalks); and adoption of the resolution
attached to the staff report dated October 4, 2004, including the findings and conditions
contained therein, with the following modifications:
Added the following condition of approval to read as follows:
That the final site, floor elevation, fencing and landscape plans shall be submitted to the
~ Planning Services Division for review and approval. Any decision by staff regarding said
plans may be appealed to the Planning Commission as a Reports and
Recommendations item.
Approved Tentative Tract Map No. 16545 (to establish a 28-lot, 21-unit detached single-
family residential subdivision) including the conditions attached to the staff report dated
October 4, 2004.
VOTE: 5-0 (Commissioners Romero and Velasquez absent)
Mark Gordon, Deputy City Attorney, presented the 10-day appeal rights for the tentative tract map ending
at 5:00 p.m. on Thursday, October 14, 2004 and the 22-day appeal rights for the reclassification and
variance ending at 5:00 p.m, on Tuesday, October 26, 2004.
