Greg McCafferty, Principal Planner, introduced Item No. 3 and read into the record a clarification to the conditions of approval in the conditional use permit draft resolution. ApplicanYs Statement: Larry Tidball, Architect for Chevron, RHL Design Group, Inc., 2401 E. Katella Avenue, Anaheim, CA, indicated they are in agreement with the conditions of approval and they understand that some of the conditions, especially on Thursday, Friday and Saturday nights, regarding the sales of beer and wine are related to some historical problems in the area. When the problems are mitigated or if changes occur, they would hope to revisit those conditions. He stated it is his understanding that they would be able to obtain a temporary certificate of occupancy, and then open the new station so that they could transfer the employees over and not have a fueling station in the area. As soon as that transfer has taken place, then they would complete the demolition work. Therefore, only one station would be open. When the demolition is complefed, the final certificate of occupancy would then be issued. THE PUBLIC HEARING WAS CLOSED. Mr. McCafferty concurred with the applicant. Chairman Eastman asked if the old station was under the same ownership. Mr. Tidball responded it is currently owned by Chevron and their intent is to sell it and the proposed use ~ would be more appropriate for the resort area. Commissioner Vanderbilt-Linares referred to the findings indicated in the Conversion Impact Report and stated he supports the finding that states, "Denial of the reclassification would deprive the owner of all reasonable or economically viable use of the property." In response to a question posed by Chairman Eastman, Mr. McCafferty stated the mobile home park owner owns all the coaches. Chairman Eastman stated the owner would be able to do what he wishes with the mobile homes as long as they are empty and he is not impacting where somebody lives. Mr. McCafferty concurred. OPPOSITION: None ACTION: Commissioner Vanderbilt-Linares offered a motion, seconded by Commissioner Romero and MOTION CARRIED, that the Anaheim City Planning Commission does hereby determine that the previously-certified EIR No. 313, together with Mitigation Monitoring Plan No. 067, is adequate to serve as the required environmental documentation for subject request.
