ApplicanYs Statement: Steve Ellis, 4742 Yorba Lane, Yorba Linda, CA, spoke in favor for the owner of the proposed project. He' : stated that the residence is designed to be in accordance with the surrounding area and to meet the requirements of the City of Anaheim. There has been a great deal of environmental investigation in addition to work from the biologist and arborist. Gary Calkins, 6263 East Trail Drive, Anaheim, CA, stated that he has been working with the City for two - years on this project. One of his goals was to make this project presentable to the neighbors. Because of his long history of experience in building this type of project, he reassured the Commission that he wiU be considerate of the neighbors when constructing the residence. Jim Borer, P.O. Box 1803, Rancho Cucamonga, CA, stated that he did a report evaluating this property as a certified arborist. Greg McCafferty, Principal Planner, said that three additional pieces of correspondence were submitted to the Commission at the study session with reference to this Item: Tom Larson, 529 West Blueridge Ave., Orange, CA, a registered consulting arborist, spoke in favor of the project. Douglas McGavin, 291 Riverwood Circle, Anaheim, CA, a long time neighbor to Mr. Calkins, spoke against the project. His main issues were the grading of #he land, amount of dirtthat needed to be moved, lack of privacy and that the proposed residence is not aesthetically compatible to the neighborhood. Neil Siegel, 6221:Trail Drive, Anaheim, CA, spoke against the project. He stated that his concerns, involved the health and safety of the Eucalyptus trees that line the property. The construction of this project would jeopardize the safety of the houses that surround this project because of the effects on the Eucalyptus trees. ,An additional concern was his site line which would include three sets of retaining , walls. , Susie Siegel, 6221 Trail Drive, Anaheim, CA, added that her concerns were that of landslides and presented a newspaper article addressing this issue. She is not in favor of;this projecf due to a record of landslides affecting this slope. Michael Jukam, 6270 East Arboretum Road, Anaheim, CA, spoke as a resident,who lives at the bottom of theslope which is directly affected by this project. ,He stated that'this'slope has a current history of things rolling down into his yard. Robert Cicero; 270 South Riverwood Circle, Anaheim, CA, agreed with Mr. Jukam. He also stated that ' because of the clean-up work that was being performed on the slope, mud came down the hill, tthrough his block wall, into his back yard and pool. The amount of dirt that needs to be moved will be a hazard to ~ his property. , Mr. Cicero also had concerns regarding his site line and the loss of natural beauty of the slope behind his house. Additionally he suggested that the access road be repositioned to minimize the effects to the ' slope and residents. Linda Nelson, 6271 East Arboretum Road, Anaheim, CA, expressed concern about potential landslides. ApplicanYs RebuttaL Gary Calkins said that yes it was his dirt that came down into Mr. Cicero's pool. The reason was that he was following an abatement order from the City of Anaheim Fire Department then the rains came which caused the mud slide. He took all necessary steps to rectify the problem. He stated that he invited all his neighbors to come up and see the proposed project. Commissioner Buffa asked what precautions would be taken to ensure that there would be no falling rocks, dirt or debris from the hill during construction. Mr. Calkins replied that a six foot wall will be erected behind the existing five foot wall to prevent any slippage onto the neighbor's property. . Commissioner Flores asked if a geological study of the soil had been performed. Mr. Calkins said that he has performed three soil tests with eight soil borings. At the time there is grading for the actual wall foundation, other soil tests will be done. He stated that Steve Miller did a complete a geology test when he put in the first keystone wall on the fire abatement road. Most of his property consists of sandstone with a three to four foot covering of dirt. He also stated that as the construction • continues, he will have the soil re-tested if need be. 03-20-06 Page 6 MARCH 20, 2006, PLANNING COMMISSION MINUTES ~ Commissioner Perez asked the applicant how much of his experience is with hillside developments. Mr. Calkins responded that he has experience with this type of project dating from 1977 to the present. James Ling, Principal Civil Engineer, stated that his department has its own process for grading which includes a public hearing for those who are interested in this aspect of the project. His department is responsible for imposing any additional conditions regarding drainage, soils, anything related to the construction of the projecf. This would include final soils, geotechnical and geological reports regarding landslides or compaction of soiL Commissioner Velazquez stated her concern about the stability of the hill. She asked if a retaining wall would stop debris from coming down the hill and what is to prevent anotherRamsgate where all of the policies and procedures were followed and there was still a serious problem. Mr. Ling said that the existing six foot perimeter wall is not designed to be a retaining wall. Its use is primarily for privacy and screening. He stated that there are requirements for the grading code and they will be followed #o ensure that the project is safe. . Commissioner Buffa acknowledged there is a separate Cityprocess that addresses soil issues and the Planning Commission's position is to address the construction of the house itself. ` Commissioner velasquez had additional concerns about the safety of the neighbors surrounding this - project including the location of the road. Mr. Ling reiterated that there is a process to address ground slippage. He stated thaf the project has an equal amount of cut and filL • Further discussion amongst the Commission, staff, applicant and residents continued addressing soil , stability, drainage in the general area, the residence drive way and property lines. THE PUBLIC HEARING WAS CLOSED. Commissioner Romero stated that he has personally viewed the proposed project area, talked with several of the concerned parties and approves of the Item. Commissioner Karaki indicated that he also met with several of the individuals regarding this Item and approves of the project. He will not approve or disapprove of the house based on an article that was published in a newspaper or because of potentially related soil slide area issues. Commissioner Buffa stated that many of the concerns of the neighbors relate to the stability of the hillside. This concern is out of the area of the Planning Commission. The Planning Commission only approves or disapproves of the land use. There is another City process that is in control of the grading and construction elements of this Item. Commissioner Flores concurred with the statements made by Commissioner Buffa. Commissioner Velasquez stressed her concerns for the safety of the neighbors as it relates to this project. James Ling and Greg McCafferty both responded that her concerns about drainage and grading will be addressed at the Public Works public hearing. A resolution to all these issues will be achieved. Commissioner Buffa agreed with the statement by Tom Larson that the line of Eucalyptus trees located • within this project will be substantially taken care of. Commissioner Perez said that he supports the Item. 03-20-06 Page 7 MARCH 20, 2006 PLANNING COMMISSION MINUTES ~ Chairman Eastman said that she personally viewed the property and cannot support the variance regarding the additionafheight of the home. She does however; support the land use. Commissioner Velasquez agreed with Chairman Eastman regarding the approval bf the land use, but she is in favor of keeping the height of the house at 25 feet: OPPOSITION: 6 people spoke in opposition to the subject request. 2 newspaper articles and photoswere submitted at today's meeting. : A letter was received in opposition, prior to the meeting. IN GENERAL: A letter was received from the Anaheim Hills Citizens' Coalition with concerns, prior to the meeting. IN SUPPORT: 3 people'spoke in favor of the subjectrequest. 4 letters in favor of the request were received prior to the meeting. Della Herrick, Associate Planner, introduced Item No. 6. ApplicanYs Statement: Karen Otis, 16871 Seawitch Lane, Huntington Beach, CA, gave a brief history of the church and explanation of design requests for the Commission. She also addressed security, landscaping, drainage and noise issues. The multi-purpose room will only be used by those individuals or groups who wiU attend a service in the church sanctuary such as a wedding. The project is designed to unify the existing buildings in a plaza setting. t Lee Petros, 1851 East 15t Street, Suite 857, Santa Ana, CA, a member of Saint John the Baptist Church, , spoke in favor of theproject. He stated that the church is not proposing this project in order to expand its membership. It is to better accommodate the existing number of parishioners and their needs. 03-20-06 _ Page 11 ' MARCH 20, 2006 PLANNING COMMISSION MINUTES `~ Mr. Petros continued by presenting an overview of the church's various functions accompanied by their parking needs. He stressed the need to be able to use the facilities after 10:00 p.m. for certain special occasions such as weddings, baptisms and their annual festivaL The church has reached'out to the surrounding neighbors to obtain their input regarding the proposed project. - Further discussion between the Commission,'staff and, applicant took place pertaining to the hours that the church`would be able to have activities ending'after 10:00 p.m. Hui Lai, 3100 Marywood Drive, Orange, CA, who performed a traffic study for this Item said that he is available for questions. ' Public Testimony: John Zamora, 523 North Dale Avenue, Anaheim, CA; expressed some concerns about the condition of the church's neighborhood rentals. He also requested that this general location be a multiple zoning area. Ms. Herrick called attention to a mapthat she had on display and explained that the area is re-zoning from the transitional to the RS-2 zoning, which means that the minimum lot size is 7,200 square feet. This zoning is consistenf with the General Plan. Mr. Forsyth, 517 Northbale Avenue, Anaheim, CA, as a long time resident, stated that he is very pleased to have the church as a neighbor. He also wanted to know what is going to be done about thepossible : _ changes to the sidewalks in addition to drainage concerns. James Ling, Principal Civil Engineer, responded that the project is required to put in sfreet improvements ~ which include an extension of the sidewalk in fronf of the church and north towards the Braille lnstitute. However, improvements are only required for the property that is in front of the Commission at this time. If any of the individual home owners want to put a sidewalk in front of their house, they are free to do so after meeting all the City requirements. Mr. Ling said that he will speak to:Mr. Forsyth after the meeting about the drainage issue. Joanne Caldwell, 8734 Kendor Drive, Buena Park, CA, expressed a concern about the existing Cypress trees and the damage that they have done. She also stated that the noise is loud on Friday and Saturtlay nights, but that she is still in favor of the general project. Chairman Eastman indicated that staff will contact Ms. Caldwell with up-to-date information regarding the Cypress trees. Marjorie Whitney, 8612 Kendor Drive, Buena Park, CA, spoke in opposition to this Item. Her concerns inciuded the bus traffic that provides guest transportation for certain church functions. Additional concerns were about serving alcohol at the church and the length of project construction, Chairman Eastman said that her concerns will be addressed. Tom Whitney, 133 East Madison Avenue, Placentia, CA, a long time former resident, spoke against the ' project and its long term effects on the area. He also is against the re-zoning of the area. Tom Brown, 324 North Coolidge Avenue, Anaheim, CA, submitted a letter to the Commission and wanted to know who the owner of record is for the church. He also complained that even though there are Conditional Use Permits in effect, they are not enforced. Chairman Eastman acknowledged receipt of his letter voicing his concerns. ~ - 03-20-06 Page 12 MARCH 20, 2006 PLANNING COMMISSION MINUTES ~ Mr. Petros said that the owner of record is Saint John the Baptist Greek Orthodox Church of Orange ' County, Inc, a non-profit organization and is filed with all the necessary legal entities. He added that the noise levels will be reduced with the construction of the new structures and that the facilities are only used by parishioners, nof outside groups or organizations. He also stated that all of the structures/houses that the church owns are being used by the church. He said that the existing structures were built to existing codes at the time they were erected. Chairman Eastman asked that the bus route for picking up patrons at the Buena Park Mall for church ` eVents be modified so it does not`disturb the local residents. ` Mr. Petros said that this concern will be addressed by the church. CommissionerBuffa asked if it would be appropriate to block off certain streets during the annual festival to help with parking. Greg McCafferty, Principal Planner, said that it is not typical for the Anaheim Police Department to block off streets for an event such as this. .He suggested that a specific shuttle route be created and adhered to which would take the bus. out from the surrounding neighborhoods. There was continued discussion between the Commission, the public and Mr. Petros regarding the use of ' the facilities on the weekends, what time events end and the noise that is created: lt was'suggested by the Commission that a security guard be on the premises after a certain time on the weekends to ensure that the parking lot noise level does not become an issue. ` Mr. Petros agreed with this suggestion. Commissioner Buffa wanted to make sure that there is proper City drainage towards Dale Avenue from ~ the storage building located on the church grounds and that it will be insulated properly: Ms. Otis responded yes to both issues. Mr. Ling said that he will follow up to verify that the drainage from the storage building will in fact flow to " Dale Avenue. There was further discussion between the Commission, applicant and pub{ic about the church event curfew times. THE PUBLIC HEARING WAS CLOSED. Commissioner Velasquez stated that it is an ongoing concern of the Commission to balance the needs of the various churches in residentia! neighborhoods and the people who live around them. She also stated : that she wanted to make sure that the drainage issues were addressed and solved. Commissioner Velasquez then proposed that the curfew times for the church activities be: Sunday through Thursday, 10:00 p.m., Friday at 11:00 p.m. and Saturday by 2:00 a.m. provided that any activity past 10:00 p.m., that there is an onsite security guard to monitor the activities in the parking lot.
