Chairman Eastman opened the public hearing
Dave See, Senior Planner, introduced this item and stated the aerial map shows the site conditions of the
existing vacant property. A single-family home abuts the site to the east and a duplex to the west. There
is a large apartment complex to the south. Setback modifications are requested for the sfreet setback
where 15 feet is required and 5 feet is proposed to the ultimate right-of-way and interior setback, 15 feet
is required and 10 feet is proposed along the interior property lines. The street side setback modification
is appropriate because although the project will be dedicated into the ultimate right-of-way there are no
plans to widen the street, therefore, a 15 foot wide landscape setback wil! be maintained. The interior
setback modification should be approved because the proposed setbacks are consistent with those
currently found in the neighborhood. He gave further detailed information regarding the proposed
building elevations, and stated a craftsman architectural style is proposed. Staff recommends approval of
the project because the project is consistent with RM-4 zoning and Genera( Plan, the building design
incorporates articulation, historical elements and architectural detail consistent with in-fill projecfs recently
approved by the Commission, in addition, the modifications requested are consistent with development
existing in the neighborhood and the waivers can be justified. The project would increase the City's
affordable housing stock and is consistent with the goals of the housing element.
Eduardo Hernandez, Community Development Department, Project Manager II, thanked the Planning
Commission for their consideration of the project.

~ Mr. See responded that the minimal requirements is actually24 feet, therefore the 26 feet exceeds the
_ public worKs standard.
Commissioner Buffa expressed her support of the project and stated the very low housing market is the
toughest market to serve; and to be able to serve it in duplex units is fantastic and feels a great job has
been done in the design and making it compatibfe with the neighborhood.
Commissioner Velasquez expressed her support of the project, and stated she volunteers for habitat in `
Costa Mesa and they always do a great job, and feels it is a real good partnership with the City and
habitat.
_ Commissioner Flores concurred with staff and fellow Commissioners and thanked'habitat for humanity
and bringing to the City of Anaheim an affordable project that is an attractive design.

Mark Gordon, Assistant City Attorney, presented the 10-day appeal rights for the Tentative Parcel Map
ending at 5:00 p.m. on Thursday, December 21, 2006; and presented the 22-day appeal rights for the

John Ramirez, Associate Planner, introduced this item and stated the General Plan designates the
property for low-medium densify residential land uses, since the proposed land use and density is
consistent with the type of land use and density allowed by the General Plan, and the project is
compatible with existing residential development in the vicinity and the proposal is consistent with the
goals and policies contained in the Housing Element and General Plan, staff recommends approval of the
requested actions to establish this residential subdivision.
ApplicanYs Statement:
George Behnam, Architect, 1150 E. Orangethorpe Avenue, Suite 109, Placentia, CA, stated he reviewed
the conditions of approval and is in agreement.
THE PUBLIC HEARING WAS CLOSED.
Commissioner Faessel asked has any correspondence been received from West Anaheim Neighborhood
Development Council (WAND).
Mr. Ramirez responded there hasn't been any feedback from WAND, but they meet regularly with other
Planning Services Division staff regarding all projects that are on the filing log, and therefore, they are
aware of the project through that process.
Commissioner Flores asked if they could recommend a certain design for patio covers.
Mr. Ramirez indicated they could add a condition of approval stipulating on that issue. Part of the '

challenge will be in the long term; they will come in at differenf times.

~ Commissioner Flores asked if it could then be stated in the homeowner's association that ho patio covers
are allowed.
Mr. Ramirez stated they could add a condition of approval pertaining to the design of the patio covers,
and he could work with the applicant and incorporate that into the CC&R's.
Commissioner Romero asked if the trash pick-up would be located on Lincoln Avenue.
Mr. Ramirez responded that the sanitation service will be through barrel pick-up on the private drive.
Commissioner Romero asked where the individual trash bins would be located. '
~ Mr. Ramirez responded in the interim they will be placed in the garages, and they will place them in front
of the garage doors on trash days. In the garages, there would be a cut-out for the trash barrels in order
for them to still maintain the minimum code required clearance for the interior space.
Greg McCafferty, Principal Planner, asked for Judy Dadant to address the issue of patio covers. -
Judy Dadant, SeniorPlanner, gave clarification regarding the patio covers and stated the code requires
for single story structures, a 10-foot structural setback, therefore, practically speaking there is only one
elevation where they may be able to add patio covers, and that would be on the north, where it is
adjacent to the school, the back two units are practically the only two unitsthat would be permitted to
have a patio structure and the structure could not exceed 5 feet in depth because currently the building is
at a 15-foot setback and code requires a 10-foot setback.
Chairman Eastman stated could that be a condition of disclosure for the buyers.
~ Mark Gordon, Assistant City Attorney, stated based upon the discussion it would seem unnecessary
because the building standards and the zoning and development standards would be controlling and
would operate as a limitation, therefore, it would be sufficient to address the issue. Such a structure
would require a building permit and any building or patio structure would require approval or review by the
Planning Department.
Commissioner Flores clarified if someone happens to puf up a patio cover and there was a complaint it
would have to go through the Code Enforcement Division.
Mr. Gordon responded if someone were to build such a structure without a permit and the approval from
the Planning Department, then yes it would become a Code Enforcement issue as it would be an
unpermitted structure.
Commissioner Flores referred to the patio cover issue and asked if they could add it fo their homeowner's
association. -
Ms. Dadant responded within their CC&R's if it was the desire of the property owner to regulate the
design of the structures, she believes they could include within their own CC&R's language that require
their review or approval prior to permitting, but that would be an issue between the association and the
homeowner.
Mr. Gordon indicated it is not something they would typically review, in some cases they do depending
upon the nature of the development, but with the subject type of development they normally wouldn't
review the CC&R's to ensure that they had such provisions in fhem, therefore, the building standards and
the zoning and development standards are controfling and would operate as a restriction.
~ Commissioner Buffa commended the applicant and stated the elevations turned out very well.
