A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
THAT PETITION FOR RECLASSIFICATION NO. 2003-00104 BE GRANTED, UNCONDITIONALLY
WHEREAS, on May 5 and May 19, 2003, the Anaheim City Planning Commission did direct
staff to initiate petitions for Reclassification of certain areas within the Anaheim Colony Historic District,
including subject properties, from multiple-family residential zoning to single-family residential zoning; and
that subjecf properties consist of 36 lots totaling approximately 6.5 acres situated in the City of Anaheim,
County of Orange, State of California, described as follows:
809, 815, 817, 825, 903, 907, 911, 915, 919, 923, 1001, 1007, 1011, 1015, 1021 and 1025
West Broadway; 804, 808, 812, 816, 900, 902, 904, 924, 928, 930, 936, 940, 1000, 1004,
1018, 1022 and 1024 West Broadway; 217 South Illinois Street and 216 South West Street:
DESCRIBED AS THOSE CERTAIN PARCELS LOCATED ON THE NORTH AND SOUTH
SIDES OF BROADWAY BETWEEN WEST STREET AND CITRON STREET, AND
BORDERED ON THE NORTH BY THAT CERTAIN PUBLIC ALLEY LOCATED
APPROXIMATELY 185.75 FEET NORTH OF AND PARALLEL TO THE CENTERLINE OF
BROADWAY, AND BORDERED ON THE SOUTH BY THAT CERTAIN PUBLIC ALLEY
LOCATED APPROXIMATELY 169.25 FEET SOUTH OF AND PARALLEL TO THE
CENTERLINE OF BROADWAY;
AND

DOLAN TRACT, IN THE CITY OF ANAHEIM, AS SHOWN ON A MAP THEREOF
RECORDED IN BOOK 13, PAGE 23, MISCELLANSOUS MAPS, RECORDS OF ORANGE
COUNTY.
WHEREAS, the above-described real properties are illustrated on the Location Map (labeled
Study Area 3) attached to the Staff Report to the Planning Commission dated June 30, 2003, Item No. 9;
and
WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in
the City of Anaheim on June 30, 2003 at 1:30 p.m., notice of said public hearing having been duly given as
required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to
hear and consider evidence for and against said proposed reclassification and to investigate and make
findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by itself
and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find
and determine the following facts:
1. That the proposal is to reclassify those properties located at 809 to 1025 West Broadway,
804 to 1024 West Broadway, 217 South Illinois Street and 216 South West Street from the RM-2400
(Residential, Multiple-Family) Zone to the RS-5000 (Residential, Single-Family) or a less intense zone; and
to reclassify that property located at 315 South Citron Street from the RM-2400 (Residential, Multiple-Family)
to the RS-7200 (Residential, Single-Family) or a less intense zone.
2. That the Anaheim General Plan designates the properties at 809 to 1025 West Broadway,
804 to 1024 West Broadway, 217 South Illinois Street and 216 South West Street for Low-Medium Density
Residential land use; and designates the property at 315 South Citron Street for Low Density Residential
land use.
3. That the subject properties are located within the Anaheim Colony Historic District, which
District is bounded by North, East, South and West Streets; and that the proposed reclassification of subject
properties is necessary and/or desirable for the orderly and proper development of the community.

4. That the proposed reclassification of subject properties does properly relate to the zones and
their permitted uses locally established in close proximity to subject properties and to the zones and their
permitted uses generally established throughout the community.
5. That one person was present at the public hearing in opposition to the proposal; and that no
correspondence was received in opposition.
6. That six people spoke at the public hearing in favor of the proposal.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning
Commission has reviewed the proposed reclassification of certain properties totaling approximately 6.5 acres
as follows: 35 parcels located on the north and south sides of Broadway between West Street and Citron
Street, and between the public alleys located parallel to and north and south of Broadway, and further
described as 809 to 1025 West Broadway, 804 to 1024 West Broadway, 217 South Illinois Street and 216
South West Street from the RM-2400 (Residential, Multiple-Family) Zone to the RS-5000 (Residential,
Single-Family) Zone, and one parcel located at the southwest corner of Citron Street and the public alley
parallel to and south of Broadway, and further described as 315 South Citron Street from the RM-2400
(Residenfial, Multiple-Famify) to the RS-7200 (Residential, Single-Famify) Zone; and does hereby approve
the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead
agency and that it has considered the Negative Declaration together with any comments received during the
public review process and further finding on the basis of the initial study and any comments received that
there is no substantial evidence that the project will have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby approve the subject Petition for Reclassification to authorize an amendment to the Zoning Map of the
Anaheim Municipal Code to excfude the a5ove-d~~~~ibed preperti~s to~~~ed at 809 to 1025 tNest Broadway,
804 to 1024 West Broadway, 217 South Illinois Street and 216 South West Street from the RM-2400
(Residential, Multiple-Family) Zone and to incorporate said described properties into the RS-5000
(Residential, Single-Family) Zone, and to exclude the above-described property located at 315 South Citron

the RS-7200 (Residential, Single-Family) Zone, unconditionally.
BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a
commitment by the City to rezone, the subject properties; any such rezoning shall require an ordinance of
the City Council which shall be a legislative act which may be approved or denied by the City Council at its
sole discretion.
