A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION
THAT PETITION FOR RECLASSIFICATION N0. 2007-00199
BE GRANTED, UNCONDITIONALLY
(212 SOUTH BEACH BOULEVARD) :
WHEREAS, the AnaheimPlanning Comm`ission did receive a verified petition for
Reclassification for real property situated in the City of Anaheim, County of Orange, State of California,
described as follows
ALL THAT CERTAIN REAL PROPERTY SITUATED'IN THE CITY OF ANAHEIM,
COUNTY OF ORANGE, STATE OF'CALIFORNIA AND DESCRIBED AS FOLLOWS:
THE SOUTH 5 ACRES OF THE WEST 10 ACRES OF THE NORTHWEST QUARTER
OF THE NORTHWEST QUARTER OF SECTION 13, TOWNSHIP 4 SOUTH,RANGE
' 11 1N THE RANCH010S COYOTES, AS SHOWN ON A MAP RECORDED INBOOK
51, PAGE 11 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE'COUNTY,
CALIFORNIA. ,
EXCEPT THAT PORTION THEREOF DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHEAST CORNER OF SAID SOUTH 5 ACRES; THENCE '" -
NORTH 334.76 FEET ALONG THE EAST LINE THEREOF; THENCE WEST 325:24
FEET TO THE WEST LINE OF THE NORTHWEST QUARTER OF SAID SECTION 13;
THENCE SOUTH 334.85 FEET ALONG SAID WEST LINE TO THE SOUTHWEST
CORNER OF SAID SOUTH 5 ACRES; THENCE EAST 325.24 FEET TO THE POINT

ALSO EXCEPT THAT PORTION THEREOF CONVEYED BY MERNA G. CRANDALL
AND NUSBAND TO THE STATE OF CALIFORNIA BY DEED RECORDED APRIL 19,
1951 IN BOOK 2178, PAGE 80 OF OFFICIAL RECORDS OF SAID ORANGE
COUNTY.
WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of
Anaheim on May 14, 2007, at 2:30 p.m., notice of said public hearing having been duly given as required by law
and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60 "Procedures", to hear and
consider evidence for and against said proposed reclassification and to investigate and make findings and
recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation and study made by itself and
in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and
determine the following facts
1. That this is a City-initiated request for reclassification of subject property from the GG (General
Commercial) zone to the RM-3 (Multiple Family Residential) zone or less intense zone.
2. That the Anaheim General Plan designates the property for Low-Medium Density Residential
land uses and the proposed RM-3 (Multiple Family Residential) zone is an appropriate implementation zone for
this land use designation.
3. That the proposed reclassification of subject property is necessary and/or desirable for the
orderly and proper development of the community.

4. - That the proposed reclassification of subject property does properly relate to the zones and their
permitted uses locally;established in ciose proximity to subject property and to the zones and their permitted
uses generally established throughout the community because it would result in a residential project that is
consistent with the type of housing envisioned for the area:
5. That 3 people indicated their presence at said public'hearing irr opposition (2 represented the
West Anaheim Neighborhood Development Council - WAND) and photographs were submitted. A letter from
WAND was received in opposition to subject petition.
CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim Planning Commission °
has reviewed the proposal; and does hereby approve the Negative Declaration upon finding that the declaration
reflects the independent judgment of the lead agency and that it has considered the Negative Declaration
together with any comments received during the public review process and further finding on the basis of the
initia( study and any comments received that there is no substantial evidence that the projecf will have a
' significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim Planning Commission does hereby
unconditionally approve the subject petition #or Reclassification to authbrize an amendment#o #he Zoning Map
of the Anaheim Municipal Code to exclude the above-described property from the GG (General Commercial) ,
zone and to incorporate said described property,into the RM-3 (Multiple Family Residential) zone.
BE IT FURTHERRESOLVED, that this resolution shall not constitute a rezoning of, or a commitment
by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council,-
which shall be a legislative act, which may be approved or denied by the City Council at its sole discretion. .
THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of '
May 14, 2007. Said resolution is subject to the appeal provisions set forth in Chapter 18.60 "Procedures" of the
Anaheim Municipal Code pertaining to appeal procedures and ma r ed by City Council Resolution in
the event of an appeaL ,
