Mayor Krein called the meeting to order. MINUTES: Minutes of the Anaheim City Council Meeting held May 17, 1966 were approved on motion by Councilman Pebley, seconded by Councilman Dutton. MOTION CARRIED. WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Dutton moved to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading is hereby given by all Councilmen, unless after reading of the title, specific request is made by a Councilman for the readin9 of such ordinance or resolution. Councilman Pebley seconded the motion. MOTION UNANIMOUSLY CARRIED. PUBLIC HEARING - PROPOSED AMENDMENT TO ANAHEIM MUNICIPAL CODE: Public hearing was scheduled pursuant to City Planning Commission Resolutions Nos. 2020 and 2021, Series 1965-66, recommending amendments to Titles i8 and 17 respectively~ Chapters 18.28 and 17~08o Plannlng Superwsor Ronald Grudzinski briefly reviewed the back- ground of the proposed amendments, advising that the City has recently re- ceived requests for single family developments, uslng 5~000 square foot lot areas, on properties approved for R-2 and R-3 zoning. Approval of such requests would reduce the density of multiple zoned property approximately 6 dwelling units per acre~ and rather than jeopardize R-1 zoning standards of ?~200 square foot lot areas, a recommended ordinance was drafted incorporating the proposed amendments (Exhibit A), which would provide lots 50 feet in width, and 5,000 square feet in area for developments of detached single family homes on property zoned R-2 or R-3. Cou~,.ci] discussion was held, and Councilman Chandler was of the opinion that to include the smaller lots in the R-2 and R-3 Zone would be less satisfactory than to esiabllsh a new zone~ such as 'R-l, 5~000". Development Services Director Alan Orsborn called attention to the advantages and to adjoining communities having fine homes on small lots. Hodges for amendment to landscaping requirement of Reclassification No. 59-60-103 (Condition No. i, Ordinance No. 1516), was submitted. ORDINANCE NO. 2293: On the recommendations of the Development Services Department, Councilman Dutton offered Ordinance No. 2293 for first reading. AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ORDINANCE NO. 1516 IN RECLASSIFICATION PROCEEDINGS NO. 59-60-103. RECLASSIFICATION NO. 64-65-19 AND CONDITIONAL USE PER, IT NO. 6la: Final plans of development submitted by S. W. Farrell, Farrell Realty, for proposed convalescent hospital with medical building at 2050 South Euclid Street, were reviewed together with reports from the City Engineer and Zonin9 Division. Said final plans were approved, as recommended by the Development Services Department, on motion by Councilman Schutte, seconded by Councilman Pebley. MOTION CARRIED. ORANGE COUNTY USE VARIANCE NO. 5741: Proposing to establish an office for the sale of motorcycles in an existing garage, and elimination of the required covered off-street parking in connection with an existing dwelling in the R-P, Residential Professional district; property located on the east side of Brookhurst Street, north of Lincoln Avenue. Excerpt from the minutes of the City Planning Commission meeting held June 6, 1966, was submitted recommending that the Orange County Planning Commission require the following conditions, if subject variance was granted: 1. That the petitioner dedicate 60 (mO feet existing) from the centerline of the street for Brookhurst Street for street widening purposes. 2. That the construction of the street improvements for Brookhurst Street be in accordance with standards of the City of Anaheim° 32 That the use of a dwelling as a residence in the commercial zone be permitted only if used by the proprietor, the manager, or the custodian. 4. That at such time as the street is widened and improved, if the resi- dential structure is still in use, the remaining asphalt areas in the front ward be removed and the area landscaped as required by the City of Anaheim standards. On motion by Councilman Chandler, seconded by Councilman Schutte, the City Council sustained the recommendation of the City Planning Commission, and ordered copy thereof forwarded to the Orange County Planning Commission. ALCOHOLIC BEVERAGE LICENSE APPLICATIONS: The following applications were presented by the City Manager to the City Council for their information: A. Application submitted by John Jennings Thompson Jr., for Person to Person Transfer of Off-Sale Beer and Wine license at the Speedee Mart #206, 801 South Euclid Street (C-1 zone). B. Application submitted by Betty G. Berkitz for Person to Person Transfer of On-Sale Beer license at the Meet'n Room, 2660 West Lincoln Avenue (Variance No. 1012). No Council action was taken on the foregoing applications. VARIANCE NO. 1774: Submitted by Gulf Oil Company requesting waiver of maximum number of signs permitted, sign height, maximum permitted sign area and sign location; property briefly described as located at the northeast corner of La Palma Avenue and Dowling Street. Public hearing was held May 10, 1966, at which time the hearing was closed and resolution denying said variance deferred to May 24, 1966 for a full Council; said resolution failing to carry, the applicant was ad- vised to present plans indicating the location of the proposed sign, and to obtain a letter of consent from the adjacent property owner; determina- tion continued to May 31, 1966, and again deferred to this date. The City Clerk read letter received this date at open meeting from W. A. Parish, of Gulf Oil Corporation, advising that adjacent properties on both Dowling Street and La Palma Avenue are owned by Gulf Oil Corporation. Mr. Mickelson, of Mickelson Associates, submitted for Council review photographs illustratin9 the type of sign they propose to erect on subject property (photographs retained for the file). In answer to Council questioning, he advised that the sign would read "Gulf" and would have no other advertising thereon, that it would be erected to a height of 53 feet. RESOLUTION NO. 66R-397: Councilman Dutton offered Resolution No. 66R-397 for adoption, granting Variance No. 1774, subject to the following conditions: 1. That adequate clearance of existing electrical lines shall be provided as req,ired by the Electrical Division~ Department of Public Utilities, and the State of California G.O. 95. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. !, 2 and 3. 3. That the sign shall be no h,gher tha!t the highest existing oil company sign at the intersection of La Palma Avenue and Dowling Street. 4. That the sign shall have a maximum area of 300 square feet. REQUEST TO SOLICIT FUNDS - FULLERTON LIONS CLUB: The City Manager reported on request received from the Fullerton Lions Club for permission to solicit funds in the City of Anaheim in conjunction with their annual community fair. CONTINUED PUBLIC HEARING - CONDITIONAL USE PER14IT NO. 704: Submitted by Robert L. Panek requesting permission for an ambulance service sub-station in an existing single-family residential structure; property located at the north- east corner of Euclid Street and Alomar Avenue (630 South Euclid Street). Public hearing was held July 6, 1965, at which time resolution of intent for C-O zoning was adopted under Reclassification No. 6m-65-128, and Conditional Use Permit Nco 70~ was denied. Re-hearing was scheduled November 9, 1965, to consider additional evidence, at which time six months interim permit for ambulance sub-station on subject property was granted, axO sald re-hearing was continued to this date. Mr. Tom Royston, 715 A1vy Street, requested permission to address the City Council as spokesman for the neighborhood. He advised that they did not object to the ambulance service nor to the C-O zoning approved on Jul'/ 6, 1965; however they were opposed fo C-1 zoning, which they feared would result in high-rise commercial buildings adjacent to their homes, and would further establish a precedent for additional requests of a similar nature in the area. 9481 City Hall~ Anaheim~ California - COUNCIL MINUTES - June 8~ 1966~ 1:30 P.M. Also noted were frequent gatherings of young people at the home located on subject property, and Mr. Royston objected to loud music on these occasions, which was audible for some distance away. He asked what could be done to correct the situation. Mr. Royston was informed that if anyone was disturbing the peace, the neighbors' recourse was to report the matter to the Police Department. Mr. Murdoch pointed out that the recommendations of the Development Services Department included the amendment of the Anaheim Municipal Code to allow ambulance services in all commercial zones by conditional use permit. Mrs. Pauline Berry, 631 South Alvy Street, called attention to the fact that in granting interim permit for the ambulance service, the City Council stipulated certain conditions, one of which was that the ambulance use Alomar Avenue in an easterly direction only when necessary. She advised that the ambulance travels east on Alomar Avenue on the average of once each day, at speed not necessarily higher than normal traffic. Mrs. Berry further advised that although the owner of the ambulance service had previously stated he was unable to find another suitable location for sub-station, there was resently advertised a house in the C-1 Zone located near Ball Road and Nutwood Street, which she felt would be a better location as it was some distance away from other homes, and situated on a major street. Mr. E. Richard Crane, owner of Crane Ambulance, addressed the Council advising that he had no knowledge of the property referred to by Mrs° Berry, however it would not be as centrally located as the property now in use. With reference to the young people and loud music, he stated that he had not been advised of any complaints of disturbance, or he would have made an effort to control the noise. Mr. Crane reported that the ambulance has traveled east on Alomar Avenue when making calls not in the nature of an emergency. He noted that there have been no registered complaints concerning excessive noise caused by the ambulance° Mrs. Berry reported that they have made no complaints, pending the expiration of the six months interim permit granted by the City Council. Mr. Steve Bagin, 635 Alvy Street, addressed the Council advising that he had resided in the house directly behind subject property for approximately eight months, and had no complaints as to the ambulance service. Mr, Joseph Ac Bradley, 707 Alvy Street, referred to the Development Services Department report and recommendations, being of the opinion that the conditional use permit procedure, in effect, would be a means of circumventing the commercial zoning, and he pointed out that over 66 percent of the other cities listed in the report do not allow ambulance services in the C-O zone. He asked if there would be any time limit established on the conditional use permit, and expressed concern that to allow this use in the C-0 zone, could open the door to other conditional use permit requests in the area, resulting in a profusion of poorly planned commercial use. Mayor Krein stated that a good cross section of the evidence had been presented, and thereupon declared the hearing closed. Discussion was held by the City Council and City Attorney, Councilmen Chandler and Dutton being of the opinion that the issue to be determined was that of land use. Councilman Chandler pointed out that the C-O zone, which basically allows business offices, was originally approved for subject property as the most limited commercial zoning, and the requested conditional use permit would limit the property to one specific use, with no time limitl however the conditional use permit would become null and void if the use ceased to exist. 9482 City Hall, Anaheim, California - COUNCIL MINUTES - June 8, 1966, 1:30 P.M. Assistant Development Services Director Robert Mickelson, advised that the recommendations of the staff were reviewed and sustained by the City Planning Commission on June 6, 1966. On the recommendations of the City Attorney, Councilman Chandler moved that action on Conditional Use Permit No. 704 be continued to September 13, 1966, 1:30 P.M., to allow amendment o£ the Anaheim Municipal Code as recommended by the Development Services Department. Councilman Dutton seconded the motion. MOTION CARRIED. MUNICIPAL IMPROVEMENT BONDS - $2,300,000.00: Official statement of Finance Director Douglas K. Ogden, relative to the sale of $2,300,000.00 bonds, was accepted by the City Council on motion by Councilman Pebley, seconded by Councilman Dutton. MOTION CARRIED. MINUTE CORRECTION: On motion by Councilman Schutte, seconded by.'Counailman Dutton, ±he City Clerk was authorized to amend the Minutes of fhe Anaheim City Council Meeting held May 24, 1966, Page 9446, under Resolution No. 66R-365, to read as follows: "RESOLUTION NO. 66R-365: Councilman Chandler offered Resolution No. 66R-365 for adoption, abandoning said easement between Evergreen Street and State College Boulevard only, excepting therefrom the northerly 5 feet, as requested by !he Light and Power Division. Refer to Resolution Book." MOTION CARRIED. MINUTES: Approval of the Minutes of the Anaheim City Council Meetings held May 24 and 31, and June 8, 1966, was deferred one week (June 21, 1966). WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Dutton moved to waive the reading in full of all ordinances and resolutions, and that consent to the waiver of reading is hereby given by all Coun¢ilmen~ unless after reading of the title, specific request is made by a Councilman for the reading of such ordinance or resolution.
