A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
ADOPTING AND RECOMMENDING TO THE CITY COUNCIL ADOPTION OF
GENERAL PLAN AMENDMENT NO. 2002-00407, EXHIBIT A,
PERTAINING TO THE LAND USE ELEMENT
WHEREAS, the Anaheim City Council did adopt the Anaheim General Plan by Resolution
No. 69R-644, showing the general description and extent of possible future development within the City;
and
WHEREAS, the Anaheim City Planning Commission did direct staff to initiate an
amendment to the Land Use Element of the General Plan to redesignate the westerly portion (which lies
within unincorporated Orange County) of a study area consisting of an irregularly-shaped 1.7-acre
property located at the southwest corner of Ball Road and Brookhurst Street, having frontages of 364 feet
on the south side of Ball Road and 230 feet on the west side of Brookhurst Street, and further described
as 1201 South Brookhurst Street from the Low Density Residential land use designation to the General
Commercial land use designation; and
WHEREAS, the Planning Commission did hold a public hearing at the Anaheim Civic
Center, Council Chamber, 200 South Anaheim Boufevard, on January 13, 2003, at 1:30 p.m., notice of
said public hearing having been duly given as required by law and in accordance with the provisions of
the Anaheim Municipal Code, to hear and consider evidence for and against said General Plan

that the hearing was continued to the January 27 and February 24, 2003 meetings; and
WHEREAS, said Commission, after due consideration, inspection, investigation and

DOES HEREBY FIND:
1. That the evidence presented substantiates the need for an amendment to the Anaheim
General Plan and that, therefore, Exhibit A should be adopted redesignating subject area for General
Commercial land uses.
2. That the General Commercial land use designation is compatible with the adjacent and
surrounding zone classifications and land uses, and will provide for appropriate commercial uses near the
intersection of two major arterial highways, and will ensure compliance with the development standards of
the underlying CL (Commercial, Limited) and CL(BCC) (Commercial, Limited-Brookhurst Commercial
Corridor Overlay) zones.
3. That no one indicated their presence at the public hearing on January 13 and January 27,
2003 in favor of the proposal; and that one person representing the West Anaheim Neighborhood
Development Council ("WAND") was present at the February 24, 2003 public hearing and spoke in favor
of the request but relayed some concerns regarding the development proposal.
4. That no one indicated their presence at the public hearing on January 13, 2003 in
opposition to the proposal; that finro people who were present at the January 27, 2003 public hearing
indicated their opposition to the sale of beer and wine at a convenience market proposed in connection
with Conditional Use Permit No. 2002-04641 which is being processed concurrently with this General
Plan Amendment; and that four people present at the February 24, 2003 public hearing indicated their
opposition to the sale of beer and wine at the proposed convenience market.

CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City
Planning Commission has reviewed the proposal to amend the Land Use Element of the General Plan to
change the designation of the westerly portion (which lies within unincorporated Orange County) of an
irregularly-shaped 1.7-acre property located at the southwest corner of Ball Road and Brookhurst Street,
having frontages of 364 feet on the south side of Ball Road and 230 feet on the west side of Brookhurst
Street, and further described as 1201 South Brookhurst Street (Arco AM/PM Service Station) from the
Low Density Residential land use designation to General Commercial land use designation; and does
hereby approve the Negative Declaration upon finding that it has considered the Negative Declaration
together with any comments received during the public review process and further finding on the basis of
the initial study and any comments received that there is no evidence that the project will have a
significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, the
Anaheim City Planning Commission does hereby adopt and recommend to the City Council of the City of
Anaheim adoption of General Plan Amendment No. 2002-00407, Exhibit A, pertaining to the Land Use
Element to redesignate the westerly portion of the study area from the Low Density Residential land use
designation to the General Commercial land use designation.
THE FOREGOING RESOLUTION was adopted at t e Planning Commission meeting of
