A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2000-04262 BE GRANTED
FOR THREE YEARS TO EXPIRE ON OCTOBER 9, 2003
WHEREAS, the Anaheim Gity Planning Commission did receive a verified Petition for
Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State
of California, described as:
PARCEL C IN THE CITY OF A~NAHEIM, COUNTY OF ORANGE, STATE OF
CALIFORNIA, AS SHOWN ON A MAP FILED IN BOOK 44, PAGE 15 OF
PARCEL MAPS, IN THE OFFIGE OF THE COUNTY RECORDER OF SAID
COUNTY; AND
PARCEL 2: THAT PORTION OF THE SOUTHWEST QUARTER OF THE
NORTHWEST QUARTER OF SECTION 8, TOWNSHIP 4 SOUTH, RANGE 10
WEST, IN THE RANCHO SAN JUAN CAJON DE SANTA ANA IN THE CITY OF
ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP
RECORDED IN BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS IN THE
OFFICE OF THE COUNTY RECORDER OF SAID COUIVTY, DESCRIBED AS
FOLLOWS:
BEGINNING AT A POINT ON 7HE SOUTHERLY LINE OF SAID SOUTHWEST
QUARTER, EAST S822.00 FEET FROM THE SOUTHWEST CORNER
THEREOF; THENCE NORTH 491.53 FEET PARALLEL WITH THE WEST LINE
OF SAID SOUTHWEST QUARTER TO THE SOUTH LINE OF THE NORTH
25.00 ACRES THEREOF; THENCE EAST 520.70 FEET ALONG SAID SOUTH
LINE TO THE EAST LINE OF SAID SOUTHWEST QUARTER; THENCE
SOUTH 492.07 FEET TO THE SOUTHEAST CORNER OF SAID SOUTHWEST
QUARTER; THENCE WEST A518.90 FEET TO THE POINT OF BEGINNING.
WHEREAS, the City Plann~ing Commission did hold a public hearing at the Civic Center
in the City of Anaheim on October 9, 2000 at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed conditional use permit and to
investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use permit is authorized
by Anaheim Municipal Code Section 18.61.050.140 to permit a church within an industrial complex with
waiver of the following:
Sections 18.06.050.020.021.0212 - Minimum number of parkinq spaces.
18.06.050.020.026.0266 (188 spaces required;
18.06.050.030.031 182 spaces proposed and concurred with by the City Traffic and
18.06.080 Transportation Manager)
and 18.61.066.050

2. That the parking waiver iS hereby approved on the basis that the deviation is minor;
and that the City Traffic and Transportation Manager has reviewed the traffic study prepared by Traffic
Safety Engineers and determined that the proposed parking is adequate to support the existing industrial
and industrially-related uses as well as the proposed church.
3. That the proposed use, as conditioned herein, will not adversely affect the adjoining
land uses and the growth and development of the area in which it is proposed to be located because the
existing industrial complex is large enough to support the church activities.
4. That the size and shape of the site for the proposed church is adequate to allow full
development of the proposal in a manner not detrimental to the particular area nor to the peace, health,
safety and general welfare because the use, as conditioned herein, will not conflict with the operations of
existing businesses within the industrial complex.
5. That the traffic generated by the proposed use will not impose an undue burden upon
the streets and highways designed and improved to carry the traffic in the area.
6. That granting this conditional use permit, under the conditions imposed, will not be
detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim.
7. That no one indicated their presence at the public hearing in opposition to the proposal;
and that no correspondence was received in opposition.
CALIFORNIA ENVIRONM~NTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to permit a church with waiver of minimum number of
parking spaces on an irregularly-shaped 3.4-acre property located at the northeast corner of Crescent
Avenue and Valley Street, having frontages of 490 feet on the north side of Crescent Avenue and 240
feet on the east side of Valley Street, and further described as 2121 West Crescent Avenue, Unit B; and
does hereby approve the Negative Declaration upon finding that the declaration reflects the independent
judgment of the lead agency and that it has considered the Negative Declaration together with any
comments received during the public review process and further finding on the basis of the initial study
and any comments received that there is nb substantial evidence that the project will have a significant
effect on the environment.
NOW, THEREFORE, BE IS RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are
hereby found to be a necessary prerequisite to the proposed use of the subject property in order to
preserve the safety and general welfare of xhe Citizens of the City of Anaheim:
That except for special religious holidays, the hours of operation shall be limited to the following:
Monday through Friday: 6:00 p.m, to 10 p.m.
Sunday: 10:30 a.m. to 12 noon (except for office staffl
2. That the number of congregants at any one time shall be limited to fifty (50) persons, sixteen (16)
years of age and over. Should the assumptions contained in the Letter of Operation (on file with
the Planning Department) change, said changes shall be submitted to the Zoning Division for
review and approved by the Planning Commission as a"Reports and Recommendations" item.
3. That the property shall be permanently maintained in an orderly fashion through the provision of
regular landscaping maintenance, removal of trash or debris, and removal of graffiti within twenty
four (24) hours from time of occurrence.

4. That all existing mature landscaping shall be maintained and immediately replaced in the event that
plants become diseased or die.
(a) That the wall signs shall comply with the sign standards for the ML (Limited Industrial) Zone
unless a variance for sign waivers is approved by the Planning Commission or City Council.
(b) That any proposed freestanding sign shall be submitted to the Zoning Division for review and
approval by the Planning Commission as a"Reports and Recommendations" item.
6. That three (3) foot high street address numbers shall be displayed on the roof of the building in a
color contrasting to the roof material. The numbers shall not be visible to the streets or adjacent
properties. Said information shall be specifically shown on plans submitted for building permits.
7. That no private school, daycare or preschool facilities shall be permitted in conjunction with this
church.
8. That this conditional use permit shall ~expire three (3) years from the date of this resolution on
October 9, 2003.
9. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1 and 2, and as conditioned herein.
10. That prior to commencement of the activity authorized by this resolution, or prior to issuance of a
building permit, or within a period of one (1) year from the date of this resolution, whichever occurs
first, Condition No. 6, above-mentioned, shall be complied with. Extensions for fu~ther time to
complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim
Municipal Code.
11. That prior to the commencement of the activity authorized by this resolution or prior to final building
and zoning inspections, whichever occurs first, Condition No. 9, above-mentioned, shall be
complied with.
12. That approval of this application constitutes approval of the proposed request only to the extent that
it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or approval
of the request regarding any other applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance
with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof,
be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this
Resolution, and any approvals herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
