PC2000-78 • A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION AMENDING THE CONDITIONS OF APPROVAL OF RESOLUTION NO. 93-131 ADOPTED IN CONNECTION WITH CONDITIONAL USE PERMIT N0. 3647, IN PART (Tracking number Conditional Use Permit No. PC2000-0212) WHEREAS, on December 1, 1993, Resolution No. PC93-131 was adopted by the Anaheim City Planning Commission to grant Conditional Use Permit 3647 and permit an expansion to an existing child day care facility and private elementary school with waiver of minimum number of parking spaces (deleted); and WHEREAS, this property is developed with a child day care facility and private elementary school and is zoned CO(SC) (Gommercial, Office and Professional-Scenic Corridor Overlay). The Anaheim General Plan Land Use Eler~ent Map designates this property for General Commercial land uses. WHEREAS, the petitioner has requested an amendment to this conditional use permit under authority of Code Section No. 18.41.050.060 and 18.41.050.150 to permit the expansion to an existing child day care facility and private elementary school with waiver of the following: SECTION NOS. 18.06.050.0264 Minimum number of arkin s aces. 18.06.050.0267 (DELETED) AN D 18.41.067 WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 5, 2000, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with Che provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed expanded use is properly one for which a conditional use permit is authorized by the Zoning Code, or that said use is not listed therein as being a permitted use; 2. That the proposed expanded use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located; 3. That the size and shape of the site for the proposed expanded use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare; 4. That the traffic generated by the proposed expanded use will not impose an undue burden upon the streets and highways designed arnd improved to carry the traffic in the area; and 5. That the granting of the expanded conditional use permit under the conditions imposed, will not be detrimental to the peace, health, saf~ty and general welfare of the citizens of the City of Anaheim. 6. That no one indicated their presence at said public hearing in opposition; and one person spoke with concerns; and that no correspondence was received in opposition to the subject petition. CR3986PK.doc -1- PC2000-78 • • CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to expand an existing child day care facility and private elementary school with waiver of minimum number of parking spaces (deleted waiver) on an irregularly- shaped, 1.42-acre property located at the northwest corner of Monte Vista Road and Old Springs Road, having frontages of 273 feet on the north side of Monte Vista Road and 241 feet on the west side of Old Springs Road (191 South Old Springs Road - Hillsborough School); and does hereby find that Negative Declaration serves as the required environmental documentation in connection with this request upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Conditional Use Permit No. 2000-04214, in part, (waiver deleted) upon the following conditions which are hereby faund to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: BE IT FURTHER RESOLVED that the Planning Commission does hereby approve, in part, (waiver deleted) tracking number Conditional Use Permit No. 2000-04214,. modifying Resolution No. PC93-131 adopted in connection with Master Conditional Use Permit No. 3647 in its entirety, with the following conditions of approval: That the owner of subject property shall submit a letter requesting termination of Conditional Use Permit No. 3861 {to permit a temporary modular building in conjunction with an existing child day care facility and private elementary school with waiver of minimum structural setback from a hillside secondary arterial highway) to the Zoning Division. 2. That any existing trees which are removed shall be replaced on a two-to-one (2:1) ratio with minimum twenty four (24) inch box trees. 3. That the wrought iron fence with stucco pilasters shall be maintained adjacent to Monte Vista Road and Old Springs Road. 4. That the enrollment of subject facility Shall be limited to a maximum of two hundred (200) students (infants through 6th grade). 5. That plans shall be submitted to the City Traffic and Transportation Manager for his review and approval showing conformance with the latest revisions of Engineering Standard Plan Nos. 436 and 602 pertaining to parking standards and driveway locations. Said information shall be specifically shown on plans submitted for building permits. Subject property shall thereupon be developed and maintained in conformance with said plans. 6. That the driveway on Old Springs Road shall be maintained with ten (10) foot radius curb returns as required by the City Engineer in conformance with Engineering Standards. 7. That trash storage areas shall be maintained in a location acceptable to the Department of Maintenance and in accordance with approved plans on file with said Department. 8. That an on-site trash truck turn-around area shall be maintained to the satisfaction of the Department of Maintenance. 9. That a sign shall be posted in the drop-off zone prohibiting parking for the picking-up of students and that the picking-up of students shall be staggered throughout the day to prevent parking and circulation problems. CR3986PK.doc -2- PC2000-78 • • 10. That signage shall be limited to legally permitted and approved signs existing on the date of this resolution. Requests for any additional code-permitted signage shall be reviewed and approved by the Planning Commission as a Reports and Recommendation item. 11. That a landscape plan shall be submitted to the Planning Commission as a Reports and Recommendations item for relandscaping of the area previously occupied by the temporary building. 12. That no roof-mounted equipment shall' be permitted in conjunction with this request. 13. That subject property shall be developed and maintained substantially in accordance with plans and specifications submitted to the City of ~4naheim by the petitioner and which plans are on file with the Planning Department marked Revision No. 1 of Exhibit Nos. 1 and 2 and Exhibit Nos. 3 through 6 (Master CUP No. 3647) and marked Exhibit No. 1(CUP No. 2000-04214). 14. That prior to issuance of a building permit of within a period of one (1) year from the date of this resolution, whichever occurs first, Condition Nos. 1, 5 and 11 above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 15. That prior to final building and zoning onspections, Condition Nos. 2 and 9 above-mentioned, shall be complied with. 16. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement.
