RESOLUTION NO. PC2001-83
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 2988 AND CONDITIONAL USE PERMIT NO. 3749
WHEREAS, on March 14, 1988 the Planning Commission adopted Resolution No. PC88-
75 to grant Conditional Use Permit No. 2988 and permit expansion to an existing auto sales and service
facility (Mercedes-Benz dealership) to include a car wash/auto preparation area, storage garage and
employee parking lot on property located at 5395 East La Palma Avenue; and
WHEREAS, on March 20, 1995 the Planning Commission adopted Resolution No. PC95-
33 to grant Conditional Use Permit No. 3749 and permit a business office in the ML "Limited Industrial"
zone at 1400 North Brasher Street; and
WHEREAS, on January 17, 2001, Planning Commission adopted Resolution No.
PC2001-6 to grant Conditional Use Permit No. 2001-04272, in part, to permit expansion of an existing
automotive dealership with waivers of maximum floor area ratio and permitted encroachments into
required yards (waivers of maximum number of monument signs and minimum distance between
monument signs were denied) on property located at 1370-1400 North Brasher Street, and 5375 and
5401 East La Palma Avenue; and that Condition No. 23 of said resolution specifies that the property
owner submit a letter requesting termination of Conditional Use Permit Nos. 2988 and 3749; and
WHER~AS, this pr_operty is developed with an automobile dealership (~aliber Motors
Inc.) in Development Area 2(Expanded Industrial Area) of the Northeast Area Specific Plan No. SP94-1;
that the Anaheim General Plan Land Use Element designates this site for General Industrial land uses;
and that the properry is located within the Project Alpha Redevelopment Area (Northeast Area); and
WHEREAS, Don Bering, representing the property owner, has requested termination of
Conditional Use Permit Nos. 2988 and 3749 to comply with the conditions of approval of Conditional Use
Permit No. 2001-04272.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission.
does hereby terminate all proceedings in connection with Conditional Use Permit No. 2988 and
Conditional Use Permit No. 3749 on the basis of the foregoing findings.
