A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 2003-00106 (STUDY AREA 2) BE GRANTED,
UNCONDITIONALLY
WHEREAS, on May 5, 2003, the Anaheim City Planning Commission did direct staff to
initiate petitions for Reclassification of certain areas within the Anaheim Colony Historic District, including
subject properties, from multiple-family residential zoning to single-family residential zoning; and that
subject properties total approximately 5.72 acres situated in the City of Anaheim, County of Orange, State
of California, described as follows:
LOTS 16 THROUGH 30 IN BLOCK 'A' AND LOTS 1 THROUGH 30 IN BLOCK `B' OF
TRACT NO. 217 (NUT GROVE TRACT), M.M.-13, RECORDED IN THE OFFICE OF
THE ORANGE COUNTY RECORDER.
W HEREAS, the above-described real properties, which are addressed at 507, 511, 515,
519, 523, 527, 531, 535, 539, 543, 549, 551, 555 and 559 South Resh Street, and 502, 506, 510, 514,
518, 522, 526, 530, 534, 540, 544, 548, 550, 556 and 558 South Resh Street, and 612 and 706 West
Santa Ana Street, and 507, 511, 515, 519, 523, 527, 531, 535, 539, 543, 549, 553, 555 and 559 South
Janss Street, are illustrated on the Location Map (labeled 'Study Area 2') attached to the Staff Report to
the Planning Commission dated June 30, 2003, Item No. 11; and
1NHER~A~, th~ City Planning Commission did hold. a. public hearing_ at the Civic Center
in the City of Anaheim on June 30, 2003 at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed reclassification and to investigate
and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
1. That the proposal is for reclassification of Study Area 2 from the RM-2400 (Residential,
Multiple Family) Zone to the RS-5000 (Residential, Single-Family) or a less intense zone.
2. That the Anaheim General Plan designates subject properties for Low Medium Density
Residential land uses.
3. That the subject properties are located within the Anaheim Colony Historic District, which
District is bounded by North, East, South and West Streets; and that the proposed reclassification of
subject properties is necessary and/or desirable for the orderly and proper development of the
community.
4. That the proposed reclassification of subject properties does properly relate to the zones
and their permitted uses locally established in close proximity to subject property and to the zones and
their permitted uses generally established throughout the community.
5. That one person spoke at the public hearing in opposition to the proposal; and that no
correspondence was received in opposition.
6. That seven people indicated their presence at the public hearing in favor of the proposal.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City.
Planning Commission has reviewed the proposal to reclassify an area consisting of forty five lots totaling
5.72 acres and located between Santa Ana Street and Water Street on the west side of Janss Street, and
the east and west sides of Resh Street, and bounded on the west by a public alley located approximately
139 feet west of the centerline of Resh Street, from the RM-2400 (Residential, Multiple Family) Zone to
the RS-5000 (Residential, Single-Family) or a less intense zone, and further described as 507- 559 South
Resh Street, 502- 558 South Resh Street, 612 and 706 West Santa Ana Street, and 507- 559 South
Janss Street; and does hereby approve the Negative Declaration upon finding that the declaration
reflects the independent judgment of the lead agency and that it has considered the Negative Declaration
together with any comments received during the public review process and further finding on the basis of
the initial study and any comments received that there is no substantial evidence that the project will have
a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning
Map of the Anaheim Municipal Code to exclude the above-described properties (Study Area 2) from the
RM-2400 (Residential, Multiple Family) Zone and to incorporate said described properties into the RS-
5000 (Residential, Single-Family) Zone, unconditionally.
BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a
commitment by the City to rezone the subject property; any such rezoning shall require an ordinance of
the City Council which shall be a legislative act which may be approved or denied by the City Council at
its sole discretion.
