Resolution-PC 2001-173• • RESOLUTION NO. PC2001-173 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION RECOMMENDING ADOPTION OF AMENDMENT NO. 4 TO THE ANAHEIM HILLS FESTIVAL SPECIFIC PLAN NO. SP 90-1 (Chapter 18.74 "SP 90-1 Zoning and Development Standards") WHEREAS, on March 27, 1990, the Anaheim City Council adopted Ordinance No. 5109 to establish Zoning and Development Standards for The Anaheim Hills Festival Specific Plan No. 90-1 (Chapter 18.74 of the Anaheim Municipal Code); and that The Anaheim Hills Festival development proposal consisted of approximately 533,950 sq.ft. of retail space, a 4,000 sq.ft. service station, a 33,000 sq.ft. theater, a 150-room hotel with a 7,500 sq.ft. freestanding restaurant, and a 240,000 sq.ft. business commercial area within four Development Areas on 85 acres located at the southwest corner of Santa Ana Canyon Road and Roosevelt Road in the Scenic Corridor Zone Overlay; and WHEREAS, on March 27, 1990, the City Council adopted Ordinance No. 5110 to reclassify the 85-acre project site to the Specific Plan No. 90-1, Anaheim Hills Festival, Zone subject to certain conditions of approval; and WHEREAS, on July 28, 1992, the City Council adopted Ordinance No. 5324 amending Conditions of Approval Nos. 6 and 13 set forth in Ordinance No. 5110 pe~taining to traffic signals and street improvements at the most westerly access on Santa Ana Canyon Road, at Roosevelt Road and Monte Vista Road, and on Festival Drive (Amendment No. 1); and WHEREAS, on July 22, 1997, the City Council adopted Ordinance No. 5603 to amend Ordinance No. 5110, as amended, and approve Amendment No. 2 to The Anaheim Hills Festival Specific plan N~,, g~-1 ~~r#~in~na to Development Area 2(Retail Commercial and Entertainment) to (1) expand the existing theater (up to 25,000 sq.ft. or 1,500 seats), (2) revise the site plan to redesignate 20,000 sq.ft. of area from "home improvement furnishings" to "general retail" uses, (3) construct a 35,000 sq.ft. health club and a 10,000 sq.ft. child day care center facility with a 15,000 sq.ft. outdoor play area, and (4) amend Condition No. 9 of Ordinance No. 5110 to permit on-street parking along Festival Drive; and WHEREAS, on August 18, 1998, the City Council adopted Ordinance No. 5645 to approve Amendment No. 3 to the Specific Plan Zoning and Development Standards to add subparagraph 2 to paragraph (b) "Conditional Uses" of subsection .060 "Development Area 4- Business Commercial Area" of Section 18.74.040 "Development Standards" of Chapter 18.74 to permit development of senior citizens' apartments in said Development Area 4 in connection with a conditional use permit (18.74.040.060(b)2(i) through (vii)); and WHEREAS, on August 24, 1999, the City Council adopted Ordinance No. 5697 to approve Specific Plan Adjustment No. 1 to amend Ordinance No. 5109, as previously amended, to amend clause (a) "One Vertical Sign" of subparagraph 5"Theater Marquee" of paragraph (d) "Permitted Signs" of subsection .080 "Sign Regulations" of Section 18.74.040 "Development Standards" of Chapter 18.74 of the Anaheim Municipal Zoning Code to permit two Theater Marquee wall signs (18.74.040.080(d)5(a)); and WHEREAS, the property is developed with The Anaheim Hills Festival proJect in the SP90-1(SC) "The Anaheim Hills Festival Specific Plan - Scenic Corridor Overlay" zone; and WHEREAS, pursuant to the procedures set forth in Chapter 18.93 of the Anaheim Municipal Code, the petitioner proposes to amend the Zoning and Development Standards for Development Area 1(Scenic Commercial) to allow additional signage for in-line tenant units that back CR5263P K.doc -1- PC2001-4 73 ~ • onto Santa Ana Canyon Road; that the current Anaheim Hills Festival Sign Regulations (subsection 18.74.040.080 of the Zoning Code) allow secondary signage for corner tenants only, not to exceed one- half the size of the primary sign; and that the proposed secondary signs for smaller in-line tenants will provide limited exposure for businesses that currently have no visible identity to Santa Ana Canyon Road; and, furthermore, that such amendment would provide equity between in-line and corner tenants and would be limited to retail shops (currently five tenant units back onto Santa Ana Canyon Road); and WHEREAS, proposed Amendment No. 4 to the Festival Specific Plan 92-1 encompasses the sign regulations contained in subsection 18.74.040.080 of Chapter 18.74, and would allow an additional wall sign for each in-line tenant unit that backs onto Santa Ana Canyon Road (currently 1 wall sign per tenant permitted, and two wall signs are proposed); and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on December 17, 2001, at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed amendment and to investigate and make findings and recommendations in connection therewith; and that the hearing was continued from the December 3, 2001 Planning Commission meeting; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That this property has unique site characteristics such as topography, location and surroundings whieh are eFlhanced by special 4a~d-~se and dev~lopme~t standards, and-the prapos~d amendment to the Sign Regulations will allow signage consistent with these existing characteristics. 2. That the qroposed amendment will result in development of desirable character which will be compatible with existing and proposed development and the surrounding neighborhood. 3. That the proposed amendment contributes to a balance of land uses and equitable allowance of signage for all retail tenants within the shopping center. 4. That the proposed amendment respects environmental and aesthetic resources consistent with economic realties. 5. That no one indicated their presence at the public hearing in opposition to the proposal; that no correspondence was received in opposition; and that one person representing the Concerned Citizens of the Canyon spoke and requested that the public hearing be continued. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal to amend Chapter 18.74 of the Anaheim Municipal Code (The Anaheim Hills Festival Specific Plan No. 90-1 Zoning and Development Standards) to permit a secondary wall sign for the retail tenant units in Development Area 1 that back onto Santa Ana Canyon Road on an 85-acre irregularly-shaped property located at the southwest corner of Santa Ana Canyon Road and Roosevelt Road, having frontages of 2,170 feet on the south side of Santa Ana Canyon Road and 850 feet on the west side of Roosevelt Road, and further described as 8182 East Santa Ana Canyon Road (Anaheim Hills Festival Shopping Center); and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. -2- PC2001-173 • • NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the Anaheim City Planning Commission does hereby recommend that the City Council, by ordinance, adopt Amendment No. 4 to the Anaheim Hills Festival Specific Plan (SP90-1) to amend clause (a) of subparagraph 4"In-Line Shop Buildings" of paragraph (d) "Permitted Signs" of subsection .080 "Sign Regulations" of Section 18.74.040 "Development Standards" of Chapter 18.74 of Title 18 of the Anaheim Municipal Code (18.74.040.080(d)4(a)) to read as follows: (a) One (1) Primary Wall Sign per store shall be permitted with a maximum letter height of thirty (30) inches. If finro (2) rows of letters are required, the maximum letter height shall be finrelve (12) inches per row, with the total height not to exceed thirty (30) inches. In no case shall the Primary Sign width be greater than thirty (30) feet nor the total sign area exceed twenty percent (20%) of the storefront footage. In addition to the foregoing, one (1) Secondary Wall Sign (facing Santa Ana Canyon Road) per store shall be permitted, subject to the foregoing maximum letter height requirements, and subject to the following additional requirements: (1) In no case shall the Secondary Wall Sign width be greater than one half (0.5) of the width of the tenant space not to exceed fifteen (15) feet, nor shall the total sign area exceed ten percent (10%) of the storefront footage. (2) Each sign shall be limited to the same sign verbiage and logo as displayed an-the Primary Sign. Logos shall_be calculated in the total sign area. (3) Both the Primary and Secondary Signs shall be channel letters, flush mounted with no exposed raceways, and consistent in design, color, illumination and text.
