RESOLUTION NO. PC2001-108
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS lN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 3423, CONDITIONAL USE PERMIT NO. 4096,
RECLASSIFICATION NO. 98-99-10, AND TENTATIVE PARCEL MAP NO. 98-234
WHEREAS, on August 20, 1991, the City Council adopted Resolution No. 91R-260 to
grant Conditional Use Permit No. 3423 permitting a commercial retail center with building heights in
excess of 35 feet, a service station and a freestanding drive-through restaurant, and with waivers of
minimum landscaped setback, minimum structural setback, maximum wall height and minimum number
of required parking spaces on property located at 8200 East La Palma Avenue; and that the entitled
commercial retail center was never constructed; and
WHEREAS, on June 15, 1999, the City Council took the following actions regarding the
16.3-acre site at 8200 East La Palma Avenue: adopted Resolution No. 99R-128 to approve
Reclassification No. 98-99-10 to rezone the property from the RS-A-43,000(SC) "Residential/Agricultural
- Scenic Corridor Overlay" and CL(SC) "Commercial, Limited - Scenic Corridor Overlay" zones to the
CO(SC) "Commercial, Office and Professional - Scenic Corridor Overlay" zone; adopted Resolution No.
99R-129 to grant Conditional Use Permit No. 3423 and permit a planned commercial office/light industrial
center with roof-mounted equipment, with a semi-enclosed restaurant having sale of alcoholic beverages
for on-premises consumption, with building heights in excess of 35 feet, and with waivers of minimum
parking lot landscaping and minimum area per lot; and approved Tentative Parcel Map No. 98-234 to
es#ablish a 13-1ot commercial subd.ivisioa; and that the entitled ~ommercial/light indus~Fia4 centeF was
never constructed; and
WHEREAS, the subject property is undeveloped; that the zoning is RS-A-43,000(SC)
"Residential/Agricultural - Scenic Corridor Overlay" and CL(SC) "Commercial, Limited - Scenic Corridor
Overlay"; that the General Plan Land Use designation is Hillside Low-Medium Density Residential; and
that the property is located within the River Valley Redevelopment Project Area; and
WHEREAS, on October 10, 2000, the City Council adopted Resolution No. 2000R-219 to
approve Reclassification No. 2000-00029 to rezone #he property from the RS-A-43,000(SC)
"Residential/Agricultural - Scenic Corridor Overlay" and CL(SC) "Commercial, Limited - Scenic Corridor
Overlay" zones to the RS-5000(SC) "Residential, Single Family - Scenic Corridor Overlay" zone; and
that Condition No. 3 of said resolution specifies that the property owner request termination of Conditional
Use Permit Nos. 3423 and 4096, Reclassification No. 98-99-10 and Tentative Parcel Map No. 98-234;
and
WHEREAS, Cherryl Thompson, Project Manager, representing the D.R. Horton Los
Angeles Holding Company, Inc., has requested termination of Conditional Use Permit Nos. 3423 and
4096, Reclassification No. 98-99-10 and Tentative Parcel Map No. 98-234, to comply with Condition No.
3 of the aforementioned Resolution No. 2000R-219.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby terminate all proceedings in connection with Conditional Use Permit No. 3423, Conditional
Use Permit No. 4096, Reclassification No. 98-99-10 and Tentative Parcel Map No. 98-234 on the basis of
the foregoing findings.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
August 13, 2001. ~
