Resolution-PC 2000-114~ RESOLUTION NO. PC2000-114 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING RESOLUTION NO. PC88-202, AS AMENDED, ADOPTED IN CONNECTION WITH CONDITIONAL USE PERMIT NO. 3042 CUP Tracking No. 2000-04251 WHEREAS, on August 1, 1988, the Planning Commission adopted Resolution No. PC88- 202 to grant Conditional Use Permit No. 3042 and permit a parish center expansion to an existing church at 5800 East Santa Ana Canyon Road with waivers of minimum number of parking spaces and maximum structural height; and WHEREAS, on September 26, 1988, the Planning Commission adopted Resolution No. PC88-279 to amend Resolution No. PC88-202, nunc pro tunc, to add a condition pertaining to driveway gates or other devices to discourage speed'ung in the church parking lot during off hours; and WHEREAS, on May 4, 1992, the Planning Commission adopted Resolution No. PC92-63 to amend a condition of approval pertaining to required street improvements along Santa Ana Canyon Road; and WHEREAS, this property is developed with a church (San Antonio Catholic Church) with a parish center in the RS-A-43,000(SC) (Residential/ Agricultural - Scenic Corridor Overlay) zone; and that the Anaheim General Plan Land Use Elem~nt designates the property for Hillside Low Density Residential land uses; and WHEREAS, the petitioner requests amendment to this conditional use permit under the authority of Code Sections 18.03.030.010, 18.21.050.110 and 18.21.050.270 to construct a two-story religious education building in conjunction with the existing church, with the following waivers: (a) Sections 18.04.060.050 - Reauired qarkinp lot landscapinq. and 18.06.030.040 (b) Section 18.84.042.030 - PermiCted roof-mounted equipment. (Roof-mounted equipment not permitted in the Scenic Corridor Zone Overlay; roof-mounted equipment proposed for the new building) WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 9, 2000, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and that said public hearing was continued from the September 25, 2000 Planning Commission meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That amending the existing conditional use permit to construct a two-story religious education building in conjunction with an existing church with waivers of required parking lot landscaping and permitted roof-mounted equipment is properly a use which is authorized by the Anaheim Municipal Code. CR4922PK.doc -1- PC2000-114 ~ . 2. That waiver (a), required parking lot landscaping, is hereby denied on the basis that it was deleted following public notification. 3. That waiver (b), permitted roof-mounted equipment, is hereby approved on the basis that in commercial zones in the Scenic Corridor roof-mounted equipment which is fully screened from the public's view is permitted subject to approval of a conditional use permit and this proposal is a quasi- public use in a residential zone (RS-A-43,000) on Santa Ana Canyon Road; and that the proposed equipment, according to the exhibits and information submitted by the petitioner (cross -sectional plans, line-of-sight plan and photographs), will be below the height of the mansard roof and will be screened from the public's view, including from surrounding residences in all directions. 4. That the proposed expansion of the church, as approved, will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located; and that the petitioner is providing additional parking that is not otherwise required by the Zoning Code. 5. That the size and shape of the site for the expansion of the church facility is adequate to allow full development of the proposal in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare because the proposed building complies with the development standards of the underlying RS-A-43,000(SC) zone and is located 139 feet away from the abutting residences to the west. 6. That the traffic generated by the new religious education building will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because this religious education building will operate during the week and will not conflict with weekend church services when the entire parking lot is utilized. 7. That amending Conditional Use Permit No. 3042 to permit and construct a two-story religious education building in conjunction with the existing church will not, under the conditions imposed, be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. 8. That no one indicated their presence at the public hearing in opposition to the proposal; that three concerned people spoke; and that no correspondence was received in opposition. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: The Planning Director's authorized representative has determined tlhat the proposed project falls within the definition of Categorical Exemptions, Class 1, as defined in the State of California Environmental Impact Report (EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby amend Resolution No. PC88-202, adopted in connection with Conditional Use Permit No. 3042 and amended by Resolution Nos. PC88-279 and PC92-63, to construct a two-story religious education building in connection with an existing church and parish center, with waiver of the following: Section 18.84.042.030 - Permitted roof-mounted equipment. (Roof-mounted equipment not permitted in RS-A-43,000-zoned property in the Sceniic Corridor Zone Overlay; roof-mounted equipment proposed for the new two-story religious education building) BE IT FURTHER RESOLVEID that the conditions of approval be amended in their entirety to read as follows: That trash storage area(s) shall be provided and maintained in location(s) acceptable to the Public Works Department, Streets and Sanitation Division, and in accordance with approved plans on file with said Department. Said storage areas shall be designed, located and screened so as not to be -2- PC2000-114 ~ • readily identifiable from adjacent streets or highways. The walls of the storage areas shall be protected from graffiti opportunities by the use of plant materials such as minimum one (1) gallon sized clinging vines planted on maximum three (3) foot centers, or tall shrubbery. 2. That any roof-mounted equipment shall be subject to Anaheim Municipal Code Section 18.84.062.032 pertaining to the "SC" Scenic Corridor Overlay Zone. The method by which roof- mounted equipment will be completely screened shall be specifically shown on the plans submitted for building permits. 3. That all existing air conditioning facilities and other roof and ground-mounted equipment shall continue to be properly shielded from view and the sound buffered from adjacent residential properties. 4. That existing and proposed lighting fixtures in any proposed parking area located adjacent to any residential property shall be decorative and shall be down-lighted with a maximum height of twelve (12) feet. Said lighting fixtures shall be directed away from adjacent residential property lines to protect the residential integrity of the area. Any new lighting fixtures shall be specifically shown on the plans submitted for building permits. 5. That the proposal shall comply with all sign standards for the RS-A-43,000(SC) Zone unless a variance allowing sign waivers is approved by the Planning Commission or City Council. 6. That driveway gates or any other devices to discourage vehicles from speeding through the parking lot during hours when the church is not in operation shall be installed and maintained, as reviewed and approved by the City Traffic and Transportation Engineer. 7. That the existing parish center and the proposed religious education building shall not be used concurrently with the main church sanctuary. 8. That because this project has landscaping area(s) exceeding two thousand five hundred (2,500) square feet, a separate irrigation meter shall be installed in compliance with Chapter 10.19 "Landscape Water Efficiency" of Anaheim Municipal Code and Ordinance No. 5349. Said information shall be specifically shown on the plans submitted for building permits. 9. That plans shall be submitted to the City Traffic and Transportation Manager for review and approval showing conformance with the most current versions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and driveway locations. Subject property shall thereupon be developed and maintained in conform~ance with said plans. 10. That all new driveways shall be reconstructed to accommodate ten (10) foot radius curb returns in conformance with Engineering Department Standard No. 137. Said information shall be specifically shown on the plans submitted for building permits. 11. That three (3) foot high street address numbers shall be displayed on the roof of the building in a color contrasting to the roof material. The numbers shall not be visible to the streets or adjacent properties. Said information shall be specifically shown on the plans submitted for building permits. 12. That any tree planted on-site shall be replaced in a timely manner in the event that it is removed, damaged, diseased and/or dies. 13. That the legal property owner shall provide the City of Anaheim with a public utility easement for electrical facilities (primary and transformer). Said easement shall be submitted to the City of Anaheim prior to connection of electrical service. -3- PC2000-114 ~ ~ 14. That church activities in the existing parish center and the proposed religious education building shall end before 10 p.m., except on special church holidays. 15. That the property shall be permanently maintained in an orderly fashion through the provision of regular landscaping maintenance, removal of trash or debris, and removal of graffiti within twenty four (24) hours from time of occurrence. 16. That a landscaping and irrigation plan for the new landscaping, including minimum twenty four (24) inch box sized trees, shall be submitted to the Zoning Division for review and approval. Any decision made by the Zoning Division regarding said plan may be appealed to the Planning Commission and/or City Council. 17. That there shall be no windows on the west building elevation of the new religious education building. Revised elevation plans eliminating the windows (which are shown on the exhibits submitted in connection with this use permit) shall be submitted to the Zoning Division of the Planning Department for review and approval by the Planning Commission as a"Reports and Recommendations" item. 18. That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning Department marked Revision No. 1 of Exhibit No. 1(CUP No. 3042) and Exhibit Nos. 5, 6, 7 and 8; and as conditioned herein. 19. That prior to issuance of a building permit for the religious education building or within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 2, 4, 6, 8, 9, 10, 11, 13, 16 and 17, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 20. That prior to final building and zoning inspections, whichever occurs first, Condition Nos. 1 and 18, above-mentioned, shall be complied with. 21. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
