WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center
in the City of Anaheim on August 14, 2000, at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed variance and to investigate and make
findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the petitioner proposes waivers of the following to construct a 16-foot high corner
monument sign in an existing commercial center:

2. That the proposed monument sign will be located at the southeast corner of the
intersection of Lincoln Avenue and State College Boulevard in the commercial center named "Anaheim
Town Square."
3. That waivers (a) and (c), m~aximum area of signs and maximum height of freestanding
signs, are denied on the basis that said waivers were mistakenly advertised; and that waiver (e),
minimum sight distance, is denied on the basis that said waiver was deleted following public notification of
this variance.

4. That waivers (b) and (d), minimum distance between signs and maximum sign width, are
hereby granted on the basis that there are special and unique circumstances applicable to the property
consisting of its size, location and surroundnngs, which do not apply to other identically zoned properties
in the vicinity, because the underlying properry has frontages on five streets and is very large with signs
being placed on the two street frontages that are the most visible and accessible to the public and will
meet the advertising needs of a commercial center as large as subject property.
5. That strict application of the Zoning Code deprives the property of privileges enjoyed by
other properties under identical zoning classification in the vicinity.
6. That there are exceptional or extraordinary circumstances or conditions applicable to the
property involved or to the intended use of the property that do not apply generally to the property or class
of use in the same vicinity and zone.
7. That the requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone, and denied to the
prop~rty in question.
8. That the requested varianc~e will not be materially detrimental to the public welfare or
injurious to the property or improvements in such vicinity and zone in which the property is located
because the proposed sign will, in effect, replace an abandoned sign ("Capri Coffee Shop") that is
scheduled for demolition.
9. That no one indicated their presence at said public hearing in opposition; and that no
correspondence was received in opposition~ to subject petition.
CALIFORNIA ENVIRONM~NTAL QUALITY ACT FINDING: The Planning Director or his
authorized representative has determined that the proposed project falls within the definition of
Categorical Exemptions, Class 11, as defined in the State of California Environmental Impact Report
(EIR) Guidelines and is, therefore, categorically exempt from the requirement to prepare an EIR.
NOW, THEREFORE, BE Irt RESOLVED that the Anaheim City Planning Commission
does hereby grant subject Petition for Variance, in part, upon the following conditions virhich are hereby
found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the
safety and general welfare of the Citizens of the City of Anaheim:
1. That a revised sign plan shall be submitted to the Zoning Division for review and approval,
showing modification to the top of th~~e finro side panels to incorporate variation which is
complementary to the central sign panel.
2. That the proposed sign shall be developed with the numeric street address at the base in
minimum nine (9) inch high letters; and that the sign shall be located in a landscaped planter, the
area of which is no smaller than one-half (0.5) the total sign area of said sign, in compliance with
Code requirements (subsection 18.05.076. 020). Said information shall be specifically shown on
plans submitted for building permits.
3. That the sign shall be maintained in "like-new" condition and shall be free from graffiti at all times.
4. That the owner of subject property shall submit a letter to the Zoning Division requesting
termination of Conditional Use Permit No. 913 (to permit on-sale liquor in a proposed restaurant),
Conditional Use Permit No. 2596 (to permit on-sale alcohol in a proposed restaurant with waiver of
minimum number of parking spaces) and Conditional Use Permit No. 2318 (to permit on-sale of
alcoholic beverages in a proposed restaurant).
5. That the developer shall submit a plan to the Public Works Department, Development Services
Division, for review and approval. Tihe plan shall include the current and future rights-of-way along
State College Boulevard and Lincoln Avenue, as shown on the State College Boulevard Corridor

Master Plan, and the location of all freestanding signs in relation to the said future rights-of-way
line. All signs shall be located outside the future rights-of-way.
6. That subject property shall be developed substantially in accordance with plans and specifications
submitted to the City of Anaheim by the petitioner and which plans are on file with the Planning
Department marked Exhibit Nos. 1, 2, 3 and 4, and as conditioned herein.
7. That prior to issuance of a building permit for the sign or within a period of one (1) year from the
date of this resolution, whichever occurs first, Condition Nos. 1, 2, 4 and 5, above-mentioned, shall
be complied with. Extensions for further time to complete said conditions may be granted in
accordance with Section 18.03.090 of the Anaheim Municipal Code.
That prior to final building and zoning inspections, Condition No. 6, above-mentioned, shall be
complied with.
That approval of this application constitutes approval of the proposed request only to the extent
that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and
Federal regulations. Approval does not include any action or findings as to compliance or

BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance
with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof,
be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this
Resolution, and any approvals herein contained, shall be deemed null and void.
