A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
REINSTATING AND APPROVING CONDITIONAL USE PERMIT NO. 4061
UNTIL NOVEMBER 23, 2000,
AND AMENDING CEFtTAIN CONDITIONS OF APPROVAL OF
RESOLUTION NO. PC98-185, AS ADOPTED THEREWITH
WHEREAS, on November 23, 1998, the Planning Commission adopted Resolution No.
PC98-185 to grant Conditional Use Permit No. 4161 for one year and establish conformity with existing
Zoning Code land use requirements for an existing commercial shopping center and to permit a 3,400
sq.ft. public dance hall with waiver of minimium number of parking spaces; and that Condition No. 20 of
said resolution specifies that the use permit shall expire one year from the date of approval, on November
23, 1999; and
WHEREAS, this properry is developed with a 16,900 sq.ft. 4-unit commercial shopping
center, including a public dance hall at 1652 West Lincoln Avenue with live music and dancing but no
alcoholic beverage sales; that the property is zoned CL (Commercial, Limited); that the Anaheim
General Plan Land Use Element designates the property for General Commercial land uses; and that the
property is located in the Plaza Redevelopment Project area; and
WHEREAS, the petitioner has requested reinstatement of Conditional Use Permit No.
4061, which expired on November 23, 1999, and deletion of Condition No. 20 pertaining to the time
limitation; and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center
in the City of Anaheim on January 3, 2000 ~t 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed conditional use permit and to
investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed reinstated use are properly ones for which a conditional use permit is
authorized by the Zoning Code.
2. That the reinstated uses, as amended, will not adversely affect the adjoining land uses
and the growth and development of the area in which it is located.
3. That the size and shape of the site for the reinstated uses, as amended, is adequate to
allow full development of the proposal in a iinanner not detrimental to the particular area nor to the peace,
health, safety and general welfare.
4. That the traffic generated by the uses, as amended, will not impose an undue burden
upon the streets and highways designed and improved to carry the traffic in the area.
5. That reinstating this conditional use permit, as amended, will not be detrimental to the
peace, health, safety and general welfare of the citizens of the City of Anaheim.
6. That this conditional use permit is being exercised substantially in the same manner and
in conformance with all conditions and stip~ulations originally approved by the approval body.

7. That this conditional use permit is being exercised in a manner not detrimental to the
particular area and surrounding land uses, nor to the public peace, health and safety and general welfare,
as discussed in paragraphs (9) through (13~ of the Staff Report to the Planning Commission dated
January 3, 2000.
8. That no one indicated their presence at the public hearing in opposition to the proposal;
and that no correspondence was received in opposition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to reinstate Conditional Use Permit No. 4061 in order to
establish conformity with existing Zoning Code land use requirements for an existing commercial
shopping center and to permit a 3,400 sq.ft: public dance hall at 1652 West Lincoln Avenue with waiver of
minimum number of parking spaces; and does hereby find that the Negative Declaration previously
approved in connection with Conditional Use Permit No. 4061 is adequate to serve as the required
environmental documentation for subject re~quest upon finding that the declaration reflects the
independent judgment of the lead agency and that it has considered the previously approved Negative
Declaration together with any comments received during the public review process and further finding on
the basis of the initial study and any comments received that there is no substantial evidence that the
project will have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby amend Resolution No. PC98-185, adopted in connection with Conditional Use Permit No.
4061, to reinstate the conditional use permik and to amend Condition No. 20 therein to read as follows:
20. That subject conditional use permit shall expire on November 23, 2000.
AND BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does
hereby add the following new conditions:
26. That within a period of one (1) month from the date of this resolution, all debris
and overgrown vegetation at the rear of the property shall be removed.
27. That all trash bins shall be stored away from the public's view.
28. That within a period of two ~(2) months from the date of this resolution, a
landscape plan showing a~ditional landscaping in the f~ont area shall be
submitted to the Planning Department for review and approval by staff. Said
landscaping shall be planted within one (1) month after Planning Department
approval.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
January 3, 2000.
