A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
AMENDING RESOLUTION NO. PC96-119, ADOPTED IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 3880
WHEREAS, on November 25, 1996, the Anaheim City Planning Commission did, by its
Resolution No. PC96-119, grant Conditional Use Permit No. 3880, in part, to construct a 2-story, 12,000
sq.ft. classroom addition in conjunction with the remodel of a 2-story, 38,476 sq.ft. classroom building at
an existing private educational facility (Servite High School) with waivers of (a) maximum structural height
and (b) minimum number of parking spaces; and that waiver (a) was granted in part to require a
minimum 29-foot setback along the west property line; and
WHEREAS, the petitioner proposes to expand the existing private high school by
constructing a faculty parking lot on two adjoining RS-7200 (Residential, Single-Family) zoned lots with
waiver of minimum front yard landscaped setback; and
WHEREAS, the project site consists of three parcels: Servite High School af 1952 West
La Palma Avenue is located on property zoned RS-A-43,000 (Residential/Agricultural), and two
residential lots zoned RS-7200 are located at 1957 Dogwood Avenue (one of the single-family residences
has been demolished and the other will be demolished); and that the Land Use Element of the Anaheim
General Plan designates the private high school property as a"Parochial School Site" and the single-
family residential lots for "Low Density Residential" land uses; and
WHEREAS, t_he Cit~r Planning Commission did hold a public hearing at the Civic Center
in the City of Anaheim on September 9, 2002 at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed conditional use permit and to
investigate and make findings and recommendations in connection therewith; and that said public hearing
was continued to the September 23, 2002 Planning Commission meeting; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposed amendment is properly one for which a conditional use permit is
authorized by Anaheim Municipal Code Section 18.26.050.040, to wit: to expand an existing private high
school by constructing a faculry parking lot on two adjoining RS-7200 (Residential, Single-Family) zoned
lots with waiver of the following:
Section 18.26.063.010 - Minimum front vard landscaped setback.
(25 feet required from a street in the RS-7200 zone;
18-feet proposed along Dogwood Avenue)
2. That the proposed faculty parking lot, as conditioned herein, will not adversely affect the
adjoining land uses and the growth and development of the area in which it is proposed to be located.
3. That the size and shape of the site for the proposed faculty parking lot is adequate to
allow full development of said use in a manner not detrimental to the particular area nor to the peace,
health, safety and general welfare.
4. That the traffic generated by the faculty parking lot, as conditioned herein, will not impose
an undue burden upon the streets and highways designed and improved to carry the traffic in the area
and, further, that the parking lot will remove vehicles currently parking within the surrounding residential
neighborhood and relocate the vehicles onto the high school campus grounds.

5. That amending Conditional Use Permit No. 3880, as proposed and under the conditions
imposed, will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of
Anaheim.
6. That no one indicated their presence at the public hearing in opposition to the proposal;
and that no correspondence was received in opposition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to construct a faculty parking lot on an irregularly-
shaped 15.4-acre property having frontages of 650 feet on the south side of La Palma Avenue, 1,000 feet
on the west side of Wichita Street and 137 feet on the north side of Dogwood Avenue, being located 515
feet west of the centerline of Onondaga Avenue, and further described as 1952 West La Palma Avenue
and 1957 Dogwood Avenue (Servite High School); and does hereby approve the Negative Declaration
upon finding that the declaration reflects the independent judgment of the lead agency and that it has
considered the Negative Declaration together with any comments received during the public review
process and further finding on the basis of the initial study and any comments received that there is no
substantial evidence that the project will have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby amend Conditional Use Permit No. 3880, adopted in connection with Resolution No. PC96-
119, to expand an existing private high school by constructing a faculty parking lot with waiver of
minimum front yard landscaped setback; and
AND BE IT FURTHER RESOLVED that the legal description for the subject property is
hereby amended to read as follows:
THE WEST HALF OF THE NORTHWEST QUARTER OF THE N6RTHEAST
QUARTER OF SECTION 8, TOWNSHIP 4 SOUTH, RANGE 10 WEST, S.B.B. & M.,
EXCEPT THE SOUTH 263 FEET THEREOF, IN THE CITY OF ANAHEIM, COUNTY
OF ORANGE, STATE OF CALIFORNIA.

LOT NOS. 103 AND 104 OF TRACT NO. 1803 AS PER MAP RECORDED IN BOOK
56, PAGES 45, 46 AND 47 INCLUSIVE OF MISCELLANEOUS MAPS, IN THE
OFFICE OF THE RECORDER OF SAID COUNTY.
AND BE IT FURTHER RESOLVED that the conditions of approval be amended, in their
entirety, to read as follows:
1. That the existing Italian Cypress trees along the west property line (except adjacent to the faculty
parking lot) shall be retained and supplemented with the planting of additional twenty four (24) inch box
sized trees wherever possible. The trees shall be permanently irrigated and maintained and promptly
replaced in the event that they become damaged, diseased or die. Said information shall be
specifically shown on plans submitted for Zoning Division approval.
2. That the maximum enrollment of this school shall be eight hundred fifty (850) students.
3. That the developer shall submit a water quality management plan ("WQMP°) specifically identifying
the best management practices that will be used on-site to control predictable pollutants from storm
water runoff from the faculty parking lot. The WQMP shall be submitted to the Public Works
Department, Development Services Division, for review and approval.
4. That the property owner shall submit a letter to the Zoning Division requesting termination of
Conditional Use Permit No. 3745 (permitting temporary modular classrooms in conjunction with an
existing educational facility).
5. That plans shall be submitted to the City Traffic and Transportation Manager for review and approval
showing conformance with the current versions of Engineering Standard Plan Nos. 436 and 602
pertaining to parking standards and driveway location. Subject property shall thereupon be developed
and maintained in conformance with said plans.

6. That all air conditioning facilities and other roof and ground mounted equipment shall be properiy
shielded from view and sound buffered from adjacent residential properties.
7. That any lighting fixtures located adjacent to the residential properties to the west shall be down-lighted
with a maximum height of twelve (12) feet. Said lighting fixtures shall be directed away from adjacent
residential property lines to protect the residential integrity of the area, and said specifications shall be
shown on the plans submitted for building permits.
8. That any tree planted on-site shall be replaced in a timely manner in the event that it is removed,
damaged, diseased and/or dies.
9. That the windows on the west elevation of the new 2-story building shall be maintained as clerestory
only, as shown on Exhibit No. 2,which was submitted by the petitioner and approved by the Planning
Commission.
10. That a plan shall be submitted to the Traffic and Transportation Manager for review and approval
showing the redesign of Dogwood Avenue for one-way egress only. Servite Private School shall be
responsible for maintenance of this modified access.
11. That the owner of subject property shall be responsible for the removal of any on-site graffiti within
finrenty four (24) hours of its application.
12. That subject property shall be developed substantially in accordance with plans and specifications
- s~br~i~ted to tk~e-City of Anaheim by the_petitioner and which plans are on file with the Planning
Department marked Revision No. 1 of Exhibit No. 1 and Exhibit Nos. 1(a) through 3.
13. That the faculty parking lot shall be enclosed with a decorative wrought iron fence, including gates
across the driveway facing Dogwood Avenue. Furthermore, the existing driveway from Dogwood
Avenue to the private high school campus shall be secured by a decorative gate to limit access from
the residential neighborhood. The location of the gate(s) shall be subject to review and approval by
the Traffic and Transportation Manager. Said information shall be specifically shown on plans
submitted for Zoning Division and Traffic Engineering Division approval.
14. That the faculty parking lot shall be restricted to faculry and staff only; and that no students shall use
this parking lot. The normal hours of use shall be 6:30 a.m. to 5 p.m.; and, further, that the faculty
parking lot may be used for school-oriented special events, not to exceed twenty (20) events per
year.
15. That a six (6) foot high masonry block wali shall be constructed and maintained along the north and
west property lines of the faculty parking lot, excepting the front setback (18 feet) along Dogwood
Avenue where the wall height shall not exceed three (3) feet; provided, however, that the City Traffic
and Transportation Manager shall have the authority to reduce the height of the wall to protect visual
lines-of-sight where pedestrian and/or vehicular circulation intersect. Clinging vines to eliminate graffiti
opportunities shall be planted on maximum five (5) foot centers, and irrigated and maintained, adjacent
to said wall. Said information shall be specifically shown on the plans submitted for building permits.
16. That a landscaping and irrigation plan for the faculty parking lot shall be submitted to the Zoning
Division for review and approval, including that minimum twenry four (24) inch box sized trees shall be
installed and maintained along the north, south and west property lines. Any decision made by the
Zoning Division regarding said plan may be appealed to the Planning Commission and/or City Council.
17. That signage for subject facility shall be limited to that shown on the exhibits on file with the City of
Anaheim under Conditional Use Permit No. 4154. Any additional signage shall be subject to approval
by the Planning Commission as a"Reports and Recommendations" item.

18. That there shall be no "cross-scheduling" between the theater and the gymnasium (i.e., no concurcent
events).
19. That parking arrangements shall be made with the City of Anaheim Traffic and Transportation Manager
to allow parking on La Palma Avenue for special events and/or that parking shall be provided on-site,
on the track field.
20. That trash storage area(s) shall be refurbished (including painting the trash enclosure doors) to the
satisfaction of the Public Works Department, Streets and Sanitation Division, to comply with approved
plans on file with said Department. Further, trash bins shall be stored inside the enclosure(s) out of the
public's view.
21. That the private high school administration shall establish a traffic management plan acceptable to the
Traffic and Transportation Manager to address student loading/unloading activities and other traffic
circulation issues for the intersection of Dogwood Avenue and Keystone Street.
22. Condition No. 22 was intentionally de/eted at the Sepfember 23, 2002 P/anning Commission public
hearing.
23. That prior to issuance of a building permit, or prior to commencement of the activity authorized by this
resolution, or within a period of one (1) year from the date of this resolution, whichever occurs first,
Condition Nos. 1, 3, 4, 5, 7, 10, 13, 15, 16 and 21, above-mentioned, shall be complied with.
Extensions for fu~ther time to complete said conditions may be granted in accordance with Section
18.03.090 of the Anaheim Municipal Code.
24. That prior to final building and zoning inspections or prior to commencement of activity authorized by
this resolution, whichever occurs first, Condition Nos. 12 and 20, above-mentioned, shall be complied
with.
25. That approval of this application constitutes approval of the proposed request only to the extent that it
complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal
regulations. Approval does not include any action or findings as to compliance or approval of the
request regarding any other applicable ordinance, regulation or requirement.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby
find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance
with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof,
be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this
Resolution, and any approvals herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
September 23, 2002.
