Mayor Krein called the meeting to order~ and announced that the
purpose of the meeting was to consider authorizing a contract between the
City of Anaheim and Tommy Walker Enterprises~ Inc~ for an exhibition of fire-
works in Anaheim Stadium July 4~ 19660
Terms of rental agreement in accordance with fee schedule adopted by
the City Council were discussed as they pertain to the special event to be
staged~ for the purpose of considering an amendment to the contract, providing
for a provision against loss~ inasmuch as the event is to be a patriotic dis-
play supported by the City of Anaheim as a public service°
In discussing the established fee scheduled~ it was determined that
the percentage of total fees was based and determined on total gross admission
revenue~ and not graduated as gross revenue fell into a different percentage
bracket°
Mro Walker brought to the Council's attention~ using the ten per cent
bracket as an example~ that the sale of one ticket could place the total
revenue in the twelve and one-half per cent bracket~ costing the entrepreneur
approximately $800o00o
Councilman Chandler suggested that an amendment to the fee schedule
be drafted~ wherein~ regardless of the percentage point~ if the sale of one or
more tickets increased the revenue to the next percentage bracket~ some adjust-
ment be provided up to a pointo
Mro Walker was of the opinion that the $59000°00 minimum should apply
~o all events; however~ the fee schedule should be analyzed on the basis of the
event~ perhaps on a graduated scale° He thereupon related possibilities in
connection with a musical program in comparison to a sporting or patriotic
event~ such as the one proposed,~
Mr~ Geisler read suggested wording wherein a formula for relief in
the event of loss could be established~ based on the fact that the display is
in the publ]z interest°
At the conclusion of the discussion~ on motion by Councilman Chandler,
seconded by Councilman Pebley~ it was determined that if the cost of production
exceeds the gross revenue by any part~ the producer can share in the net parking
and concessions to the extent of $5,000~00~ or to the actual net income from
concessions or parking~ whichever is lesser° MOTION CARRIED.
Councilman Chandler moved that where in the established fee schedule
a breaking point would place the fee charged in the next bracket~ in no case
shall the licensee be charged for the additional amount over his actual income
from the breakage point° Councilman Schutte seconded the motion. MOTION CARRRIED.
On motion by Councilman Chandler~ seconded by Councilman Pebley, the
~ayor and City Clerk were authorized to execute contract with Iommy Walker
Enterprises~ Inc~ MOTION CARRIED~
ADJOURNMENT: Councilman Chandler moved to adjourn,
the motion, MOTION CARRIED. (6:10 P,M.)
