A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS IN CONNECTION WITH
CONDITIONAL USE PERMIT NOS. 1066, 2834, 3189, 3496, 3704 AND 3870,
AND VARIANCE NOS. 508 AND 2788
WHEREAS, on October 21, 1968, the Anaheim Planning Commission, by its Resolution
No. PC68-314, granted Conditional Use Permit No. 1066 to permit on-sale alcoholic beverages in
conjunction with a restaurant under construction at 940 South Brookhurst Street; and that this restaurant
no longer exists; and
WHEREAS, on October 28, 1986, the Anaheim City Council, by its Resolution No. 86R-
488, granted Conditional Use Permit No. 2834, in part, to permit a foodmart in conjunction with self-serve
gasoline sales, with waiver of minimum structural setback at 956 South Brookhurst Street (off-sale beer
and wine at the foodmart were denied); and that use this use no longer exists; and
WHEREAS, on October 17, 1989, the City Council, by its Resolution No. 89R-411,
granted Conditional Use Permit No. 3189 to permit a 5,040 square foot commercial center with a
maximum of four units at 944 South Brookhurst Street; and that this use no longer exists; and
WHEREAS, on April 28, 1992, the City Council, by its Resolution No. 92R-92, granted
Conditional Use Permit No. 3496 to retain and expand a convenience market at 944 South Brookhurst
Street; and. that t.h.is. u.s.e no longer exists; and _____
WHEREAS, on August 8, 1994, the Planning Commission, by its Resolution No. PC94-
106, granted Conditional Use Permit No. 3704, in part, to remodel an automobile service station and to
construct a car wash facility at 956 South Brookhurst Street (waivers of minimum distance between
service stations, maximum self-service sign area and minimum landscaping at street frontages were
denied); and that this use no longer exists; and
WHEREAS, on September 16, 1996, the Planning Commission, by its Resolution No.
PC96-96, granted Conditional Use Permit No. 3870 to construct a 1,126 square foot service station with a
1,000 square foot convenience market at 956 South Brookhurst Street; and that the service station and
convenience were never constructed; and
WHEREAS, on March 5, 1956, the Planning Commission, by its Resolution No. 142,
Series 1955-56, granted Variance No. 508 to permit a service station at the northeast corner of Ball Road
and Brookhurs# Street; and that this use no longer exists; and
iNHEREAS, on fVlay 11, 1976, the City Councii, by its Resofution ~Io. 76R-244, granted
Variance No. 2788 for waiver of permitted uses to permit an unlawfully established photo kiosk on a
service station site at 956 South Brookhurst Street; and that this use no longer exists; and
WHEREAS, on December 20, 1999, the Planning Commission, by its Resolution No.
PC99-228, granted Variance No. 4383 to demolish a restaurant and commercia! retail center to construct
a drive-through pharmacy with waivers of minimum number of parking spaces and minimum setback
abutting a residential zone at 940-956 South Brookhurst Street; and that Condition No. 27 of said
resolution specifies that the property owner shall submit a letter to the Zoning Division requesting
termination of Conditional Use Permit Nos. 1066, 2834, 3189, 3496, 3704, and 3870, and Variance Nos.
508 and 2788 because said entitlements are no longer needed; and

WHEREAS, Everett H. Miller, Jr., property owner, has submitted a letter requesting
termination of Conditionai Use Permit Nos. 1066, 2834, 3189, 3496, 3704, and 3870, and Variance Nos.
508 and 2788 to comply with said Condition No. 27.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby terminate all proceedings in connection with Conditional Use Permit Nos. 1066, 2834, 3189,
3496, 3704, and 3870, and Variance Nos. 508 and 2788 on the basis of the foregoing findings.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
June 17, 2002.
