RESOLUTION NO. PC2005-23
' A RESOLUTION (OF THE ANAHEIM CITY PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS IN CONNECTION WITH
CONDITIONAL USE PERMIT NO. 3150
(1198 SOUTH STATE COCLEGE BOULEVARD)
WHEREAS; on April 25, 9989, the Anaheim Pianning' Commission, by its Resofution Na
PC89-113, did grant Conditional Use Permit No: 3150 to permit a self-serve gas station with convenience
sfore at 1198 South State College Blvd; and
WHEREAS, Mr. Bhupinder, property owner, submitted a letter dated December 12, 2004,
requesting termination of Conditional Use Permit Na 3150 to comply with the Condition of approval Na 10 of
Resolution No. PC2003-137, Conditional Use Permit No. 2003-04758 (to raise the canopy height for a
previously approved service station with a conVenience market with the off-premise sale and consumption of
beer and wine) approved by t~ie Planning Commission on October 6, 2003, requires the property owner. to
submit a letter to the Planning Services Division requesting termination of Conditional Use Permit No. 3150
since this entitlement is no longer needed. :
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby terminate all proceedings in connection with Conditional Use Permit No. 3150 on the basis of the
foregoing findings.
BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find
and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with
each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be
declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then #his
Resolution, and any approvals herein contained, shall be deemed null and void.
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of
February 7, 2005. Said resolution is subject to the appeal provisions se h in Chapter 18.60 `Procedures"
ofthe Anaheim Municipaf Code pertaining to appeal procedure ma e repla ~d ity Council
Resolution in the event of an appeaL --
