RESOLUTION NO. PC2003-104
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 2003-00106 (STUDY AREA 8) BE GRANTED,
UNCONDITIONALLY
WHEREAS, on May 5, 2003, the Anaheim City Planning Commission did direct staff to
initiate petitions for Reclassification of certain areas within the Anaheim Colony Historic District, including
subject property, from multiple-family residential zoning to single-family residential zoning; and that
subject property consists 0.74 acres situated in the City of Anaheim, County of Orange, State of
California, described as follows:
THAT CERTAIN RECTANGULAR PROPERTY LOCATED AT THE SOUTHWESTERLY
CORNER OF ADELE STREET AND EMILY STREET, AND HAVING FRONTAGES OF
173 FEET ON THE SOUTHERLY SIDE OF ADELE STREET AND 112 FEET ON THE
WESTERLY SIDE OF EMILY STREET; AND
THAT CERTAIN RECTANGULAR PROPERTY HAVING A FRONTAGE OF 90 FEET ON
THE WESTERLY SIDE OF EMILY STREET, BEING LOCATED 138.25 FEET
SOUTHEAST OF THE CENTERLINE OF ADELE STREET AND APPROXIMATELY 183
FEET NORTHWEST OF THE CENTERLINE OF CYPRESS STREET, AND HAVING A
DEPTH OF 120 FEET.
WHEREAS, the above-described properties, which are addressed at 206, 214 and 216
East Adele Street and 317 and 321 North Emily Street, are illustrated on the Location Map (labeled 'Study
Area 8') attached to the Staff Report to the Planning Commission dated June 30, 2003, Item No. 11; and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center
in the City of Anaheim on June 30, 2003 at 1:30 p.m., notice of said public hearing having been duly
given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter
18.03, to hear and consider evidence for and against said proposed reclassification and to investigate
and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by
itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing,
does find and determine the following facts:
4. That the proposal is for reclassification of Study Area 8 from the PD-C/RM-2400 (Parking
District-Commercial/Residential, Multiple-Family) Zone to the RS-5000 (Residential, Single-Family) or a
less intense zone.
2. That the Anaheim General Plan designates subject property for Low-Medium Density
Residential land use.
3. That the subject property is located within the Anaheim Colony Historic District, which
District is bounded by North, East, South and West Streets; and that the proposed reclassification of
subject property is necessary and/or desirable for the orderly and proper development of the communiry.
4. That the proposed reclassification of subject property does properly relate to the zones
and their permitted uses locally established in close proximity to subject property and to the zones and
their permitted uses generally established throughout the community.
5. That one person spoke at the public hearing in opposition to the proposal; and that no
correspondence was received in opposition.

6. That seven people indicated their presence at the public hearing in favor of the proposal.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposed reclassification from the PD-C/RM-2400 (Parking
District-Commercial/Residential, Multiple-Family) Zone to the RS-5000 (Residential, Single-Family) or a
less intense zone on a 0.74-acres irregularly-shaped property located at the southwest corner of Adele
Street and Emily Street, having frontages of 173 feet on the south side of Adele Street and 201 feet on
the west side of Emily Street, and further described as 206 through 216 East Adele Street and 317 and
321 North Emily Street; and does hereby approve the Negative Declaration upon finding that the
declaration reflects the independent judgment of the lead agency and that it has considered the Negative
Declaration together with any comments received during the public review process and further finding on
the basis of the initial study and any comments received that there is no substantial evidence that the
project will have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission
does hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning
Map of the Anaheim Municipal Code to exclude the above-described property (Study Area 8) from the
PD-C/RM-2400 (Parking District-Commercial/Residential, Multiple-Family) Zone and to incorporate said
described property into the RS-5000 (Residential, Single-Family) Zone, unconditionally.
BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a
commitment by the City to rezone the subject property; any such rezoning shall require an ordinance of
the City Council, which shall be a legislative act, which may be approved or denied by the City Council at
its sole discretion.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
June 30, 2003.
