RESOLUTION NO. PC2000-41
A RESOLUTION OF TH~ ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR CONDITIONAL USE PERMIT NO. 4188 BE DENIED
WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for
Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State
of California, described as:
LOT 8 OF TRACT 1322, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE,
STATE OF CALIFORNIA, IN THE RANCHOS LAS BOLSAS AND SAN JUAN
CAJON DE SANTA ANA, AS SHOWN ON A MAP THEREOF RECORDED IN
BOOK 40, PAGE 7, MISCELLANEOUS MAPS, RECORDS OF SAID ORANGE
COUNTY.
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center
in the City of Anaheim on April 10, 2000 at 1:30 p.m., notice of said public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03,
to hear and consider evidence for and agai~st said proposed conditional use permit and to investigate
and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed use is properly one for which a conditional use permit is authorized by
Anaheim Municipal Code Section 18.26.050.030 to permit and establish a cultural and meditation center
with accessory caretaker's residence.
2. That the proposed use is hereby denied because the use, at this location in an area
which is zoned RS-7200 (Residential, Singl~e-Family), could adversely affect the adjoining land uses and
the growth and development of the area, arod could adversely change the land use patterns of the
surrounding single-family residential area.
3. That the size and shape of this property is not large enough to contain all the activities
on-site; and that the submitted letter of operation indicates three specific holidays that would draw
additional visitors to this cultural and meditation center, and the overflow parking would adversely affect
the nearby single-family residences on Cerritos Avenue.
4. That the traffic generated by the cultural and meditation center, especially during special
holidays, would impose an undue burden upon Cerritos Avenue and create competition for on-street
parking with existing single-family residences which front on Cerritos Avenue.
5. That granting of Conditional Use Permit No. 4188, ~egardless of any conditions which
might be imposed, would be detrimental to the peace, health, safety and general welfare of the citizens of
the City of Anaheim.
6. That 12 people indicated their presence at the public hearing in opposition to the
proposal; and that 30 letters were received in opposition.
CALIFORNIA ENVIRONM~NTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to permit and establish a cultural and meditation center
with accessory caretaker's residence on a rectangularly-shaped 1.15-acre property having a frontage of

166 feet on the north side of Cerritos Avenue and a maximum depth of 302 feet, being located 650 feet
west of the centerline of Bayless Street, and further described as 1609 West Cerritos Avenue; and does
hereby approve the Negative Declaration upon finding that the declaration reflects the independent
judgment of the lead agency and that it has considered the Negative Declaration together with any
comments received during the public review process and further finding on the basis of the initial study
and any comments received that there is no substantial evidence that the project would have a significant
effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby deny subject Petition for Conditional Use Permit on the basis of the aforementioned findings.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
April 10, 2000.
