RESOLUTION NO. 2021- 101
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING PUBLIC SERVICE EASEMENTS
LOCATED UPON ASSESSOR'S PARCEL NUMBERS 085-641-
29 AND 365-491-01 PURSUANT TO CALIFORNIA STREETS
AND HIGHWAYS CODE SECTION 8330, ET SEQ. —
SUMMARY VACATION (ABA2020-00403).
WHEREAS, the Community Services Department has requested the vacation of certain
public service easements generally located upon Assessor's Parcel Numbers 085-641-29 and 365-
491-01, in the City of Anaheim, County of Orange, State of California, as more particularly
described below (individually, "Public Service Easement" and collectively, "Public Service
Easements"), in conjunction with the realignment of a multi -use recreation trail easement as
granted to the City as City Deed 12559; and
WHEREAS, the City of Anaheim ("City of Anaheim") acquired the Public Service
Easements for pedestrian and equestrian trial ("Public Service Purposes"); and
WHEREAS, the Public Service Easements are not necessary for present or prospective
Public Service Purposes or any other public purpose; and
WHEREAS, the Public Service Easements to be vacated have been determined to be
excess and superseded by relocation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim
does hereby order the vacation of the Public Service Easements (1) for equestrian trail purposes as
shown on Tract Map 10973 recorded in Book 557, Pages 4 through 11 of Miscellaneous Maps in
the Office of the Orange County Recorder and (2) for pedestrian and equestrian trail purposes as
shown on Tract Map 10974 in Book 578, Pages 42 through 46 of Miscellaneous Maps in the Office
of the Orange County Recorder and more particularly described in Exhibit "A" and Exhibit "A-1"
attached hereto and incorporated herein by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby makes
this vacation pursuant to the requirements of the California Streets and Highways Code, Division
9, Part 3 Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall not
be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized and
directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall
be complete and the Public Service Easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 2 day of Ncwemher , 2021, by the following roll call vote:
