RESOLUTION NO. PC2005-100
A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS1N GQNNECTION WITH '
CONDITIONAL USEPERMIT N0. 3471
(425 NORTH MAGNOLIA AVENUE) "
WHEREAS, on December 16, 1991, the Anaheim Planning Commission, by its Resolution Na '
PC91-198, grant Conditional Use Permit Na 3471 to permit the conversion of an existing 128-unit apartment'
complex to a 128-unit, 21=1ot air-space condominium complex with waiver of required lot frontage, minimum Iot
w+dth; m~nimum floor area; permitted encroachment to required yards, minimum distance between building and
landscaped setback at 425 North Magnolia Avenue; and
WHEREAS, Mark Whitehead property agent, has submitted a letter requesting termination of
Conditional Use Permit No. 3471 to comply with the condition of approval of_no. 11 of Resolution No. PC2004-
120, for Conditional Use Permit No. 2004-04898 (to construct a 114-unit attached and detached residential
condominium with waiver of maximum building wall length) approved by the:Planning Commission on October
10, 2004, requiring the property owner to submit a'letter to thePlanning Services Division requesting termination
of Conditional Use Permit No. 3471 sincethis entitlement is nolonger needed.
NOW, THEREFORE, BE 1T RESOLVED that the Anaheim City Planning Commission does '
hereby terminate all proceedings in connection with Conditional Use Permit Na 3471 on the basis of the '
foregoing findings.
BE IT FURTHER RESOLVED that the Anaheim Planning Commission does' hereby find and
determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all
of the conditions hereinabove set forth. Should any such condition, or any part thereof; be declared invalid or
unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any
approvals herein contained, shall be deemed null and void. ,
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of July 25,
2005. Said resolution is subject to the appeal provisions set forth in Ch er 18.60 "Proc s" of the Anaheim '
Municipal Code pertaining to appeal procedures and may pl b~ City i Re ution in the event
