2004-189RESOLUTION NO. 2004-189 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 92R-17 WHICH ESTABLISHED PERSONNEL RULES FOR MANAGEMENT CONFIDENTIAL AND NON-REPRESENTED PARI'-TIME CLASSIFICATIONS WHEREAS, the Human Resources Director has recommended in a staff report dated August 24, 2004, that Resolution No. 92R-17 be amended in the manner hereinafter set forth, and WHEREAS, as a result thereof, the need exists to amend Resolution No. 92R-17 which established Personnel Rules for Management, Confidenbal and Non-Represented Pad- Time Classifications. NOW, THEREFORE BE IT RESOLVED b~,- the City Counci! of the City of Anaheim as follows' That Personnel Rule 10, Salary Reduction Susoension, Demodon and Dismissal, be amended to read as follows: "Rule 10. Salary Reduction: Suspension, Demobon and Dismissal Section 10.0 The tenure of every fuli-time confidential, management and non- represented part-time employee shall be conditioned on good behav;or and satisfactory work performance. Any employee may be suspended, reduced ii*, salary, demoted or dismissed for good and sufficient cause. 10.01 When, in the judgment ct the appropriate Execubve Manager, a non- exempt Confidential or non-~'epreser, ted part-time emoloyee's work performance or conduc? iustifies discipiinary action short of demotion or dish'., dssal, the employee may b~ suspended without Oa~, or reduced in salaw. !0 O2 When an employee in a confidential or management classification designated as "Exempt" has been deter.mined by ';:he aopropriate Executive lVtanager to have violated workplace conduct rules, the Executive Manager may suspend such employee without pay in any number of full work-day increments up to sixty (60) days. Alternatively, the sala,'y of an exempt emp!oyee found to have violated workplace conduct rules may be reduced to a ievel of not less than $455 per week. BE IT FURTHER RESOLVED that the effective date of this Resolution shall be August 23, 2004. AND, BE IT FURTHER RESOLVED that except as amended herein, Resolution No. 92R-17 shall remain in full force and effect.
