A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION
TERMINATING AL~ PROCEEDINGSJN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 379 AND 3436
(736 SOUTM BEACH BOULEVARD AND 2966 WEST STONYBROOK DRIVE)
WHEREAS, on April 30, 1963 Conditional Use Permit Na 379 the Anaheim City Council did, by
its Resolution No. 63R-350, grant to construct a service station; and ' '
WHEREAS, on July 29, 1991 Conditional Use Permit No. 3436 the Anaheim Planning
Commission did, by its Resolution Na PC91-114, grant to construct a four story, 61-unit motel, including a
manager's unit; and
WHEREAS, John Ward, property owner, has submitted a letter requesting termination of
Conditional Use Permit Nos. 379 and 3436 to comply with the Condition of approval No. 24 of Resolution Na
PC2004-36, for Conditional Use Permit Na 2004-04831 (to construct a 7-unit detached one-family residential
airspace condominium with the waivers) approved by the Planning Commission on April 4, 2004, requires the
property owner to submit a letter to the Zoning Division requesting termination of Conditional Use Permit Nos.
379 and 3436 since these entitlements are no longer needed.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Planning Commission does hereby
terminate all proceedings in connection with Conditional Use Permit Nos.379 and 3436 on the basis of the
foregoing findings.
BE IT FURTHER RESOLVED that the Anaheim Planning Commission does hereby find and
determine that adoption of this Resolution is expressly predicated upon applicanYs compliance with each and all
of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or
unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any
approvals herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
September 8, 2004. Said resofution is subject to the appeal ovisions set forth in Chapter 18.60 "Procedures"
of the Anaheim Municipal Code pertaining to appeal p ur s and m aced by a City Council
Resolution in the event of an appeal. ~~-~" '
