PC2003-99 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION THAT PETITION FOR RECLASSIFICATION NO. 2003-00106 (STUDY AREA 1) BE GRANTED, UNCONDITIONALLY WHEREAS, on May 5 and May 19, 2003, the Anaheim City Planning Commission did direct staff to initiate petitions for Reclassification of certain areas within the Anaheim Colony Historic District, including subject properties, from multiple-family residential zoning to single-family residential zoning; and that subject properties total approximately 3.32 acres situated in the City of Anaheim, County of Orange, State of California, described as follows: PORTION A LOTS 15 THROUGH 22 IN BLOCK 1 OF THE ENTERPRISE TRACT, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 4, PAGE 89 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY; AND LOTS 15 THROUGH 23 IN BLOCK 2 OF THE ENTERPRISE TRACT, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP RECORDED IN BOOK 4, PAGE 89 OF MISCELLANEOUS MAPS, IN THE OFFICE OF - T~i~-COUNfiY-RECOR~7~R O~ S/XfD COUNfiY: --- - - --- - - PORTION B LOTS 4 Ti-iF20UGi~ i ii~1 BLO~~C 2 JF i HE `E~ITERPRISE TRACT', A SUBDiViSiON OF A PART OF VINEYARD LOT `E6', ANAHEIM, AS SHOWN ON A MAP RECORDED IN BOOK 4, PAGE 89 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA. WHEREAS, the above-described real properties, which are addressed at 517, 521, 525, 529, 533, 537, 539 and 543 West Chestnut Street, and 512, 516, 520, 524, 526, 530, 534, 540 and 542 West Chestnut Street, and 513, 517, 521 and 527 West Broadway, are illustrated on the Location Map (labeled `Study Area 1') attached to the Staff Report to the Planning Commission dated June 30, 2003, Item No. 11; and WHEREAS, the City Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 30, 2003 at 1:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.03, to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposal is to reclassify Study Area 1 as follows: reclassification of Portion `A', which is located at 517 through 543 West Chestnut Street and 512 through 542 West Chestnut Street, from the RM-2400 (Residential, Multiple-Family) and PD-C/RM-2400 (Parking District - Commercial/Residential, Multiple-Family) Zones to RS 5000 (Residential, Single-Family) or a less intense zone; and reclassification of Portion `B', which is located at 513 through 527 West Broadway, from the RS-2400 (Residential, Multiple-Family) Zone to RS-7200 (Residential, Single-Family) or a less intense zone. cr\PC2003-099.doc -1- PC2003-99 • • 2. That the Anaheim General Plan designates the properties on the north and south sides of Chestnut Street for Low-Medium Density Residential land uses and the properties on the north side of Broadway for Medium Density Residential land uses. 3. That the subject properties are located within the Anaheim Colony Historic District, which District is bounded by North, East, South and West Streets; and that the proposed reclassification of subject properties is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locally established in close proximity to subject property and to the zones and their permitted uses generally established throughout the community. 5. That one person spoke at the public hearing in opposition to the proposal; and that no correspondence was received in opposition. 6. That seven people indicated their presence at the public hearing in favor of the proposal. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim City Planning Commission has reviewed the proposal for reclassification of twenty one properties totaling 3.32 acres as follows: Portion `A' - RM-2400 (Residential, Multiple-Family) and PD-C/RM-2400 (Parking District - Commercial/Residential, Multiple-Family) zoning to RS 5000 (Residential, Single-Family) or less intense zoning on a rectangular parcel having a frontage of 381 feet on the north side of Chestnut Street and a depth of 139 feet, and being located 215 feet west of the centerline of Harbor Boulevard (517 through 543 West Chestnut Street) and a rectangular parcel having a frontage of 422 feet on the south sicte ofi Clrestnut ~treet arrd a maximum ctepth of 148 feet, and-b~irrg focated 174 feet west of the centerline of Harbor Boulevard (512 through 542 West Chestnut Street); and Portion 'B' - RS-2400 (Residential, Multiple-Family) zoning to RS-7200 (Residential, Single-Family) or less intense zoning on a rectangular parcel having a frontage of 193 feet on the north side of Broadway and a depth of 154 feet, and being locat2d ~ 78 feet ivest of the centerfine of Harbor Soulevar~ (5~ 3 through 527 West Broadway); and does hereby approve the Negative Declaration upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve the subject Petition for Reclassification (Study Area 1) to authorize an amendment to the Zoning Map of the Anaheim Municipal Code as follows: Portion A: To exclude the above-described lots located on the north and south sides of Chestnut Street at 517 through 543 West Chestnut Street and 512 through 542 West Chestnut Street from the RM-2400 (Residential, Multiple-Family) and PD-C/RM-2400 (Parking District - Commercial/Residential, Multiple-Family) Zones and to incorporate said described lots into the RS-5000 (Residential, Single-Family) Zone, unconditionally, and Portion B; To exclude the above-described lots located on the north side of Broadway at 513 through 527 West Broadway from the RS-2400 (Residential, Mulfiple-Family) Zone and to incorporate said described lots into the RS-7200 (Residential, Single-Family) Zone, unconditionally. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council, which shall be a legislative act, which may be approved or denied by the City Council at its sole discretion. -2- PC2003-99 ~ • June 30, 2003.
